A RESOLUTION SETTING FORTH APPROVAL OF A ZONING USE PERMIT FOR
THE ESTABLISHMENT OF A CELLULAR TELEPHONE COMMUNICATIONS FACILITY
IN AN A-R/36A (AGRICULTURAL RESIDEN'rIAL/THIRTY-SIX ACRE MINIMUM
LOT SIZE) ZONE IN A PORTION OF THE SW\ SECTION 4, TOWNSHIP 13
NORTH, RANGE 19 WEST, LOCATED IN THE LAKE HAVASU AREA, MOHAVE
COUNTY, ARIZONA
WHEREAS, at the regular meeting of the Mohave County Board
of supervisors held November 2, 1992 a public hearing was
conducted to determine whether approval should be granted to
Citizens Utilities Company of Kingman, Arizona, for a zoning Use
Permit (ZUP) for the establishment of a cellular telephone
communications
facility
in
an
A-R/36
(Agricultural
Residential/Thirty-Six Acre Minimum Lot Size) zone in a portion
of the SW~ Section 4, Township 13 North, Range 19 West, located
at the terminus of a new extension into Section 4 of Tropic Road,
located in the Lake Havasu area, and
WHEREAS, Section 4 is located immediately east of Lake
Havasu City and is approximately immediately north of Section 9
in which the Horizon Six subdivision is located.
The site is
accessed from McCulloch Boulevard via Tropic Boulevard.
Tropic
Boulevard currently ends at the city limits and the proposed
access road would be a continuation of that road to the proposed
site, and

WHEREAS, review of floodplain map #040058-3130B indicates
the washes traversing this site to be designated floodplains but
the remainder of the section is not so designated. This site is
being leased by Citizens Utilities Company from the Arizona State
Land Department.
This site is currently vacant.
Surrounding
land uses consist of Lake Havasu City to the west, vacant land to
the east and north with vacant land and Horizon Six to the south.
The applicant proposes to place a twelve foot by twenty foot
(12'x20') building and one hundred seventy (170') foot tower with
guyed supports to establish a communications facility, and

WHEREAS, a public hearing before the Mohave County Planning
and zoning Commission on October 14, 1992 and did generate a
recommendation of APPROVAL of the requested zoning Use permit
contingent upon the following conditions:
1. The applicant comply with all applicable provisions of
Sections 25, 26, 27, and 31 of the Mohave County zoning
Regulations. Compliance with Section 27.P (Site plan
Requirements) and Ordinance 87-1 (Dark Sky Ordinance)
is also required.
2. That appropriate zoning/building/environmental permits
be obtained.
3. If construction or use has not commenced within one (1)
year of Board approval of the Zoning Use Permit or if
the use has been discontinued for six (6) months, then
approval shall terminate at that date.
4. This zoning Use Permit is subject to revocation upon
sixty (60) days notification by the Board of
Supervisors, if in the opinion of the Commission and
Board the continued use of the property would be
contrary to the public health, safety, and welfare.

5. Require Citizens Utilities Company erect barrier(s) to
prevent access to the tower site at appropriate
location(s) on the access road.
6. If these conditions are not met within one (1) year
this approval shall be void. If at the expiration of
this period the property has not been improved for the
use for which it was conditionally approved, the Board
after notification by registered mail to the owner and
applicant who requested the ZUP shall schedule a public
hearing to grant an extension, determine compliance
with the schedule for development or cause the property
to revert to its former zoning classification in
accordance with Arizona Revised Statutes Annotated,
Title 11, Chapter 6, 11-832.
WHEREAS, the notice of hearing was published in the Kingman
Standard, a newspaper of general circulation in Kingman, Mohave
County, Arizona, on October 17, 1992, and posted October 15, 1992
as required by the Arizona Revised Statutes and the Mohave County
zoning Regulations.
NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors,
at their regular meeting on Monday, November 2, 1992 approved
this zoning Use Permit as recommended by the Mohave County
Planning and zoning Commission, subject to the conditions
outlined herein.
