PAGE 1 OF ~ HOHAVE COUNTY BOARD OF SUPERVISORS RECORDING FEE 0.00 He , -~ RESOLUTION NO. 92-327 A RESOLUTION SETTING FORTH THE REZONING OF PARCEL IlO, SECTION 19, TOWNSHIP 23 NORTH, RANGE l6 WEST, FROM: A-R/10A (AGRICULTURAL RESIDENTIAL/TEN ACRE MINIMUM LOT SIZE) ZONE, PROPOSED TO BE: A- R/4A (AGRICULTURAL RESIDENTIAL/FOUR ACRE MINIMUM LOT SIZE) ZONE, LOCATED IN THE MORAVE COUNTY GENERAL AREA, MORAVE COUNTY, ARIZONA WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on October 5, 1992, a public hearing was conducted to determine whether approval should be granted to Brian J. Mack of Kingman, Arizona, for a zone change from the existing A-R/10A (Agricultural Residential/Ten Acre Minimum Lot Size) zone to A-R/4A (Agricultural Residential/Four Acre Minimum Lot Size) zone, occupying the northeast corner of Calle Charcas and Avenida Mendez, north of Kingman in the Mohave County General ~ - area, and WHEREAS, Section 19 is approximately six (6) miles north of the Butler area and approximately two (2) miles east of Stockton Hill Road. The subject property is located on the section line road Calle Charcas approximately one-half (.5) mile west of Hualapai Road, and WHEREAS, rev iew 0 f the floodplain map #040058-2155B indicates this parcel to be clear of a designated floodplain. .,. .. -~ . . p. The applicant desires to split this eleven plus (11+) acre parcel into three 4+ acre parcels, and WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on September 9, 1992, the Commission recommended a conditional APPROVAL of the requested rezoning with the applicant understanding and accepting the following conditions: 1. The three parcels be zoned A-R/4A (Agricultural- Residential/Four Acre Minimum Lot Size). 2. Submittal and recordation of a Parcel Plat prepared in accordance with Article 3.l6 of the Mohave County Subdivision Regulations. 3. The establishment of a minimum lot size based on the size of parcels per the recorded Parcel Plat. 4. Each parcel shall have legal access. ~ - 5. The three parcels shall meet or exceed four (4) acres exclusive of road easements or rights-of-way. 6. The Parcel Plat shall show any surface drainage or FEMA flood zones. 7. No building/zoning permits shall be issued until after Parcel Plat recordation. 8. That appropriate zoning/building/environmental permits be obtained. 9. The Board of Supervisors accept the dedication of a twenty (20') foot radius curve at the southwest corner of the subject parcel and the granting of an eight (8') foot public utility easement along the southern boundary of the subject property. This shall be approved through the recording of the resolution authorizing this zone change, and that the dedication/granting statement and dedication/granting be shown on the Parcel Plat. ". . . The owner of the above referenced property pursue the abandonment of the necessary width of road right-of-way known as Calle Charcas as it is contiguous to the southern boundary of this parcel. 11. The abandonment be accepted by the Board of Supervisors prior to the recording of the parcel plat. 12. The parcel plat must indicate the abandonment accruement of the resultant acreage to the referenced property. and above 13. The rezone shall not become effective for at least thirty (30) days after final approval of the change in classification by the Board of Supervisors. Being November 4, 1992, as per ARS 11-829E. 14. I f these conditions are not met wi thin one (1) year this approval shall be void. If at the expiration of this period the property has not been improved for the use for which it was conditionally approved, the Board after notification by registered mail to the owner and applicant who requested the rezoning shall schedule a public hearing to grant an extension, determine compliance with the schedule for development or cause the property to revert to its former zoning classification in accordance with Arizona Revised Statutes Annotated, Title 11, Chapter 6, 11-832. ~ - At the request of Roqer Esquerra, cartoqrapher, the Planninq Commission recommends Parcel Plat Boundaries be a triple wide line as the l/8" blue line border obscures dimensions. WHEREAS, the notice of hearing was published in the Kingman Standard, a newspaper of general circulation in Kingman, Mohave County, Arizona, on September 19, 1992, and posted September 15, 1992, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. '. ~. ~ . . ~~GE 211~ ~~ S~ (fEE~92-55145) Resolution No. 92-327 Page 4 - ; NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, October 5, 1992 approved this change in zoning as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
