PAGE 1 uF 3 NOHAVE COUNTY BOARD OF SUPERVISORS RECORDING FEE 0.00 He WCROALMED ,- -.,1 '-~ RESOLUTION NO. 92-326 FOR A-R THE ESTABLISHMENT OF A WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held October 5, 1992 a public hearing was conducted to determine whether approval should be granted to Citizens Utilities Company of Kingman, Arizona, for a Zoning Use Permit (ZUP) for the establishment of a communications facility in an A-R (Agricultural Residential) zone in a portion of Section 17, Township 20 North, Range l5 West, located on Getz Peak in the Hualapai Mountains, and .... - WHEREAS, Section 17 is located approximately ten (10) miles southeast of the Andy Devine, Stockton Hill Road and Hualapai Mountain Road intersection and lies east of Hualapai Mountain Road. The subject property is accessed from Hualapai Mountain Road north via an unnamed road in the vicinity of the Ranger Station at the entrance to the Hualapai Mountain Park, and WHEREAS, this site is currently occupied by an existing facility in the form of a microwave tower approved by the Board '... . The applicant proposes to significantly upgrade and add to the existing facility. Surrounding land uses consist of Bureau of Land Management (BLM) lands. This site is being leased by Citizens Utilities Company from BLM, and WHEREAS, a public hearing before the Mohave County Planning and Zoning Commission on September 9, 1992 and did generate a recommendation of APPROVAL of the requested Zoning Use Permit contingent upon the following conditions: 1. The applicant comply with all applicable provisions of Sections 25, 26, 27, and 31 of the Mohave County Zoning Regulations. Compliance with Section 27. P (Site Plan Requirements) and Ordinance 87-1 (Dark Sky Ordinance) is also required. FS:l i.c:;J 2. That appropriate zoning/building/environmental permits be obtained. 3. Citizens Utilities Company camouflage the towers on this site for aesthetic purposes. ~ - 4. If construction or use has not commenced within one (1) year of Board approval of the Zoning Use Permit or if the use has been discontinued for six (6) months, then approval shall terminate at that date. 5. This Zoning Use Permit is subject to revocation upon sixty (60) days notification by the Board of Supervisors, if in the opinion of the Commission and Board the continued use of the property would be contrary to the public health, safety, and welfare. 6. If these conditions are not met within one (1) year this approval shall be void. If at the expiration of this period the property has not been improved for the use for which it was conditionally approved, the Board after notification by registered mail to the owner and applicant who requested the ZUP shall schedule a public hearing to grant an extension, determine compliance with the schedule for development or cause the property to revert to its former zoning classification in accordance with Arizona Revised Statutes Annotated, Title l1, Chapter 6, ll-832. e",~, I : ~:',.,,~ i ' f.>.'.' Page 3 P~GE "3 OF 4~ C.f~E..q'.l-S51.44) ~~ '21.1.'5 F<1 WHEREAS, the notice of hearing was published in the Kingman Standard, a newspaper of general circulation in Kingman, Mohave County, Arizona, on September 19, 1992, and posted September 18, 1992 as required by the Arizona Revised Statutes and the Mohave County zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, October 5, 1992 approved this Zoning Use Permit as recommended by the Mohave County Planning and Zoning Commission, subject to the conditions outlined herein.
