PAGE 1 OF 3 MOHAVE COUNTY BOARD OF SUPERVISORS RECORDInG FEE 0.00 He RESOLUTION NO. 92-324 A RESOLUTION SETTING FORTH AN EXTENSION OF TIME FOR THE APPROVED PRELIMINARY PLAN OF WALNUT CREEK COMMERCIAL, TRACT 3022, BEING A RESUBDIVISION OF LOTS 1 & 2, BLOCK 2, WALNUT CREEK ESTATES UNIT 1, TRACT 3007, BEING A PORTION OF SECTION 7, TOWNSHIP 20 NORTH, RANGE 17 WEST, LOCATED IN THE Me CONNICO AREA, MORAVE COUNTY, ARIZONA WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on October 5, 1992, a public hearing was conducted to determine whether approval should be granted to Walnut Creek Development Company, Kingman, Arizona and , represented by Dennis Sim, for an extension of time for the approved preliminary plan of WALNUT CREEK COMMERCIAL, Tract 3022, located in the McConnico area, and ~ - WHEREAS, the owner/developer of this tract is Dennis Sim, Walnut Creek Development Co., Kingman, Arizona. The engineer of record for this subdivision is William E. Miller, P.E., Holland West, Inc., Englewood, Colorado, and WHEREAS, the plan as submitted and reviewed is a resubdivision of Lots 1 & 2, Block 2, Walnut Creek Estates, Tract '''l 3007, known as Tract 3022, proposed to be resubdivided into six (6) lots with a average lot size of one plus (1+) acres, and . . Resolution No. 92-324 PAGE 2 OF 3 BY. 2118 PG ~2 (FEEt92-55142) Page 2 WHEREAS, the Preliminary Plan for this tract was approved by the Mohave County Board of Supervisors on September 5, 1989, via Resolution P&ZC: 89-179. Article 3.10-1 states, "Upon application to the co~nission and prior to the expiration, of the time limit, extensions in increments of one (1) year may be granted by the Board if the subdivider is actively processing the Final Plat. If such action is not taken than all proceedings relating to the plat shall be terminated", and WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on September 9, 1992, the COlmnission reco~nended conditional APPROVAL of the requested extension of time with the applicant understanding and accepting the following conditions: 1. In the letter dated August 26, 1992, Mr. Frank B. Holland, of Holland West, Inc., states, "please accept this letter as a request for extension of time to record the above referenced Tract 3022 until January, 1993. Since requesting an extension for revision to the preliminary plan we have studied, with our client, the project and feasibility thereof and have decided not to revise the preliminary plan. We therefore request that an extension of time be granted by the Planning and Zoning Commission allowing time to collect and review documentation in order to record the plan as previously submitted. Thank you for consideration of this request." ~ - 2. The original request for extension of time was submitted on June 22, 1992. Due to the delay getting this extension on the agenda legal counsel has indicated an extension to January 1993 would be equitable. Therefore, this extension of time will be in effect until January 1, 1993. . . Resolution No. 92-324 Page 3 PAGE 3 OF 3 BK 2118 PG 43 (FEE~92-55142) 3. As provided in Article 3.10-1 ".. " extensions in increments of one (1) year may be granted by the Board if the subdivider is actively processinq the Final Plat. If such action is not taken than all proceedinqs relatinq to the plat shall be terminated. At the request of Roqer Esquerra~artoqrapher , the Planninq Commission recommends Final Plat Boundaries be a triple wide line as the 1/8" blue line border obscures dimensions. WHEREAS, the notice of hearing was published in the Kingman Standard, a newspaper of general circulation in Kingman, Mohave County, Arizona, on September 19, 1992, and posted September 18, 1992, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, October 5, 1992 approved this extension of time for the preliminary plan of WALNUT CREEK ~ - COMMERCIAL, Tract 3022, as recommended by the Mohave County Planning and Zoning Commission and outlined herein. "Pat" Chastain REVOCATION OF RESOLUTION At the Board of Supervisors meeting held October 19, 1992, the Mohave County of Supervisors rescinded the Board of Supervisors action taken at the Regular meeting held on October 5, 1992, at which time Resolution No. 92-323, was adopted. The Resolution (92-323) amended the Mohave County General Plan by correcting the McConnico area plan to add omitted baseline data, Mohave County, Arizona, and was recorded at fee No. 92-55141 Book 2118 pages 37, 38,39 and 40. As Clerk of the Mohave County Board of Supervisors I hereby request that this affidavit of revocation of recording be duly recorded this 30th day of October, 1992.
