PAGE 1 OF 6 MOHAVE COUNTY BOARD OF SUPERVISORS RECORDING FEE 0.00 He RESOLUTION NO. 92-318 A RESOLUTION SETTING FORTH AN EXTENSION OF TIME PERMIT TO ALLOW FOR THE STORAGE OF BULK FUELS WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on October 5, 1992, a public hearing was conducted to determine whether approval should be granted to Fred Grigg of Triple G Partnership, Kingman, Arizona, for an extension of time for a Zoning Use Permit (ZUP) to allow for the storage of ';.J:,' bulk fuels in a M-X (Heavy Manufacturing) zone, in Lot 1, Block G, Lake Havasu Estates, Tract 1168, Section 13, Township l7 North, Range 18 West, located twelve hundred (1200') feet east of ~ - the 1-40 West Yucca Interchange in the Yucca area, and WHEREAS, the subject property is located just south of the Yucca 'l'ownsite and is east of I-40's eastern border. It is accessed off of 1-40 at the West Yucca Interchange, and WHEREAS, review of floodplain map #040058-2675B indicates this property is clear of any designated floodplain. However, a site inspection of the area reveals a minor wash running east to west across the property. The property is currently occupied by a well and a building used for storage. Surrounding zoning consists of conunercial, agricultural and manufacturing to the north; manufacturing to the east; residential, conunerc ial and mul tifamily to the south and I-40 to the west. Ford Motor Company occupies the manufacturing zone on the north and east. Surrounding land uses consist of mostly vacant land with some homes to the south, a mix of homes and businesses to the northwest and Ford Proving Grounds to the north and west, and WHEREAS, the applicant's proposal was to store liquid fuels in a bulk storage facility within Lot 1 of Block G. At the reconunendation of the Conunission, a meeting was held with the ,~~,)."; applicant, Yucca Fire officials and a representative of the State Fire Marshal's office on July 19, 1991. During the course of the meeting various concerns were addressed. Primary concerns were ~ - the local fire district's ability to handle an incident at the fuel storage site. The representative from the State Fire Marshal's office indicated that conununication between the local and state fire agencies would ensure steps were taken to mitigate local concerns. The applicant indicated that he would take steps to protect the well from possible contamination. The County Building Department indicated that they would also work closely with the local and state fire agencies. The applicant indicated he would, upon approval of a Zoning Use Permit (ZUP) for this site, forward engineered plans to the State Fire Marshal for review and obtain the necessary County permits, and . . PAGE 3 OF BK 2118 PG I o 23 (FEE~92-55137) Resolution No. 92-318 Page 3 WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on August 14, 1991 and did generate a recommendation of APPROVAL of the requested Zoning Use Permit contingent upon the following conditions: 1. The applicant comply with all applicable provisions of Sections 25, 26, 27, and 31 of the Mohave County Zoning Regulations. In addition to compliance with Mohave County Ordinance 87-1 (Dark Sky Ordinance). 2. That appropriate zoning/building permits be obtained and Mohave County Building Department approves the design of the storage facility and related improvements that fall within its purview. 3. The State Fire Marshal's office, in coordination with the Yucca Fire Department, approves the design of the storage facility and related lmprovements. '~1 4. Arizona Department of Environmental Quality approves the quantity and quality of the water supply. --,:~) 5. Arizona Department of Environmental Quality approves measures taken to protect the existing and subsequent well(s) and groundwater from potential contamination by activities at this site. ~ - 6. Arizona Department of Environmental Quality approves the use and design of the sewage treatment facility for this development. 7 . Adequate parking shall be implemented in accordance with the Mohave County Zoning Ordinance. 8. Any remainder of the lot not used for development shall be maintained free of debris and the vegetation controlled to m~n~mize potential fire hazards. Grasses /weeds shall be cut regularly to assure less than eight (8") inches of growth. I f crushed rock is used then the soil shall be maintained in a weed free condition. 9. Any open lot storage must be related to or be an accessory to the primary business. . . Resolution No. 92-3l8 PAGE 4 OF 6 BK 2118 PG 24 (FEE~92-55137) Page 4 10. The applicant shall pave the driveway access and parking in accordance with Mohave County Standard Specification #l71, or better. The storage area shall be covered with a dust-proof surface. If crushed rock is used for the dust-proof surface then the soil shall be maintained in a weed free condition. 11. If construction or use has not commenced within one (1) year of Board approval of the Zoning Use Permit or if the use has been discontinued for six (6) months, then approval shall terminate at that date. 12. This Zoning Use Permit is subject to revocation upon sixty (60) days notification by the Board of Supervisors, if in the opinion of the Commission and Board the continued use of the property would be contrary to the public health, safety, and welfare. f'.'::,,\ 13. If these conditions are not met within one (1) year this approval shall be void. If at the expiration of this period the property has not been improved for the use for which it was conditionally approved, the Board after notification by registered mail to the owner and applicant who requested the ZUP shall schedule a public hearing to grant an extension, determine compliance with the schedule for development or cause the property to revert to its former zoning classification in accordance with Arizona Revised Statutes Annotated, Title 11, Chapter 6, 11-832. ~ - WHEREAS, the applicant has submitted documentation indicating he has been working to meet the conditions of approval as specified in Resolution Number 91-240. The Planning Commission Staff has received copies of documentation from the State Fire Marshal's office given conditional approval for portions of the operation. 'l'he applicant' s representative has also indicated they are awaiting comments and approvals from the Arizona Department of Environmental Quality (ADEQ), and . . Resolution No. 92-318 PAGE 5 OF 6 BK 2118 PG 25 (FEE~92-S5137) Page 5 WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on September 9, 1992, the Commission recommended conditional APPROVAL of the requested extension of time with the applicant understanding and accepting the following conditions: 1. Continued compliance with conditions of Resolution No. 91-240. 2. Required building permits be accompanied by a site plan in accordance with Section 27.P. 3. Required permits be obtained for on site grading. 4. The applicant contact local utilities to obtain clearance for infringement into the existing sixteen (16') foot PUE and DE. If clearance is not obtained then the tank farm should be moved out of the existing sixteen (16') foot PUE and DE. . \ (;\ 1- ; 'Co'.) 5 . It is unclear as to the circulation pattern of vehicles within the lot. This needs to be better illustrated on the site plan. The circulation pattern would influence staff comments as to the adequacy of provisions for road access and whether additional road improvement is needed within the site. In addition to the considerations as to whether the roadways within the site need to be paved or if a gravel standard is adequate for the projected impacts. ~ - 6. A handicapped parking space and bumper stops be provided in accordance with Section 26. 7. A view obscuring fence be provided in accordance with Section 24.C.1. This fence needs only be provided on the south and west sides of this property. 8. This extension of time be granted for this use until September 3, 1993. .~~... -:,' . . ~ ," ... . . PAGE 6 OF 6 BK 2118 PG 26 (FEE~92-55i37) Resolution No. 92-318 Page 6 WHEREAS, the notice of hearing was published in the Kingman Standard, a newspaper of general circulation in Kingman, Mohave County, Arizona, on September 19, 1992, and posted September 18, 1992 as required by Arizona Revised Statutes, and the Mohave County zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, October 5, 1992 approved the granting of this extension of time for a conditional zoning Use Permit as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
