PAGE 1 Of 4- MOHAVE COUHTY 80ARDOf.SUPERVlSORS RECORDING FEE 0.00 Ne RESOLUTION NO. 92-365 A RESOLUTION SETTING FORTH THE REZONING OF LOT 1228, SACRAMENTO CITY, SECTION 5, TOWNSHIP 19 NORTH, RANGE 18 WEST, FROM: A-R/IA (AGRICULTURAL RESIDENTIAL/ONE ACRE MINIMUM LOT SIZE) ZONE, PROPOSED TO BE: C-2H/lA (HIGHWAY COMMERCIAL/ONE ACRE MINIMUM LOT SIZE) ZONE, LOCATED IN THE GOLDEN VALLEY AREA, MORAVE COUNTY, ARIZONA WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on November 2, 1992, a public hearing was conducted to determine whether approval should be granted to John Gist of Kingman, Arizona, for a zone change from the existing A- R/1A (Agricultural Residential/One Acre Minimum Lot Size) zone to C-2H/1A (Highway Commercial/One Acre Minimum Lot Size) zone, located on the south side of Highway 66, four hundred fifty (450') feet east of Diamond Street in the Golden Valley area, and WHEREASt Section 5 is located in the lower Sacramento Valley area. The section is bisected by Highway 66 and is located approximately seven (7) miles southwest of the Interstate 40 (1- 40) McConnico interchange. The section is bounded by Dawson Drive, Ramada Road, Na~ajo Drive and Tombstone Trail. Section 5 is occupied by two subdivisions; Sacramento Ranchos, Unit 3 and Sacramento City. The majority of Highway 66 frontage in Section 5 is in Sacramento City. The subject property has frontage on Highway 66, and , . . ... Resolution No. 92-365 Page 2 PAGE 2 Of 4- BK 2131 PG 009 (FEEt92-610'S7) WHEREAS, review of floodplain map #040058-2500B indicates three major washes traversing the section. Two washes are located in the east half of the section while the third is located on the western edge. Two gas line easements traverse the section in the Sacramento Ranchos unit. This section was included in the 1980 Sacramento Valley Area Plan. The area plan for this section was recently modified to allow for commercial uses, and WHEREAS, the site was occupied by a open market which was not in compliance with the ordinance. The applicant has pursued L' . an area plan amendment and is currently pursuing this request to bring this lot into compliance. The applicant has also been working on the property to clear the site. The applicant desires to establish a commercial use in the form of a small market with some open lot sales. Surrounding land uses consist of some scattered residences and mostly vacant land, and WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on October 14, 1992, the Commission recommended a conditional APPROVAL of the requested rezoning with the applicant understanding and accepting the following conditions: ~,:,~C'i 1. The applicant comply with all applicable provisions of Sections 25, 26, 27, and 31 of the Mohave County Zoning Regulations. Compliance wi th Section 27 . The property owner and/or occupant of the property shall assure that a buffer that is view obscuring shall be erected/constructed/planted within thirty (30) days of occupancy of residential property adjacent/ contiguous to this approved commercial zoning. 3. Any remainder of the lot not used for development shall be maintained free of debris and the vegetation controlled to minimize potential fire hazards. Grasses /weeds shall be cut regularly to assure less than eight (8") inches of growth. If crushed rock is used then the soil shall be maintained in a weed free condition. 4. Any open lot storage must be related to or be an accessory to the primary business. r.. 5. Such storage area shall be completely enclosed by a view-obscuring fence which extends two (2') feet above the highest item to be stored, with a minimum of six (6') feet and a maximum of eight (8') feet in height. Such a fence shall display no advertising. 6. The applicant shall pave the driveway access and parking in accordance with Mohave County Standard Specification #171, or better. The storage area shall be covered with a dust-proof surface. If crushed rock is used for the dust-proof surface then the soil shall be maintained in a weed free condition. 7. Proof of hookup to an approved sewage and water system shall be submitted to staff. 8. The rezone shall not become effective for at least thirty (30) days after final approval of the change in classification by the Board of Supervisors. Being December 2, 1992, as per ARS 11-829E. 9 . I f these conditions are not met wi thin one (1) year this approval shall be void. If at the expiration of this period the property has not been improved for the use for whicD it was conditionally approved, the Board after notification by registered mail to the owner and applicant who requested the rezoning shall schedule a public hearing to grant an extension, determine compliance with the schedule for development or cause the property to revert to its former zoning classification in accordance with Arizona Revised Statutes Annotated, Title 11, Chapter 6, 11-832. .' . . Resolution No. 92-365 Page 4 WHEREAS, the notice of hearing was published in the Kingman Standard, a newspaper of general circulation in Kingman, Mohave County, Arizona, on October 17, 1992, and posted October 15, 1992, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, a t their regular meeting on Monday, November 2, 1992 approved this change in zoning as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
