PAGE. 1 OF '" HOHAVE COUNTY BOARD OF SUPERVISORS RECORDING FEE 0.00 He ..1.' !~fj!GniJfiLJ1Ell ~..:; RESOLUTION NO. 92-363 A RESOLUTION SETTING FORTH AN EXTENSION OF TIME FOR A ZONING USE PERMIT TO PROVIDE FOR OFF-PREMISE PARKING IN AN A-R (AGRICULTURAL RESIDENTIAL) ZONE ON A PORTION OF THE W~ E~ NE~ SECTION 10, TOWNSHIP 21 NORTH, RANGE 19 WEST, LOCATED IN THE GOLDEN VALLEY AREA, MORAVE COUNTY, ARIZONA WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on November 2, 1992, a public hearing was conducted to determine whether approval should be granted to Max Bevins of SUN CAPITAL, INCORPORATED, Kingman, Arizona, for an extension of time for a Zoning Use Permit (ZUP) to provide for off-premise parking in an A-R (Agricultural Residential) zone on a portion of the W~ E~ NE~ Section 10, Township 21 North, Range 19 West, located on the east side of Emery Park Road, three hundred (300') feet south of Highway 68 in the Golden Valley area, and WHEREAS, Section 10 is approximately eight and one-half (8.5) miles west of the Highway 68 and 93 junction and is bisected by Highway 68. The subject property is accessed from Highway 68 via Emery Park Road south approximately three hundred (300') feet on the east side of the street, and WHEREAS, Section 26 of the zoning ordinance allows for off premise parking where provisions are made to reserve the property ... . . The applicant is applying for this ZUP to reserve off premise parking for the proposed Ocotillo Shopping center immediately to the north of the requested parking area. The parking will be primarily for theater parking but also provide overflow from the proposed stores. Surrounding uses consist of mostly vacant land, and WHEREAS, the Golden Valley Area plan indicates the entirety of this parcel and parcels to the east and west to be designated for either commercial or multifamily uses, and WHEREAS, a public hearing before the Mohave County Planning ....-:;1 and Zoning Commission on August 14, 1991 and did generate a recommendation of APPROVAL of the requested zoning Use Permit contingent upon the following conditions: 1. The applicant comply with all applicable provisions of Sections 25, 26, 27, and 31 of the Mohave County Zoning Regulations. In addition to compliance with Mohave County Ordinance 87-1 (Dark Sky Ordinance). 2. That appropriate zoning/building permits be obtained. 3. A one (1') foot vehicle non-access easement shall be established along the east, west and south boundaries of this development except approved entrance points. A three (3') foot block wall shall be required along the west vehicle non-access easement. In addition, a three (3') foot chain link fence shall be required along the east and south boundary of this development. (This approval based on the fact there is no development adjacent to this project.) This lot shall for all intents and purposes be considered one lot with the adjoining site for the proposed Ocotillo Shopping Center and the sale of any individual lot, or break out thereof, shall immediately negate this approval. 4. . . Resolution No. 92-363 Page 3 ~~GE 2131 ~~ 60; (FEEt92-61~) 5. The applicant shall pave the driveway access and parking in accordance with Mohave County Standard Specification #171, or better. 6. Any remainder of the lot not used for development shall be maintained free of debris and the vegetation controlled to minimize potential fire hazards. Grasses /weeds shall be cut regularly to assure less than eight (8") inches of growth. I f crushed rock is used then the soil shall be maintained in a weed free condition. 7. The owner/developer shall acquire right-of-way for and pave Emery Park Road as it is contiguous to this property and north to Highway 68. The paving of the aforementioned road shall be in accordance with Mohave County Standard Specification #101.10A, or better and shall be placed on the center line of roadway right-of- ways in a width and design as approved by the County Engineer. 8. This ZUP is directly tied to the proposed Ocotillo Shopping Center. I f the center is not developed this permit shall be void. - .-;.~ . . 9. If construction or use has not commenced within one (1) year of Board approval of the Zoning Use Permit or if the use has been discontinued for six (6) months, then approval shall terminate at that date. 10. This Zoning Use Permit is subject to revocation upon sixty (60) days notification by the Board of Supervisors, if in the opinion of the Commission and Board the continued use of the property would be contrary to the public health, safety, and welfare. 11. If these conditions are not met within one (1) year this approval shall be void. If at the expiration of this period the property has not been improved for the use for which it was conditionally approved, the Board after notification by registered mail to the owner and applicant wh~ requested the ZUP shall schedule a public hearing to grant an extension, determine compliance with the schedule for development or cause the property to revert to its former zoning classification in accordance with Arizona Revised Statutes Annotated, Title 11, Chapter 6, 11-832. The applicant has indicated he needs an extension due to time factors in complyinq with requirements from ADOT to obtain access to Hiqhway ~ and feels he can meet the above conditions throuqh the construction process. ~ . . Page 4 WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on October 14, 1992, the Commission recommended conditional APPROVAL of the requested extension of time with the applicant understanding and accepting PAGE ~ Of 4 DK 2131 PG 604 (FEE.92-61~) the following conditions: 1. Continued compliance with conditions of Resolution No. 91-246. 2. Required building permits be accompanied by a site plan in accordance with Section 27.P. 3. The applicant acquire proper permits for existing signage advertising the proposed project. 4. This extension of time be granted for this use until September 3, 1993. WHEREAS, the notice of hearing was published in the Kingman Standard, a newspaper of general circulation in Kingman, Mohave County, Arizona, on October 17, 1992, and posted October 15, 1992, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, November 2, 1992 approved this extension of time for the Zoning Use Permit, as recommended by the Mohave County Planning and zoning Commission and outlined herein.
