RESOLUTION NO. 92-356
A RESOLUTION SETTING FORTH THE REZONING OF PARCEL 19B-A, SECTION
25, TOWNSHIP 23 NORTH, RANGE 17 WEST, FROM: A-R/10A (AGRICULTURAL
RESIDENTIAL/TEN ACRE MINIMUM LOT SIZE) ZONE, PROPOSED TO BE: A-
R/5A & 4A (AGRICULTURAL RESIDENTIAL/FIVE AND FOUR ACRE MINIMUM
LOT SIZE) ZONES, LOCATED IN THE NORTH KINGMAN PORTION OF THE
MOHAVE COUNTY GENERAL AREA, MOHAVE COUNTY, ARIZONA
WHEREAS, at the regular meeting of the Mohave County Board
of Supervisors held on November 2, 1992, a public hearing was
conducted to determine whether approval should be granted to
Edward A. & Karen M. Early of Rockville, Maryland, for a zone
change from the existing A-R/10A (Agricultural Residential/Ten
Acre Minimum Lot Size) zone to A-R/5A & 4A (Agricultural
Residential/Five and Four Acre Minimum Lot Size) zones, located
north of Calle Charcas between Parker and Longee Streets, in the
North Kingman portion of the Mohave County General area, and
WHEREAS, Section 25 is approximately five (5) miles north of
the Butler area.
The subject property is accessed via Calle
Charcas east approximately 3,800 feet to the northwest corner of
the subject property, and

indicates this parcel to be clear of a designated floodplain.

The property is currently vacant.

Surrounding land uses consist
primarily of vacant land.
The applicant desires to split this
fifteen plus (15+) acre parcel into three (3) five (5) acre
parcels, and
WHEREAS, at the public hearing before the Mohave County
Planning and Zoning Commission on October 14,
1992,
the
Commission recommended a conditional APPROVAL of the requested
rezoning with the applicant understanding and accepting the
following conditions:
1. The three parcels be zoned A-R/5A (Agricultural-
Residential/Five Acre Minimum Lot Size).
2. Submittal and recordation of a Parcel Plat prepared in
accordance with Article 3.16 of the Mohave County
Subdivision Regulations.
3. The establishment of a minimum lot size based on the
size of parcels per the recorded Parcel Plat.
4. Each parcel shall have legal access.
5. The three parcels shall meet or exceed five (5) acres
exclusive of road easements or rights-of-way.
6. The Parcel Plat shall show any surface drainage and
FEMA flood zones.
7. No building/zoning permits shall be issued until after
Parcel Plat recordation.
8. That appropriate zoning/building/environmental permits
be obtained. -

9. The Board of Supervisors accept the abandonment of the
existing fifty foot (50') roadway easements as they are
within and contiguous to the eastern, northern, the
western boundaries of the subject property to be
replaced by the dedication of a thirty-five foot (35')
road right-of-way along the northern and western
boundaries and a thirty foot (30') road right-of-way
along the eastern boundary, and a twenty ( 20') foot
radius will be needed at the northeast and northwest
corners of the proposed parcels where they are
contiguous to Longee Street and Parker Street. This
shall be approved through the recording of the
resolution authorizing this zone change, and that the
granting statement and dedication be shown on the
Parcel Plat.
10. The abandonment will only pertain to the roadway
easements, any existing utility easements underlying
the fifty foot (50') roadway easements will remain and
be indicated and referenced to record on the Parcel
Plat.

11. The rezone shall not become effective for at least
thirty (30) days after final approval of the change in
classification by the Board of Supervisors. Being
December 2, 1992, as per ARS 11-829E.
12 . I f these conditions are not met wi thin one (1) year
this approval shall be void. If at the expiration of
this period the property has not been improved for the
use for which it was conditionally approved, the Board
after notification by registered mail to the owner and
applicant who requested the rezoning shall schedule a
public hearing to grant an extension, determine
compliance with the schedule for development or cause
the property to revert to its former zoning
classification in accordance with Arizona Revised
Statutes Annotated, Title 11, Chapter 6, 11-832.
At the request of Roqer Esquerra, cartoqrapher, the Planninq
Commission recommends Final Plat and Parcel Plat Boundaries be a
triple wide line as the 1/8" blue line border obscures
dimensions.
WHEREAS, the notice of hearing was published in the Kingman
Standard, a newspaper of general circulation in Kingman, Mohave

County, Arizona, on October 17, 1992, and posted October 15,
1992, as required by Arizona Revised Statutes and the Mohave
County Zoning Regulations.

NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors,
at their regular meeting on Monday, November 2, 1992 approved
this change in zoning as recommended by the Mohave County
Planning and Zoning Commission and outlined herein.
