PAGE 1 OF + MOHAVE COUNTY BOARD OF SUPERVISORS RECORDING FEE 0.00 Nt - RESOLUTION NO. 92-354 A RESOLUTION SETTING FORTH THE REZONING OF SECTIONS 2, 11 AND A PORTION OF 14, TOWNSHIP 22 NORTH, RANGE 16 WEST, FROM: A-R (AGRICULTURAL RESIDENTIAL) ZONE, PROPOSED TO BE: M (GENERAL MANUFACTURING) ZONE, LOCATED IN THE NORTH KINGMAN PORTION OF THE MORAVE COUNTY GENERAL AREA, MORAVE COUNTY, ARIZONA WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on November 2, 1992, a public hearing was conducted to determine whether approval should be granted to the City of Kingman, for a zone change from the existing A-R (Agricultural Residential) zone to M (General Manufacturing) zone, being the location of the Hilltop (Kingman City) wastewater treatment plant, located in the North Kingman portion of the Mohave County General area, and WHEREAS, Sections 2, 11 and 14 are located approximately two and one half (2.5) miles north of Thompson Avenue. The site is accessed from Highway 66 via an unnamed road being approximately three and two tenths (3.2) miles north of Thompson Avenue on the west side of the highway, thence west one (1) mile to the existing facility, and WHEREAS, review of floodplain maps #040058-2160B & 2170B indicate portions of these sections are within a designated "'. i . . Resolution No. 92-354 Page 2 PAGE 2 OF 4 BK 2131 PG 571 (FEEt92-6104&) floodplain created by the Mohave Wash. The site is currently occupied by a wastewater treatment facility. The City of Kingman plans to expand the existing facility. The City has indicated the access road will be paved. The site is bordered by private land and State Lands. The Planning Commission staff received a comment letter from the State Lands department and has contacted the City and the City is preparing a letter to address those concerns expressed by the State. This rezone action will bring this site into compliance with the recently updated Section 23 of the Mohave County Zoning Regulations regarding general manufacturing uses, and WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on October 14, 1992, the Commission recommended a conditional APPROVAL of the requested rezoning with the applicant understanding and accepting the following conditions: 1. The applicant comply with all applicable provisions of Sections 23, 25, 26, 27, and 31 of the Mohave County Zoning Regulations. Compliance with Section 27.P (Site Plan Requirements) and Ordinance 87-1 (Dark Sky Ordinance) is also required. 2. That appropriate zoning/building/environmental permits be obtained. 3. Any significant change (as determined by the Planning Director, appealable to the Planning Commission) in the approved specific land use shall require a rehearing on the change before the Commission, with a final determination to be made by the Board in accordance with Section 23 of the Mohave County Zoning Regulations. If crushed rock is used for the dust-proof surface then the soil shall be maintained in a weed free condition. 5. Any open lot storage must be related to or be an accessory to the primary business. Such storage shall be completely enclosed by a view-obscuring fence which extends two (2') feet above the highest item to be stored, with a minimum of six (6') feet and a maximum of eight ( 8') feet in height. Such a fence shall display no advertising. The storage area shall be covered with a dust-proof surface. If at the expiration of this period the property has not been improved for the use for which it was conditionally approved, the Board after notification by registered mail to the owner and applicant who requested the rezoning shall schedule a public hearing to grant an extension, determine compliance with the schedule for development or cause the property to revert to its former zoning classification in accordance with Arizona Revised Statutes Annotated, Title 11, Chapter 6, 11-832. WHEREAS, the notice of hearing was published in the Kingman Standard, a newspaper of general circulation in Kingman, Mohave County, Arizona, on October 17, 1992, and posted October 15, 1992, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. --- ~ I t . . Resolution No. 92-354 Page 4 PAGE 4 OF 4 BK 2131 PG 579 (FEEt92-610-\(,) NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, November 2, 1992 approved this change in zoning as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
