MICI,ED ~c v' RESOLUTION NO. 92-407 A RESOLUTION SETTING FORTH REVOCATION OF A ZONING USE PERMIT ESTABLISHING A MOBILE HOME AS A RESIDENCE IN A C-2 (GENERAL COMMERCIAL) ZONE ON LOTS 19 & 20, BLOCK 147, NEW KINGMAN ADDITION #10, TRACT 1103, LOCATED IN THE KINGMAN AREA, MOHAVE COUNTY, ARIZONA WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on December 7, 1992, a public hearing was conducted to determine whether approval should be granted for the REVOCATION OF A ZONING USE PERMIT that established a mobile home as a residence in a C-2 (General Commercial) zone on Lots 19 & 20, Block 147, New Kingman Addition #10, Tract 1103, occupying the southwest corner of Neal Avenue and North Lomita Street in the Kingman area, and WHEREAS, New Kingman Addition #10, Tract 1103, is located approximately one ( 1 ) mile west of the Stockton Hill Road/Northern Avenue intersection north of Kingman. The property is located and accessed from Stockton Hill Road, west onto Northern Avenue approximately one (1) mile then north on North Lomita Street to the southwest corner of Neal Avenue and North Lomita Street, and WHEREAS, review of Floodplain map #0400s8-216sC indicates this area to be clear of potential flooding. The applicant wished to place a mobile home on these lots for a residential use in a C-2 (General Conwercial) zone, and WHEREAS, followinq are the oriqinal conditions of approval as specified in Resolution 90-209: 1. That Zoning/Building permit(s) be obtained. 2. If construction or use has not commenced within one (1) year of Board approval of the Zoning Use Permit or if the use has been discontinued for six (6) months, then approval shall terminate at that date. 3. This Zoning Use Permit is subject to revocation upon sixty (60) days notification by the Board of Supervisors, if in the opinion of the Commission and Board the continued use of the property would be contrary to the public health, safety, and welfare. That proof of ownership for the current owners of the property and submittal of the fee for the second ZUP be provided two weeks prior to the Board of Supervisors meeting of August 6, 1990. WHEREAS, the first extension was qranted via Resolution 91- 255 with the followinq lanquaqe noted: The Commis s ion recommended approval of the current ZUP for these lots in July of 1990 and the Board approved Resolution 90-209 in August of 1990. The applicant has requested an extension based on difficulties in selling his home in New York State. Resolution No. 92-407 Page 3 WHEREAS, the Planning and Zoning Commission, at their meeting on August 14, 1991, recommended APPROVAL of a one (1) year extension of time this zoning Use Permit (ZUP) for establishment of two (2) residences on Lots 19 & 20, Block 147, New Kingman Addition #10, Tract 1103 with the following conditions noted: 1. Compliance with conditions of Resolution 90-209. WHEREAS, Staff sent a reqistered letter informinq the applicant that the ZUP was about to expire and would be revoked unless some action was taken to apply for buildinq permits or another extension of time. No reply as of the writinq of this recommendation has been received, and WHEREAS, at the public hearing before the Mohave County Planning and zoning Commission on November 18, 1992, the Commission recommended APPROVAL of the REVOCATION of the zoning Use Permit based on the following: 1. No activity in the form of permit applications has occurred. 2. No response was received to the registered notification that the revocation was to be agendized. 3 . NOW 'rHEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, pecember 7, 1992 approv'ed the revocation of this Zoning Use Permit as reconunended by the Mohave County Planning and Zoning Conunission and outlined hE:!rein.
