RESOLUTION NO. 92-405
A RESOLUTION SETTING FORTH THE REZONING OF PARCEL 22, LAZY Y-U
RANCH PHASE 1, SECTION 11, TOWNSHIP 20 NORTH, RANGE 16 WEST,
FROM: A-R/36A (AGRICULTURAL RESIDENTIAL/THIRTY-SIX ACRE MINIMUM
LOT SIZE) ZONE, PROPOSED TO BE: A-R/9A & 19A (AGRICULTURAL
RESIDENTIAL/NINE AND NINETEEN ACRE MINIMUM LOT SIZE) ZONES,
LOCATED IN THE HUALAPAI MOUNTAIN AREA, MOHAVE COUNTY, ARIZONA
WHEREAS, at the regular meeting of the Mohave County Board
of Supervisors held on December 7, 1992, a public hearing was
conducted to determine whether approval should be granted to John
L. Neely of Parker, Arizona, for a zone change from the existing
A-R/36A (Agricultural Residential/Thirty-Six Acre Minimum Lot
Size) zone, to A-R/9A & 19A (Agricultural Residential/Nine and
Nineteen Acre Minimum Lot Size) zones, located in the Hualapai
Mountain area, and
WHEREAS, the subject property is located approximately four
(4) miles southeast of the Kingman City limits, on Hualapai
Mountain Road. The subject property is approximately one (1) mile
southeast of Hualapai Mountain Road and is accessed via Lazy Y-U
Drive, Pack Saddle Drive, Saddletree Drive and Horseshoe Drive,
and
WHEREAS, review of floodplain map #0400s8-23s0C indicates
this area to be within Flood Zone C. The terrain is rugged

mountain foothill country. Well constructed gravel base roads
serve these properties. The site is currently vacant and bordered
on all sides by vacant land. The owner is requesting a division
into three (3) parcels. The zone change is for A-R/9A, A-R/9A and
A-R/19A Parcel designations from this original forty (40) acre
parcel, and
WHEREAS, Lazy Y-U Ranch, phase I is the division of three
(3) Sections plus eighty (80) acres, into fifty (50) parcels of
forty (40) acres of more each. The developers plan to divide an
additional six (6) Sections of land in the future, and
WHEREAS, all roads are easements and as such do not create
parcel divisions, according to the state Real Estate office. The
road designation is designated as follows: "Easements shown...are
perpetual in nature and are created for ingress/egress, drainage
and public utility purposes for the benefit of each of the
parcels and their owners and the public." The project attorneys
recommended this wording to accommodate the public, and
WHEREAS, there is no specific Area Plan for this area, and
it is not within the Building Overlay area, and
WHEREAS, at the public hearing before the Mohave County
Planning and Zoning Commission on November 18,
1992,

Commission recommended a conditional APPROVAL of the requested
rezoning with the applicant understanding and accepting the
following conditions:
1. The two (2) southern parcels be zoned A-R/9A
(Agricultural-Residential/Nine Acre Minimum Lot Size),
and the north parcel be zoned A-R/19A (Agriculteral-
Residential/Nineteen Acre Minimum Lot Size).
2. Submittal and recordation of a Parcel Plat prepared in
accordance with Article 3.16 of the Mohave County
Subdivision Regulations.

The establishment of a ml.nl.ffiUm lot size based on the
size of parcels per the recorded Parcel Plat.
Each parcel shall have legal access.
The parcel plat shall show any surface drainage or FEMA
flood zones.
No building/zoning permits shall be issued until after
Parcel Plat recordation.
That appropriate zoning/building/environmental permits
be obtained.
The rezone shall not become effective for at least
thirty (30) days after final approval of the change in
classification by the Board of Supervisors. Being
January 6, 1993, as per ARS 11-829E.
9. I f these conditions are not met wi thin one (1) year
this approval shall be void. If at the expiration of
this period the property has not been improved for the
use for which it was conditionally approved, the Board
after notification by registered mail to the owner and
applicant who requested the rezoning shall schedule a
public hearing to grant an extension, determine
compliance with the schedule for development or cause
the property to revert to its former zoning
classification in accordance with Arizona Revised
Statutes Annotated, Title 11, Chapter 6, 11-832.
At the request of Roqer Esquerra, cartoqrapher, the Planninq
Commission recommends Final Plat and Parcel Plat Boundaries be a
triple wide line as the 1/8" blue line border obscures
dimensions.

WHEREAS, the notice of hearing was published in the Kingman
Standard, a newspaper of general circulation in Kingman, Mohave
County, Arizona, on November 20, 1992, and posted November 19,
1992, as required by Arizona Revised Statutes and the Mohave
County Zoning Regulations.
NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors,
at their regular meeting on Monday, December 7, 1992 approved
this change in zoning as recommended by the Mohave County
Planning and zoning Commission and outlined herein.
