RESOLUTION NO. 92-403 A RESOLUTION SETTING FORTH THE REZONING OF A PORTION (EAST 459 FEET) OF PARCEL 247, STOCKTON HILL RANCHES UNIT 8, SECTION 36, TOWNSHIP 23 NORTH, RANGE 17 WEST, FROM: A-R/10A (AGRICULTURAL RESIDENTIAL/TEN ACRE MINIMUM LOT SIZE) ZONE, PROPOSED TO BE: A- R/6A (AGRICULTURAL RESIDENTIAL/SIX ACRE MINIMUM LOT SIZE) ZONE, LOCATED IN THE NORTH KINGMAN AREA, MOHAVE COUNTY, ARIZONA WHEREAS, at the regular meeting of the Mohave County Board of supervisors held on December 7, 1992, a public hearing was conducted to determine whether approval should be granted to Patrick P. and Sibyl A. Petry of Kingman, Arizona, for a zone change from the existing A-R/ lOA (Agricultural Residential/Ten Acre Minimum Lot Size) zone, to A-R/6A (Agricultural Residential/Six Acre Minimum Lot Size) zone, located in the North Kingman portion of the Mohave County General area, and WHEREAS, Section 36 is approximately five (5) miles north of the Butler area and approximately one-quarter (.25) mile east of Stockton Hill Road. The property is accessed from Stockton Hill Road via Jane Avenue east approximately one-half (.5) mile, thence north approximately one half (.5) mile to Ruthe Avenue, thence east approximately eight hundred and sixty-two (862') feet to the northwest corner of the subject property, and ~..s. . . Page 2 Resolution No. 92-403 PAGE 2 OF 4 BK 2146 PG 861 (FEEt92-675S8) WHEREAS, review of floodplain map #0400s8-21s5C indicates this Parcel to be clear of a designated floodplain. The property is currently vacant. Surrounding land uses consist primarily of vacant land with a few scattered residences. The applicant desires to split this thirteen (13+) acre parcel into two six (6+) acre parcels, and WHEREAS, at the public hearing before the Mohave County 1992, the Planning and Zoning Commission on November 18, Commission recommended a conditional APPROVAL of the requested rezoning with the applicant understanding and accepting the following conditions: 1. (Agricultural- The two (2) parcels be zoned A-R/6A Residential Six Acre Minimum Lot Size). 2. Submittal and recordation of a Parcel Plat prepared in accordance with Article 3.16 of the Mohave County Subdivision Regulations. 3 . 4. 5 . 6 . 7 . ,- -\ 8. The establishment of a minimum lot size based on the size of parcels per the recorded Parcel Plat. Each parcel shall have legal access. The two (2) parcels shall meet or exceed six (6) acres exclusive of road easements or rights-of-way. The parcel Plat shall show any surface drainage or FEMA flood zones. No building/zoning permits shall be issued until after Parcel Plat recordation. The Board of Supervisors accept the abandonment of fifteen (15') feet of the existing fifty (50') foot roadway easement along the east and north boundaries, and twenty (20') feet of the existing fifty (50') foot roadway easement along the south boundary of the ....~ 4. . . Resolution No. 92-403 Page 3 PAGE 3 OF 4 aK 2146 PG 862 (FEE~92-67S88) subject property to be replaced by the dedication of a thirty-five (35') foot road right-of-way along the east and north boundary, and a thirty (30') foot dedication along the southern boundary of the subject property. Also the dedication of twenty (20') foot radius curves at the northeast and southeast corners of the subject property. In addition the granting of an eight ( 8' ) foot public utility easement along the north, east and south boundaries of this parcel. This shall be approved through the recording of the resolution authorizing this zone change, and that the dedication/granting statement and dedication/granting be shown on the Parcel Plat. 9. That appropriate zoning/building/environmental permits be obtained. 10. The rezone shall not become effective for at least thirty (30) days after final approval of the change in classification by the Board of Supervisors. Being January 6, 1993 , as per ARS 11-829E. ( ''1 11. I f these conditions are not met within one (1) year this approval shall be void. If at the expiration of this period the property has not been improved for the use for which it was conditionally approved, the Board after notification by registered mail to the owner and applicant who requested the rezoning shall schedule a public hearing to grant an extension, determine compliance with the schedule for development or cause the property to revert to its former zoning classification in accordance with Arizona Revised Statutes Annotated, Title 11, Chapter 6, 11-832. At the request of Roq~r Esquerra, cartoqrapher, the Planninq Commission recommends Final Plat and Parcel Plat Boundaries be a triple wide line as the 1/8" blue line border obscures dimensions. WHEREAS, the notice of hearing was published in the Kingman Standard, a newspaper of general circulation in Kingman, Mohave , '~ County, Arizona, on November 20; 1992, and posted November 19, 1992, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. - .. ~ ."" j .1 ,'~' .J .......
