PAGE 1 OF 4 OHAVE COUNTY BOARD Of SUPERVISORS ECORDIHG FEE 0.00 He RESOLUTION NO. 92-402 A RESOLUTION SETTING FORTH THE REZONING OF A PORTION (NORTHWEST 862 FEET) OF PARCEL 247, STOCKTON HILL RANCHES UNIT 8, SECTION 36, TOWNSHIP 23 NORTH, RANGE 17 WEST, FROM: A-R/10A (AGRICULTURAL RESIDENTIAL/TEN ACRE MINIMUM LOT SIZE) ZONE, PROPOSED TO BE: A- R/6A (AGRICULTURAL RESIDENTIAL/SIX ACRE MINIMUM LOT SIZE) ZONE, LOCATED IN THE NORTH KINGMAN AREA, MOHAVE COUNTY, ARIZONA WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on December 7, 1992, a public hearing was conducted to determine whether approval should be granted to 0;. . -~.~ Charles Donour of San Diego, California, for a zone change from the existing A-R/10A (Agricultural Residential/Ten Acre Minimum Lot Size) zone, to A-R/6A (Agricultural Residential/Six Acre Minimum Lot Size) zone, located in the North Kingman portion of the Mohave County General area, and WHEREAS, Section 36 is approximately five (5) miles north of the Butler area and approximately one-quarter (.25) mile east of Stockton Hill Road. The property is accessed from Stockton Hill Road via Jane Avenue east approximately one-half (.5) mile to Bannister Street, thence north approximately one-half (.5) mile to the southwest corner of the subject property, and ,c) WHEREAS, review of floodplain map #0400s8-21ssC indicates this Parcel to be clear of a designated floodplain. Surrounding land uses consist primarily of vacant land with a few scattered residences. The applicant desires to split this twelve (12+) acre parcel into two (2) six (6+) acre parcels, and WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on November 18, 1992, the Commission recommended a conditional APPROVAL of the requested rezoning with the applicant understanding and accepting the following conditions: 1. '.1 j' ! ,.1 \,:.;,;iI The West parcel be zoned A-R/sA (Agricultural Residential/Five Acre Minimum Lot Size) and the East parcel be zoned A-R/6A (Agricultural-Residential/Six Acre Minimum Lot Size). 2. Submittal and recordation of a Parcel Plat prepared in accordance with Article 3.16 of the Mohave County Subdivision Regulations. 3 . 4 . S. 6. 7 . 8 . ')~ , ',-:1 9 . The establishment of a mlnlmum lot size based on the size of parcels per the recorded Parcel Plat. Each parcel shall have legal access. The two (2) parcels shall meet or exceed six (6) acres exclusive of road easements or rights-of-way. The parcel Plat shall show any surface drainage or FEMA flood zones. No building/zoning permits shall be issued until after Parcel Plat recordation. That appropriate zoning/building/environmental permits be obtained. The Board of Supervisors accept the abandonment of fifteen (15') feet of the existing fifty (50') foot road easement along north boundary, and twenty ( 20' ) feet of the existing fifty (50') foot road easement .,,...... , . . Resolution No. 92-402 Page 3 PAGE 3 OF + BK 2146 PG 858 (FEE~92-67587) along the west boundary of the subject property to be replaced by the dedication of a thirty-five (35') foot road right-of-way along the north boundary, and a thirty (30') foot dedication along the western boundary of the subject property. Also the dedication of twenty (20') foot radius curve at the northwest corner of the subject property. In addition the granting of an eight (8') foot public utility easement along the north and west boundaries of this parcel. This shall be approved through the recording of the resolution authorizing this zone change, and that the dedication/granting statement and dedication/granting be shown on the Parcel Plat. 10. The rezone shall not become effective for at least thirty (30) days after final approval of the change in classification by the Board of Supervisors. Being January 6, 1993, as per ARS 11-829E. , -:;.:_: 11 . I f these conditions are not met within one (1) year this approval shall be void. If at the expiration of this period the property has not been improved for the use for which it was conditionally approved, the Board after notification by registered mail to the owner and applicant who requested the rezoning shall schedule a public hearing to grant an extension, determine compliance with the schedule for development or cause the property to revert to its former zoning classification in accordance with Arizona Revised Statutes Annotated, Title 11, Chapter 6, 11-832. At the request of Roqer Esquerra, cartoqrapher, the Planninq Commission recommends Final Plat and Parcel Plat Boundaries be a triple wide line as the 1/8" blue line border obscures dimensions. WHEREAS, the notice of hearing was published in the Kingman Standard, a newspaper of general circulation in Kingman, Mohave County, Arizona, on November 20, 1992, and posted November 19, 1992, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. ~...,' . . Resolution No. 92-402 Page 4 PAGE 4 OF 4 8K 2146 PG 859 (FEE~92-67587) NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, December 7, 1992 approved this change in zoning as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
