PAGE 1 OF 3 MOHAVE COUNTY BOARD OF SUPERVISORS RECORDING FEE 0.00 He RESOLUTION NO. 92-392 A RESOLUTION SETTING FORTH AN EXTENSION OF TIME FOR THE APPROVED PRELIMINARY PLAN OF AZTEC JUNCTION, TRACT 3019, BEING A SUBDIVISION OF PARCEL 46 AND A PORTION OF PARCEL 47 PER THE RECORD OF SURVEY MAP FOR SECTION 10, TOWNSHIP 21 NORTH, RANGE 18 WEST, LOCATED IN THE GOLDEN VALLEY AREA, MOHAVE COUNTY, ARIZONA WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on December 7, 1992, a public hearing was conducted to determine whether approval should be granted to Aztec Junction One Limited Partnership, Jim Kuden, General Partner of Escondido, California for an extension of time for the approved preliminary plan of AZTEC JUNCTION, Tract 3109, being a subdivision of Parcel 46 and a portion of Parcel 47, per the Record of Survey map for Section 10, Township 21 North, Range 18 West, in the Golden Valley area, and WlIEREAS, the owner/developer of this tract is Aztec Junction One Limited Partnership, Jim Kuden, General Partner, of Escondido, California. The Engineer responsible for the preparation of the drainage report and design of this subdivision is Mohave Engineering Associates, Inc., Kingman, Arizona, and WHEREAS, the preliminary plan depicts fifty-one (51) acres subdivided into one hundred fifty-three (153) lots. Resolution No. 92-392 Page 2 PAGE 2 Of J BK 2146 PG 817 (FEE~92-67517) (3) lots fronting on Highway 68 range in size from 1.15 to 4.30 acres and are proposed to be zoned C-2 (General Commercial). The remainder of the tentative tract or 38.4 acres is proposed to be subdivided into one hundred fifty (150) lots. These lots range in size from six thousand (6,000) square feet to ten thousand (10,000) square feet for a density of 3.9 lots per acre, and WHEREAS, the preliminary plan for this tract was approved by the Mohave County Board of Supervisors on October 3, 1988, via P&CZ Resolution 88-149. Article 3.10-1 states, "Upon application to the commission and prior to the expiration of the time limit, 1...;'.:'4" ".":4 1,'1 , , ".n extensions in increments of one (1) year may be granted by the Board if the subdivider is actively processing the Final Plat. If such action is not taken than all proceedings relating to the plat shall be terminated", and WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on November 18, 1992, the Commission recommended conditional APPROVAL of the requested extension of time with the applicant understanding and accepting the following conditions: 1. In the letter dated October 16, 1992, received by P & Z October 18, 1992, Jim Kuden, General Partner owner/developer, states, "We have tried without success to sell Aztec to a number of developers but funds are not available for construction projects of our type at this time. Thus we are on hold until the economy recovers sufficiently to create demand for the type of homes allowed on the Aztec Junction type project. ~ . . Resolution No. 92-392 Page 3 PAGE 3 OF 3 BK 21~6 PG 818 (FEEt92-67577) In addition, sewer requirements have stiffened which precludes our increasing lot sizes from 6,000 to 10,000 square feet and moving ahead with construction of fewer homes. It is obvious that we are locked in for now until the demand for the homes to be built is in place. Thus, we ask the County to bear with us and grant this extension of time herein requested. II 2. This is the third extension of time for this project. 3. This extension of time will be in effect until October 3, 1993. 4. As provided in Article 3.10-1 "..., extensions in increments of one (1) year may be granted by the Board if the subdivider is actively processinq the Final Plat. If such action is not taken than all proceedinqs relatinq to the plat shall be terminated." At the request of Roqer Esquerra, cartoqrapher, the Planninq Commission recommends Final plat and Parcel Plat Boundaries be a ;;:1 triple wide line as the 1 /8 II blue line border obscures j dimensions. ;.:'~ WHEREAS, the notice of hearing was published in the Kingman Standard, a newspaper of general circulation in Kingman, Mohave County, Arizona, on November 21, 1992, and as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, November 2, 1992 approved this extension of time for the preliminary plan of AZTEC ", 3109, as recommended by the Mohave County Commission and outlined herein.
