A RESOLUTION SETTING FORTH THE REZONING OF LOT 1, BLOCK N, LAKE
MOHAVE RANCHOS i5C AMENDED, SECTION 29, TOWNSHIP 26 NORTH, RANGE
19 WEST, FROM: A-R/I0A (AGRICULTU~ RESIDENTIAL/TEN ACRE MINIMUM
LOT SIZE) ZONE, PROPOSED TO BE: A-R/7A & 3A (AGRICULTU~
RESIDENTIAL/SEVEN AND THREE ACRE MINIMUM LOT SIZE) ZONES, LOCATED
IN THE DOLAN SPRINGS AREA, MOHAVE COUNTY, ARIZONA
WHEREAS, at the regular meeting of the Mohave County Board
of Supervisors held on December 7, 1992, a public hearing was
conducted to determine whether approval should be granted to
:j Diane Sandland of Dolan Springs, Arizona, for a zone change from
, :J the existing A-R/I0A. (Agricultural Residential/Ten Acre Minimum
Lot Size) zone to A-R/7A & 3A (Agricultural Residential/Seven and
Three Acre Minimum Lot Size) zones, located in the Dolan Springs
area, and
WHEREAS, Section 29 is approximately three and one-half
(3.5) miles north of Pierce Ferry Road. The subject property is
accessed
from Pierce
Ferry
Road via
Cedar Road
north
approximately two and one-half (2.5) miles to 11th Street, thence
west approximately one-half (.5) mile to Canyon Drive, thence
north approximately one (1) mile to 13th Street, thence east
~1 approximately thirteen hundred. (1300') feet to Yost Street,
thence north approximately nine hundred (900') feet to the
southeast corner of the subject property, and

WHEREAS, on August 14, 1992, the applicant presented a
letter dated August 13, 1992 to the Planning & Zoning Department,
stating, "No matter what the outcome of the application, I would
like to request a refund of my $350.00 application fee." At this
time the applicant was informed that she should present this
issue to the Planning and Zoning Director, Jim Neblett. The
applicant was also informed that the application could be
processed but that a refund would not be likely.
The applicant
opted not to speak to Mr. Neblett, and

indicates this parcel to be clear of a designated floodplain.

The property is vacant, as well as most surrounding properties.
The applicant desires to split this thirteen (13+) acre parcel
into two 3+ acre parcels and one 7+ acre parcel, and
WHEREAS, on wednesday, September 9, 1992, the Mohave County
Planning and Zoning Commission recommended conditional approval
of the above referenced zone change request.
Pr ior to the
advertised Board of Supervisors Hearing on October 5, 1992, the
applicant requested this item be pulled from the agenda.
During
the actual survey of the property, the owner discovered that the
approved forty (40') foot roadway and utility easement along the
west and south boundaries of the property would not allow these
parcels to meet the minimum approved acreage.

the owner is seeking an amendment to the recommendations to allow
for a thirty (30') foot roadway and utility easement which would
allow them to meet the minimum acreage. Old language is otruck,
new language is bolded, and
WHEREAS, at the public hearing before the Mohave County
Planning and Zoning Commission on November 18,
1992, the
Commission recommended a conditional APPROVAL of the requested
rezoning with the applicant understanding and accepting the
following conditions:
1.
The northernmost parcel be zoned A-R/7A (Agricultural-
Residential/Seven Acre Minimum Lot Size) and the
southern parcels be zoned A-R/3A (Agricultural-
Residential/Three Acre Minimum Lot Size).

2. Submittal and recordation of a Parcel Plat prepared in
accordance with Article 3.16 of the Mohave County
Subdivision Regulations.
3. The establishment of a m~n~mum lot size based on the
size of parcels per the recorded Parcel Plat.
4. Each parcel shall have legal access.
5. The northern parcel shall meet or exceed seven ( 7 )
acres and the southern parcel shall meet or exceed
three (3) acres exclusive of road easements or rights-
of-way.
6. The Parcel Plat shall show any surface drainage or FEMA
flood zones.

The Board of Supervisors accept the granting of a
twenty (20') foot radius curve at the southwest corner
of the subject property and a forty (10') foot thirty
(30') foot roadway and public utility easement along
the southern boundary of the subject property and the
western boundary, terminating at the southwestern
corner of the proposed northern most parcel. This
shall be approved through the recording of the
resolution authorizing this zone change, and that the
granting statement and granting be shown on the Parcel
Plat.

8. The applicant submit adequate proof of ownership prior
to the October 5, 1992 Board of Supervisors meeting
which will consider this rezone request.
9. No building/zoning permits shall be issued until after
Parcel Plat recordation.
, 10. That appropriate zoning/building/environmental permits
be obtained.
11. The rezone shall not become effective for at least
thirty (30) days after final approval of the change in
classification by the Board of Supervisors. Being
January 6, 1993, as per ARS 11-829E.

12. If these conditions are not met within one (1) year
this approval shall be void. If at the expiration of
this period the property has not been improved for the
use for which it was conditionally approved, the Board
after notification by registered mail to the owner and
applicant who requested the rezoning shall schedule a
public hearing to grant an extension, determine
compliance with the schedule for development or cause
the property to revert to its former zoning
classification in accordance with Arizona Revised
Statutes Annotated, Title 11, Chapter 6, 11-832.

At the request of ROGer ESGuerra, cartoGrapher, the Planninq
Commission recommends Final Plat and Parcel Plat Boundaries be a
triple wide line as the 1/8" blue line border obscures
dimensions.
WHEREAS, the notice of hearing was published in the Kingman
Standard, a newspaper of general circulation in Kingman, Mohave
County, Arizona, on November 20, 1992, and posted November 19,
1992, as required by Arizona Revised Statutes and the Mohave
County Zoning Regulations.

NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors,
at their regular meeting on Monday, December 7, 1992 approved
this change in zoning as recommended by the Mohave County
Planning and Zoning Commission and outlined herein.
