WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on December 7, 1992, a public hearing was conducted to amend the Mohave County General Plan, South Mohave Valley Area Plan, to provide for single family residential, mobile home park and commercial uses in Section 27, Township 18 North, Range 22 West, located in the South Mohave Valley area, and WHEREAS, the Planning and Zoning Commission is required to recommend to the Board of Supervisors a County land use General Plan which is designed to conserve natural resources, to insure efficient expenditure of public funds, and promote the health, safety, convenience, and general welfare of the public. The South Mohave Valley Area Plan is a part of the Comprehensive General Plan of Mohave County, and WHEREAS, Section 27 is located approximately eight (8) miles south of the Bullhead City's southernmost border. Resolution No. 92-389 PAGE 2 OF 13 N. 2146 P6 799 (V:~'92-61S7~l Page 2 bounded by Highway 95, King Street, Willow Drive, and Green Valley Road, and WHEREAS, review of floodplain map #040058-2605C indicates portions of this section to be within a major designated floodplain. Current Section 25 land uses consist of three (3) recorded subdivisions, a twenty (20) acre school site, a variety of commercial uses along Highway 95, with the majority of the section being vacant, undeveloped land used for agricultural purposes, and WHEREAS, the applicant desires to amend the plan for a thirty-seven (37) acre portion of the northeast quarter of Section 27. The amendment would provide for the development of a proposed mobile home and RV park, and WHEREAS, a public meeting to receive input from the surrounding property owners was held on October 6, 1992, at the Mohave Valley Elementary School #16 at 7:00 p.m. A letter addressing the concerns raised during the meeting was mailed to the Willow Valley Property Owners Association and the Club Association, and WHEREAS, the Planning and Zoning Commission at their meeting on November 18, 1992 did recommend APPROVAL of the amendment of . . Resolution No. 92-389 Page 3 PAGE :3 OF 13 BK 2146 PG 800 (FEEt92-67575) the South Mohave Valley Area Plan, via Resolution P&ZC: 92-2 [Exhibit "AA"], as presented to the public, and WHEREAS, the notice of hearing was published in the Kingman Standard, a newspaper of general circulation in Kingman, Mohave County, Arizona on November 21, 1992, and in the Mohave valley Daily News, and posted November 20, 1992 as required by Arizona Revised Statutes. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, December 7, 1992, approved and adopted this amendment to the Mohave County General Plan, '. :.j South Mohave Valley Area Plan, as recommended by the Mohave County Planning and Zoning Commission and outlined herein. WHEREAS, at the regular meeting of the Mohave County Planning and Zoning Commission held on November 18, 1992, a public hearing was conducted to amend the South Mohave Valley . ~ " ,',1 Area Plan, to provide for combination Mobile Home and Recreational Vehicle Park in Section 27, Township 18 North, Range 22 West, in the South Mohave Valley area, and WHEREAS, the Planning and Zoning Commission is required to recommend to the Board of Supervisors a County land use General Plan which is designed to conserve natural resources, to insure efficient expenditure of public funds, and promote the health, safety, convenience, and general welfare of the public, and WHEREAS, Section 27 is located in the lower South Mohave Valley area. The section is located approximately eight ( 8) ., ., miles south of the Bullhead City' Limits. The section is bounded by King Street, Highway 95, Willow Drive and Green Valley Road. The section is occupied by Willow Valley Mobile Home Estates 17 " . . Resolution P&ZC: 92-2 Page 2 PAGE 5 OF 13 BK 2146 PG 802 (FEE~92-6757S) _:,,j ., and 18, Tracts 1072 and 1164-A, and Evergreen Addition, Tracts 4030. 4001, 4060, and Vista Tract Rio Estates, 4041, Furthermore, there exists large tracts of vacant agricultural land, a public school, and various commercial uses, most of which front on Highway 95, and WHEREAS, review of floodplain map #040058-2605C indicates this section as "NOT IN FEMA SPECIAL FLOOD HAZARD AREA. FLOODPLAIN USE PERMIT NOT REQUIRED" . In addition, the Transwestern Pipeline traverses the northern portion of this section, and WHEREAS, the applicant for this area plan amendment desires to establish a combination mobile home park and recreational vehicle park, and WHEREAS, a public meeting was held on October 6, 1992 at the Mohave Valley Elementary School #16 to gather input from the property owners in the section. Twenty-six (26) people were in attendance. The major concern of those in attendance involved a previously created Property Owners Association, through which members were provided ';lith access to a clubhouse and marina. According to the members present., . the clubhouse and marina is currently overburdened and should not have to accept any new members. Staff explained that the purpose of the Area Plan Amendment was to allow for a proposed rezone to establish a mobile home and recreational vehicle park and that the Planning Commission did not have the authority to enforce the document . . A letter dated November 5, 1992 (Exhibit "A"), was mailed to the Willow Valley Estates Property Owner's Association and the Willow Valley Club Association, from Staff, further explaining the proposed Area Plan Amendment and notifying them of the scheduled Planning & Zoning Commission meeting which would consider the proposal, and WHEREAS, the notice of hearing was published in the Kingman Standard, a newspaper of general circulation in Kingman, Mohave County, Arizona on October 31, 1992, and posted October 30, 1992 as required by Arizona Revised Statutes and Mohave County Zoning Regulations. ! --., ~'.,,_-..;;,J1 NOW THEREFORE BE IT RESOLVED BY, the Planning and Zoning Commission at their meeting on November 18, 1992, did APPROVE the amendment to the South Mohave Valley Area Plan to provide for Mobile Home and Recreational Vehicle park consideration in Section 27, Township 18 North, Range 22 West lying west of Highway 95 in the South Mohave Valley Area, as shown on Exhibit liB" . The meeting was held on October 6, 1992, at the South Mohave Valley Elementary School. !' ". Unfortunately, the sign-in sheet which included the mailing addresses of those individuals seeking a response, has been misplaced. Because the majority of those attending were residents of Willow Valley Estates, this letter is being addressed to the Willow Valley Estates Property Owner's Association, and the Willow Valley Club Association. A question was raised about the percentage of protestors necessary to require a unanimous vote of approval from the Mohave County Board of Supervisors. Because Area Plans do not actually change the zoning of the property, we do not have a formal vehicle, provided by the Arizona Revised Statutes, to consider the percentage of protestors. I have enclosed a copy of the handout which was available during the October 6, 1992, public input meeting. Illustration #1 shows the existing area plan for Section 27, Township 18 North, Range 22 West. Section 27 is highlighted in yellow. The approximate boundary of Willow Valley Estates is indicated as Single Family Residential (SFR) along the western most boundary of Section~27. Illustration #2 shows the proposed Area Plan for Section 27. Changes to the existing plan are highlighted in orange. The changes or additions include the following: A. The addition of Single Family Residential which would consider single family dwelling units, including mobile homes designed for single family occupancy, accessory . . The addition of an R-MH ( Single Family Residential Mobile Homes) and SFR or R-MH which would consider mobile home subdivisions approved according to the provisions of these regulation. Also included would be mobile home parks, and recreational vehicle parks. R-V parks would be required to be operated in conjunction with a mobile home park, and other uses allowed within an SFR area. C. Reduction of the 660' commercial strip to 330' (highlighted in red) directly north of the half section line adjacent to Highway 95. This includes the addition of approximately 660' of commercial frontage (highlighted in blue) along King St. at the NE corner of Section 27. Finally, Illustration #3 shows the particular portion of property (highlighted with purple) the owner is seeking to rezone from A-R (Agriculture/Residential) and Commercial to R-TT (Single Family Residential/ Mobile Homes and Travel Trailers) zone, for the purpose of developing a mobile home and RV park. It is because of this rezone request that the Area Plan Amendment for Section 27 was required. For those individuals wanting to know the difference between a Mobile Home and a Recreational Vehicle (RV), as defined in the Mohave County Zoning Regulations, the definitions are included in Illustration #4. On Wednesday November 18, 1992, the Mohave County Planning and Zoning Commission will hold their regularly scheduled meeting to consider a number of items, one of which will be the proposed Amendment to the above described Area Plan. The meeting will begin at 6: 30 P. M. in the Negus building located at 809 East Beale St. During this time, the concerns of the residents of Willow Valley Estates can be expressed to the Commission for consideration.
