PAGE 1 OF 5 MOHAVE COUNTY BOARD OF SUPERVISORS RECORDING FEE 0.00 Ne RESOLUTION NO. 92-387 A RESOLUTION SETTING FORTH AN EXTENSION OF TIME FOR THE REZONING OF LOTS 18, 19 & 20, BERMUDA PLANTATION, BEING A PORTION OF SECTION 15, TOWNSHIP 17 NORTH, RANGE 22 WEST, FROM: R-E (RESIDENTIAL RECREATION) ZONE, PROPOSED TO BE: (S-D)R-M (SPECIAL DEVELOPMENT MULTIPLE FAMILY RESIDENTIAL) ZONE, LOCATED IN THE SOUTH MOHAVE VALLEY AREA, MOHAVE COUNTY, ARIZONA WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on December 7, 1992, a public hearing was conducted to determine whether approval should be granted to OWEN DEVELOPMENT, represented by Michael J. Mangana of Monrovia, California, for an extension of time for the rezoning of Lots 18, 19 & 20, Bermuda Plantation, being a portion of Section 15, Township 17 North, Range 22 West, from the existing R-E (Res idential Recreation) zone to (S-D) R-M (Spec ial Development Mul tiple Family Residential) zone, located three hundred sixty (360') feet west of River Avenue south of Levee Drive, in the South Mohave Valley area, and WHEREAS, Bermuda Meadows subdivision is located approximately thirteen (13) miles south of Bullhead City's southern limits and is accessed from Highway 95 via Harbor Avenue at Higgen's Corner south to Levee Drive. The property is currently occupied. Surrounding land uses consist of a mixture of residences and vacant land with the Colorado River to the south. proposed subdivisions named Mauna Kea & Mauna Lani to the north are being processed by the applicant. The subject property extends from Levee Drive south across Dike Road to the river. The proposed site plan indicates a duplex on Lot 18 and a three-plex on Lots 19 & 20 for a total of five (5) units on the three (3) lots, and WHEREAS, followinq are the oriqinal conditions of approval as specified in Resolution 91-313: 1. The applicant comply with all applicable provisions of Sections 25, 26, 27, and 31 of the Mohave County Zoning Regulations. In addition to compliance with Mohave County Ordinance 87-1 (Dark Sky Ordinance). The ZONING PLAN be approved for a (S-D) R-M/ 1 & 2A (Special Development/Multiple Family Residential/One & Two Acre Minimum Lot Size) zone in accordance with Section 19 of the Mohave County Zoning Regulations. The one acre minimum shall apply to Lot 18. The two acre minimum lot size shall apply to Lots 19 & 20 as they are combined by the applicant. 2. The owner accepts that whenever a "S-D" zone is granted, each phase of stage of development of building proposals shall be submitted to the planning staff, to be evaluated and compared with the approved zoning plan before any permits may be granted. 4. The applicant shall pave all driveway access, roadways and parking in accordance with Mohave County Standard Specification #171, or better. The rezone shall not become effective for at least thirty (30) days after final approval of the change in classification by the Board of Supervisors. Being January 2, 1992, as per ARS 11-829E. 14. If these conditions are not met within one (1) year this approval shall be void. If at the expiration of this period the property has not been improved for the use for which it was conditionally approved, the Board after notification by registered mail to the owner and applicant who requested the rezoning shall schedule a public hearing to grant an extension, determine compliance with the schedule for development or cause the property to revert to its former zoning classification in accordance with Arizona Revised Statutes Annotated, Title 11, Chapter 6, 11-832. WHEREAS, the applicant has indicated his reasons for an extension are the timinq of sewer line installation Qy the Fort :73 Moiave Tribal Utilities Authority (FMTUA) and approval of proposed neiqhborinq tracts Mauna Kea and Mauna Lani, and WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on November 18, 1992, the Commission recommended conditional APPROVAL of the requested extension of time with the applicant understanding and accepting the following conditions: 1. Continued compliance with conditions of Resolution No. 91-313. 2. Required building permits be accompanied by a site plan in accordance with Section 27.P. 3. Resolution No. 92-387 Page 5 PAGE S OF 5 BK 2146 PG 794 (FEE~92-67S73) WHEREAS, the notice of hearing was published in the Kingman Standard, a newspaper of general circulation in Kingman, Mohave County, Arizona, on November 21, 1992, and in the Mohave Valley Daily News, and posted November 20, 1992 as required by Arizona Revised Statutes, and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, December 7, 1992 approved the granting of this extension of time for a conditional Zone Change as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
