PAGE 1 OF 4- NOHAVE COUNTY BOARD OF SUPERVISORS RECORDING FEE 0.00 HC RESOLUTION NO. 92-386 A RESOLUTION SETTING FORTH AN EXTENSION OF TIME FOR THE REZONING OF A PORTION OF NW~ SECTION 25, TOWNSHIP 19 NORTH, RANGE 22 WEST, FROM: A-R (AGRICULTURAL RESIDENTIAL) ZONE, PROPOSED TO BE: R-MH (SINGLE FAMILY RESIDENTIAL MOBILE HOME) ZONE, LOCATED IN THE SOUTH MORAVE VALLEY AREA, MORAVE COUNTY, ARIZONA WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on December 7, 1992 r a public hearing was conducted to determine whether approval should be granted to John Gerogedes of Bullhead City, Arizona, for an extension of time for the rezoning of a portion of the NW~ Section 25, Township 19 North, Range 22 West, From: A-R (Agricultural Residential) zone, proposed To Be: R-MH (Single Family Residential Mobile Home) zone, proposed as expansion of an existing mobile home park, located seven hundred fifty (750~) feet south of El Rodeo Road on the east side of Mountain View Road, in the South Mohave Valley area, and WHEREAS, Section 25 is located approximately two (2) miles south of Bullhead City~ s southernmost border and approximately one ( 1) mile west of Highway 95. The subject property is accessed from Highway 95 via EI Rodeo Road east approximately one (1) mile to Mountain View Road thence south approximately eight hundred (800) feet on the east side of the street, and ,- . , .. . . Resolution No. 92-386 Page 2 .. . PAGE 2 OF 4 BK 2146 PG 787 (FEEt92-67572) WHEREAS, review of floodplain map #040058-2445C indicates this area to be within a major designated floodplain. The subject property is currently vacant and surrounding uses consist of Beverly Hill Estates to the south, Las Estancias to the west across Mountain View Road, EI Rodeo Mobile Home Park to the east and vacant land to the north, and WHEREAS, the applicant desired this two plus (2+) acre parcel to be zoned R-MH and provide for the expansion of the current EI Rodeo Mobile Home Park west to Mountain View Road. The expansion would also allow for the park to connect to a !~~' ~~~ sanitary sewer line being provided by the applicant, and WHEREAS, followinq are the oriqinal conditions of approval as specified in Resolution 91-264: 1. The applicant comply with all applicable provlslons of Sections 25, 26, 27, and 31 of the Mohave County Zoning Regulations. In addition to compliance with Mohave County Ordinance 87-1 (Dark Sky Ordinance). 2. The applicant submit requisite plans and reports in accordance with Section 27.1 of the Mohave County Regulations, or its successor, for review and approval by the Commission. 3. These lots will not be for sale unless or until they have been approved as subdivided parcels by Mohave County Planning and Zoning and have met all requirements of the State of Arizona. 4. Provision for a buffer, in the form of a six (6') foot block wall on the southern boundary and on the western boundary being Mountain View Road, except for approved access point, shall be required. Provision of five (5') foot sight proof fence shall be required along the north boundary of this parcel. ~ . . Resolution No. 92-386 Page 3 PAGE '3 Of 4 8K 2146 PG 788 (FEE~92-61572) ,5. Arizona Department of Environmental Quality approves the water supply and distribution system. 6. Arizona Department of Environmental Quality approves the quantity and quality of the water supply. 7. Arizona Department of Environmental Quality approves the use and design of the sewage treatment facility for this development. 8. The Board of Supervisors accept the dedication of a forty-two foot (42 ~) right-of-way and eight (8 ~) foot PUE along Mountain View Road as it is contiguous to this property in addition to twenty (20~) foot radii at the intersection of the proposed access to Mountain View Road from this portion of the project through the approval of the resolution authorizing the zone change, and that the dedication statement and dedication be shown on a document acceptable to the Public Works Department. 9. The owner/developer shall pave the interior access road up to Mountain View Road right-of-way and pave Mountain View Road as it is contiguous to this site. The paving of the aforementioned roads shall be to Mohave County Standards 101.10A or better and shall be placed on the center line of roadway right-of-ways in a width and design as approved by the County Engineer. 10. That appropriate zoning/building permits be obtained. 11. Adequate parking shall be implemented in accordance with the Mohave County zoning Ordinance. 12. The rezone shall not become effective for at least thirty (30) days after final approval of the change in classification by the Board of Supervisors. Being November 6, 1991, as per ARS 11-829E. 13 . I f these conditions are not met wi thin one (1) year this approval shall be void. If at the expiration of this period the property has not been improved for the use for which it was conditionally approved, the Board after notification by registered mail to the owner and applicant who requested the rezoning shall schedule a public hearing to grant an extension, determine compliance with the schedule for development or cause the property to revert to its former zoning classification in accordance with Arizona Revised Statutes Annotated, Title 11, Chapter 6, 11-832. Resolution No. 92-386 Page 4 WHEREAS, the applicant has PAGE 4 OF 4 BK 2146 PG 789 (FEE~92-61572) indicated his reasons for an extension are to continue the submittal and review process. The ini tial plan submittal for this portion of the park has been received Qy Staff and is under review, and WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on November 18, 1992, the Commission recommended conditional APPROVAL of the requested extension of time with the applicant understanding and accepting the following conditions: 1. Continued compliance with conditions of Resolution No. 91-264. 2. This extension of time be granted for this use until October 7, 1993. .-",,: WHEREAS, the notice of hearing was published in the Kingman Standard, a newspaper of general circulation in Kingman, Mohave County, Arizona, on November 21, 1992, and in the Mohave Valley Daily News, and posted November 20, 1992 as required by Arizona Revised Statutes, and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, December 7, 1992 approved the extension of time for a conditional Zone Change the Mohave County Planning and Zoning herein. / MOHAVE COUNTY BOARD OF SUPERVISORS ~~ Chairman t'
