PAGE 1 OF 4 rtOHAVE COUNTY BOARD OF SUPERVISORS RECORDING FEE 0.00 He RESOLUTION NO. 92-381 A RESOLUTION SETTING FORTH APPROVAL OF A ZONING USE PERMIT FOR THE ESTABLISHMENT OF A MOBILE HOME PARK IN A R-E (RESIDENTIAL RECREATION) ZONE, IN A PORTION OF SECTION 16, TOWNSHIP 14 NORTH, RANGE 20 WEST, LOCATED IN THE LAKE ~VASU AREA, MO~VE COUNTY, ARIZONA WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held December 7, 1992 a public hearing was conducted to determine whether approval should be granted to Havasu Heights Ranch and Development Corporation, represented by Robert Klemm, of Lake Havasu City, Arizona, for a Zoning Use Permit (ZUP) for the establishment of a mobile home park in a R-E (Residential Recreation) zone, in a portion of Section 16, Township 14 North, Range 20 West, occupying the northeast corner of Chenoweth Drive and London Bridge Road in the Lake Havasu area, and WHEREAS, this property is located at the northeast corner of London Bridge Road and Chenoweth Drive, approximately one-half (.5) mile west of Highway 95 and approximately one-quarter (.25) mile west of the Lake Havasu City Limits, and WHEREAS, review of Floodplain map #040058-3110B indicates this area is not in a FEMA special flood hazard area. The existing Mobile Home Park is only the middle portion of the originally approved park in 1969. In an effort to complete the park according to current standards and requirements the owner is requesting a zoning use permit. Sewage will be handled by proposed common septic systems or as approved by Mohave County Health Department and Arizona Department of Environmental Quality. The size of the property is 4.7 and 15.8 acres. These mobile home spaces will be for RENT only, and WHEREAS, a public hearing before the Mohave County Planning and Zoning Commission on November 18, 1992 and did generate a recommendation of APPROVAL of the requested Zoning Use Permit contingent upon the following conditions: 1. The applicant comply with all applicable provisions of Sections 25, 26, 27, and 31 of the Mohave County Zoning Regulations. Compliance with Section 27 P. (Site plan Requirements) and Ordinance 87-1 (Dark Sky Ordinance) is also required. 2. The applicant submit plans and reports in accordance with Section 27-1 of the Mohave County Regulations, or its successor, for review and approval by the Commission and Board of Supervisors. 3. These lots/spaces will not be for sale unless or until they have been approved as subdivided parcels by the Mohave County Board of Supervisors and have met all the requirements of the State of Arizona. NOTE: THE FOLLOWING 3 ITEMS APPLY TO ENVIRONMENTAL REQUIREMENTS. 4. Water approval as per Mohave County Zoning Regulations Section 27-1. 5. Arizona Department of Environmental Quality approves the quality of the water supply and the distribution system. ~ .. Arizona Department of Environmental Quality approves the use and design of the onsite liquid waste disposal systems. NOTE: THE FOLLOWING 5 ITEMS APPLY TO TRANSPORTATION RELATED REQUIREMENTS. 8. The applicant shall improve all driveway access, roadways, pads and parking in accordance with Mohave County Standard Specification #173, or better as requested by the Planning and zoning Commission on November 18, 1992. (The Commission, through it's staff, would consider an alternative design in lieu of asphalt for the pad only.) 9. The County Engineer will review the drainage plan and site plan at the time of plan submittal. 10. The buffer, in the form of a six (6') foot block wall shall be required along the boundaries of this site except approved access points. (The Commission, through it's staff would consider an alternate design approved by staff to assure lot protection and non- access in lieu of a block wall.) 12. Condition #11 shall also apply to the existing mobile home park as this approval will allow for the expansion of the use. 13. The appropriate zoning/building/environmental permits be obtained. 14. Appropriate signage permits be obtained. 15. If construction or use has not commenced within one (1) year of Board approval of the Zoning Use Permit, or if the use has been discontinued for six (6) months, then approval shall terminate at that date. 16. This Zoning Use Permit is subject to revocation upon sixty (60) days notification by the Board of Supervisors, if in the opinion of the Commission and Board the continued use of the property would be contrary to the public health, safety, and welfare. .... .... .. . . If at the expiration of this period the property has not been improved for the use for which it was conditionally approved, the Board after notification by registered mail to the owner and applicant who requested the ZUP shall schedule a public hearing to grant an extension, determine compliance with the schedule for development or cause the property to revert to its former zoning classification in accordance with Arizona Revised Statutes Annotated, Title 11, Chapter 6, 11-832. WHEREAS, the notice of hearing was published in the Kingman Standard, a newspaper of general circulation in Kingman, Mohave County, Arizona, on November 21, 1992, and in the Today Daily News, and posted November 20, 1992 as required by the Arizona Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, December 7, 1992 approved this Zoning Use Permit as recommended by the Mohave County Planning and Zoning Commission, subject to the conditions outlined herein.
