PAGE 1 OF 4 ~- 'W',!;~ ~ 1'10HAVE COUNTY BOARD OF SUPERVISORS W","" ".,,~ RECORDING FEE 0.00 li<~ ~~~' RESOLUTION NO. 93-47 A RESOLUTION SETTING FORTH ~PROVAL OF A ZONING USE PERMIT FOR THE ESTABLISlIMENT FOR STORAGE OF FLAMMABLE LIQUIDS, GASES AND BULK FUELS (PROPANE) IN AN A-D (AIRPORT-DEVELOP$NT) ZONE, LOCATED ON PARCEL B, SECTION 33, TOWNSHIP 22 NORTH, RANGE 16 WEST, LOCATED IN THE KINGMAN AHlo:A, MOHAVE COUNTY, ARIZONA WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held January 13, 1993 a public hearing was conducted to determine whether approval should be granted to Discovery Propane of Kingman, Arizona, for a Zoning Use Permit (ZUP) of the establishment of flammable liquids, gases and bulk fuels (propane) in an A-D Airport-Development) zone, and WHEREAS, Section 33 is located approximately one and one- half (1. 5) miles north of the Andy Devine & 1-40 interchange. This section is bisected by Highway 66 and the Atchison Topeka & Santa Fe (AT&SF) railroad tracks. The site is on the east side of the railroad right-of-way. Access to this site is through the entrance to the airport. This access from Highway 66 being via Industrial Parkway east approximately four hundred thirty (430') feet to Industrial Boulevard, thence south approximately thirteen (1,300') hundred feet'to the terminus of Industrial Boulevard thence continuing south on Rai.lroad Street, a dirt road running parallel to the tracks, approximately two (2) miles to the intersection of Railroad Street and Berry Road, and WHEREAS, the northeast corner of this intersection has five parcels delineated that are approximately nine thousand (9,000) square feet in size. The subject property is the second parcel north of this intersection being a distance ot approximately one hundred (150') feet, and .-..1' - . .(".-,:.0.-......... PAGE 2 OF ~ 5K 2171 PG 311 (FEE~~3- 6156) Resolution No, 93-47 Page 2 WHEREAS, review of floodplain map #040058-2165C indicates this area to be clear of a designated flood zone. The site is occupied. There exists a shed and concrete supports from a previous bulk propane installation. Surrounding land uses consists of two bulk propane tank facilities on the north and south of this site. The northern facility consist of one large propane tank being 38,000 gallons and the southern facility having two tanks for a combined capacity of 50,000 gallons, and WHEREAS, the applicant desires to establish a bulk propane storage facility consisting of a tank with a 18,000 gallon capacity, the existing shed and a storage yard of residential sized propane tanks. Through some misunderstanding the applicant was not aware of the requirement for this ZUP and has installed the tank. Staff has temporarily granted power to this site contingent upon approval of this facility by the Board of Supervisors, If this request is denied the applicant has given written agreement that the facility will be removed, and WHEREAS, as required in the regulations for an A-D zone any new use or change of use must be reviewed by the Commission and the Board of Supervisors. The regulations also require that bulk storage of flammable fuels obtain a Zoning Use Permit (ZUP). This Zoning Use Permit (ZUP) process will meet the requirement for notification of a change of use and a separate procedure for the change of use .will not be necessary. The Mohave County Airport Authority has verbally indicated their approval of this request, and WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on January 13, 1993, the Commission recommended APPROVAL of the requested Zoning Use Permit contingent upon the following conditions: PAGE 3 OF 4 BK 2171 PG 312 (FEE~93- 61~b) Resolution No. 93-47 Page 3 1. The applicant comply with all applicable provisions of Sections 25, 26, 27, and 31 of the MOhave County Zoning Regulations. Compliance with Section 27. P (Site Plan Requirements) and Ordinance 87-1 (Dark Sky Ordinance) is also required. 2. The applicant Section 13. 1 Regulations. comply with all applicable provisions of (A-D zone) of the Mohave County Zoning 3. Adequate parking shall be implemented in accordance with the Mohave County Zoning Ordinance. 4. Approval from fire safety agencies. Being the Hualapai Valley Fire Department and State Fire Marshal, 5. Appropriate zoning/building/environmental permits be obtained. 6. Any remainder of the lot not used for development shall be maintained free of debris and the vegetation controlled to m~n~m~ze potential fire hazards. Grasses/weeds shall be cut regularly to assure less than eight (8") inches of growth. I f crushed rock is used then the soil shall be maintained in a weed free condition. 7. If construction or use has not commenced within one (1) year of Board approval of the Zoning Use Permit or if the use has been discontinued for six (6) months, then approval shall terminate at that date. 8. This Zoning lJse Permit is subject to revocation upon Sixty (60) days notification by the Board of Supervisors, if in the opinion of the Commission and Board the continued use of the property would be contrary to the public health, safety, and welfare. 9. If these conditions are not met within one (1) year this approval shall be void. If at the expiration of this period the property has not been improved for the use for which it was conditionally approved, the Board after notification by registered mail to the owner and applicant who requested the ZUP shall schedule a public hearing to grant an extension, determine compliance with the schedule for development or cause the property to revert to its former zoning classification in accordance with Arizona Revised Statutes Annotated, Title 11, Chapter 6, 11-832. PAGE 4 Qf 4 .. 6\<<. 2171 PG '31'3 ~rEE."'3- 61-..6) Resolution No. 93-47 Page 4 WHEREAS, the notice of hearing was published in the Kingman Standard, a newspaper of general circulation in Kingman, Mohave County, Arizona, on January 16, 1993, and posted January 14, 1993, as required by Arizona Revised Statutes, and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday February 1, 1993 approved this Zoning Use Permit as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
