Avenue is via North hundred eight (108') 107 is located approximately eleven hundred of Northern Avenue and immediately east of Access to the subject property from Northern Bank Street to Devlin Avenue, thence east one feet to Lots 17 & 18, and WHEREAS, review of floodplain map it040058-2l65C indicates this site to be clear of a designated floodplain. The site is currently vacant, Surrounding zoninq consists of R-M (Multiple Family) to the east and southeast, C-1 (Neighborhood Commercial) to the west and north, C-2 (General Commercial) to the south with R-1 (Single Family Residential) to the northeast. Surrounding land ~ consists of single family residences to the east within the R-M zoned lots with the remainder being vacant land, A one hundred (100') foot drainage parcel lies immediately south of '~.~"_..".~..O'.~_M__~~=.'.".'_=m~O_~<~~"...=."~"~~~~.,_~._"~~_._~_~;... , *- PAGE 2 OF 3 BK 2171 PG 308 (FEE~93- 6155) Resolution No. 93-46 Page 2 these lots and runs through the center of the block, This drainage parcel is the separation of C-l & C-2 zoning along Bank Street with C-2 zoning on the south, and WHEREAS, the applicant desires to rezone these lots to single family residential classification for location of residences. Eight lots on the Rast portion of Block IDS, located to the northwest of this block, were rezoned to R-l via Resolution 90-372. The applicant has selected to rezone rather than submit Zoning Use Permits (ZUP's) for each lot. The pattern over the past few years show increasing demand for residential lots and people seeking to get ZUp's or rezones in order to place residences in vacant commercially zoned lots. As the lots across the street are zoned C-l and uses are to be compatible with neighborhoods, hence it's title, there should be no conflict if the lots are used commercially. It may be these lots will also be converted to residential, and WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on January 13, 1993, the Conunission reconunended APPROVAL of the requested rezoning with applicant understanding and accepting the following conditions: 1. The applicant comply with all applicable provisions of Sections 25, 26, 27, and 31 of the Mohave County Zoning Regulations, In addition to compliance with Ordinance 87-1 (Dark Sky Ordinance). 2. The rezone shall not become effective for at least thirty (30) days after final approval of the change in classification by the Board of Supervisors. Being March 3, 1993, as per ARS ll-829E. 5. If these conditions are not met within one (1) year this approval shall be void, If at the expiration of this period the property has not been improved for the use for which it was conditionally approved, the Board after notification by registered mail to the owner and applicant who requested the rezoning shall sChedule a public hearing to grant an extension, determine compliance with the schedule for development or cause the property to revert to its former zoning classification in accordance with Arizona Revised Statutes Annotated, Title 11, Chapter 6, 11-832. WHEREAS, the notice of hearing was published in the Kingman Standard, a newspaper of general circulation in Kingman, Mohave County, Arizona, on January 16, 1993, and posted January 14, 1993, as required by Arizona Revised Statutes, and the Mohave County Zoning Regulations.
