HomeMy WebLinkAbout93-045 ; ~~ . iNDEe j RESOLUTION NO. 93-45 A RESOLUTION SETTING FORTH THE REZONING OF LOT 2, BLOCK 14, MAVERICK ESTATES UNIT 1, SECTION 12, TOWNSHIP 21 NORTH, RANGE 16 WEST, FROM: A-R/IOA (AGRICULTURAL RESIDENTIAL/TEN ACRE MINIMUM LOT SIZE) ZONE, PROPOSED TO BE: A-R/2A & 4A (AGRICULTURAL RESIDENTIAL/TWO & FOUR ACRE MINIMUM LOT SIZE) ZONE, LOCATED IN THE KINGMAN AREA, MOHAVE COUNTY, ARIZONA WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on February 1, 1993, a public hearing was conducted to determine whether approval should be granted to Robert Pollock of West Covina, California, for a zone change from the existing A-R/I0A (Agricultural Residential/Ten Acre Minimum Lot Size) zone to A-R/2A, & 4A (Agricultural Residential/Two and Four Acre Minimum Lot Size) zones, occupying the southeast corner of Hopi Road and Durango Drive, located in the Kingman area, and WHEREAS, Section 12 is located one ( 1) mile east of the Kingman City Limits, and one-half (.5) mile north of Interstate Highway 40. The property is accessed form Airway Ave. east approximately two and one half (2.5) miles to Mohave Drive a section line road dividing Sections 10 & 11, thence south approximately one (1) mile to an unnamed dirt road, thence southeast approximately one-half (.5) mile to Ironwood road, these east approximately one (1) mile to Corral Drive, thence north approximately one-quarter (.25) mile north to Hopi Road, thence west approximately six hundred and thirty (630') feet to the northeast corner of the subject property, and WHEREAS, this rezoning will constitute the tenth (10th) split of record in this section. The split is in conformance with the City of Kingman~s General Plan, and WHEREAS, review of floodplain map #040058-2350C indicates this parcel to be clear of a designated floodplain. The property is currently vacant. Surrounding land uses consist primarily of vacant land, with the majority of the area used as grazing lands. Currently there is no electric power or other public services in the area, and WHEREAS, the (9.12) acre parcel (1), four (4+) acre applicant desires into two (2), two parcel, and to split this nine plus (2+) acre parcels and one "-. WHEREAS, at the public hearing before the Mohave County Planning and zoning Commission on January 13, 1993, the Commission recommended APPROVAL of the requested r:ezoning with applicant understanding and accepting the following conditions: 1. The two (2) western parcels be zoned A-R/2A (Agricultural Residential/Two Acre Minimum Lot Size), and the eastern parcel be zoned A-R/4A (Agricultural Residential/Four Acre Minimum Lot Size). 2. Submittal and recordation of a Parcel Plat prepared in accordance with Article 3.16 of the Mohave County Subdivision Regulations. 3. The establishment of a minimum lot size based on the size of parcels per the recorded Parcel Plat. 4. Each parcel shall have legal access. 5. The two (2) western parcels shall meet or exceed two (2) acres and the eastern parcel shall meet or exceed four (4) acres exclusive of road easements or rights- of-way. ..../ ~ . . No building/zoning permits shall be issued until after Parcel Plat recordation. 8, The Board of Supervisors accept the dedication of a twenty (20') footradlus curve at the northwest corner of this parcel WIH!I'O' Lt is contiguous to Hopi Road and Durango Drive. 'l'his shall be approved through the recording of the resolution authorizing this zone change, and that the dedication/granting statement and dedication/granting be shown on the Parcel Plat. 9. That appropriate zoning/building/environmental permits be obtained. - .... ,,-~~ 10. The rezone shall not become effective for at least thirty (30) days after final approval of the change in classification by the Board of Supervisors. Being March 3, 1993, as per ARS 11-829E. ~'",/ 11. I f these conditions are not met within one (1) year this approval shall be void. If at the ~xpiration of this period the property has not been improved for the use for which it was conditionally approved, the Board after notification by registered mail to the owner and applicant who requested the rezoning shall schedule a public hearing to grant an extension, determine compliance with the schedule for development or cause the property to revert to its former zoning classification in accordance with Arizona Revised Statutes Annotated, Title 11, Chapter 6, 11-832. At the request of Roqer Esquerra, cartoqrapher, staff recommends Final Plat and Parcel Plat boundaries be a triple wide line as the 1/8" blue line border obscures dimensions. WHEREAS, the notice of hearing was published in the Kingman Standard, a newspaper of general circulation in Kingman, Mohave County, Arizona, on January 16, 1993, and posted January 14, 1993, as required by Arizona Revised Statutes, and the Mohave County zoning Regulations. .' . .
