RESOLUTION NO. 93-44
RESOLUTION SETTING FORTH DENIAL OF A REQUEST FOR INCLUSION IN THE
BUILDING CODE/URBAN OVERLAY ZONE FOR SECTION 33, TOWNSHIP 23
NORTH, RANGE 16 WEST, BEING THE RESUBDIVISION OF RUBI ACRES OF
SUNWARD HO! RANCHES AKA SUNSET MOUNTAIN ESTATES, LOCATED IN THE
LONG MOUNTAIN PORTION OF THE MOHAVE COUNTY GENERAL AREA.
WHEREAS, at the regular meeting of the Mohave County Board
of Supervisors held on February 1, 1993, a public hearing was
conducted to determine whether approval should be granted for
the, inclusion in the Building Code/Urban Overlay Zone Section
33, located in the Long Mountain area, and
WHEREAS, section 33 is located approximately four (4) miles
north of the Butler area and lies east of Stockton Hill Road.
The subject road is accessed from Stockton Hill Road via Jane
Drive (approximately six (6) miles north of Northern Avenue),
east approximately one and one-quarter (1.25) miles to Cherum
Road, thence south approximately three-tenths (.3) mile to Calle
Alamo, thence east approximately two (2) miles to the southwest
corner of the section.

WHEREAS, review of floodplain map #04058-2155B indicates two
washes traverse the property.
The applicant owns thirty-five
(35) lots within the subdivision of which this section is
comprised.
The applicant is requesting this action in order to
be able to have building inspections done within his development.
The applicant is required to have Certificates of Occupancy
(CO's) to satisfy financial obligations.
Co's cannot be issued
without qualified building inspections.
WHEREAS, this section is within the boundaries of the Long
Mountain Area Plan.
This area is designated suburban on the
proposed General Plan document. Development within this area is
sparse.
WHEREAS, following is Section 12.1 of the Mohave County
Regulations which authorizes the establishment of Urban Overlay
zones and establishes criteria for evaluating this type of
request:
"Section 12.1 ESTABLISHMENT OF URBAN-RURAL OVERLAY ZONES
A. Urban Overlay Zone:
This overlay zone will serve to identify those "Urban"
areas in Mohave County exhibiting like characteristics as
those of municipality or expected to achieve said
characteristics within a ten (10) year projected time frame,
and/or, are a functional part of an existing incorporated
City and/or will be within a ten (10) year projected time
frame.

Will define and characterize and be applied over those
unincorporated County areas not identified as URBANIZED now
or within a ten (10) year projection. These areas exhibit
overall rural characteristics in terms of identity,
character, population, density and life-styles and will
include agrarian lands, grazing and open range areas, most
public lands, crossroads communities and those settled
communities with less than current or projected populations
of 2,500 people within compact and unidentifiable spatial
limits or boundaries and/or density of less than 1,500
permanent residents per square mile.
WHEREAS, the Commission at their meeting on January 13, 1993
did recommend DENIAL of the request for inclusion in the Building
Code/Urban Overlay Zone for Section 13 with the applicant
understanding and accepting the following conditions:
1, Insufficient density of structures or population to
warrant approval of this request at this time.
2. This area is not anticipated to be annexed within the
limits of Kingman City or become a functional part
thereof within the ten year time frame required.
3. The applicant does not own the entire section and no
other requests from property owners in the section have
been received.
4, The smallest area currently so designated without being
zoned nonresidential or bordered by a Municipality is
five sections, being the Golden Shores area.
5. The nearest urban overlay area is three (3) miles away.
NOTE: Ii the General Plan is adopted, ~ study should be initiated
to determine whether "suburban" areas can be included within ~
buildinq code area without havinq to meet urban characteristics.

WHEREAS, the notice of hearing was published in the Kingman
Standard, a newspaper of general circulation in Kingman, Mohave
County, Arizona, on January 16, 1993 and as required by Arizona
Revised Statutes and the Mohave County Zoning Regulations.
NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors,
at their regular meeting on Monday February 1, 1993, DENIED
approved this INCLUSION IN THE BUILDING CODE/URBAN OVERLAY ZONE
as recommended by the Mohave County Planning and Zoning
Commission and outlined herein.
