I1U c. . ftv '~.l!~Y' RESOLUTION NO. 93-43 A RESOLUTION SETTING FORTH THE REZONING OF PARCEL 23, LAZY Y-U RANCH, PHASE I, LOCATED IN SECTION 11, TOWNSHIP 20 NORTH, RANGE 16 WEST, FROM: A-R/36A (AGRICULTURAL-RESIDENTIAL/THIRTY-SIX ACRE MINIMUM LOT SIZE) ZONE, PROPOSED TO BE: A-R/7A, 1lA & 19A (AGRICULTURAL-RESIDENTIAL/SEVEN, ELEVEN & NINETEEN ACRE MINIMUM LOT SIZE) ZONES, LOCATED IN THE HUALAPAI MOUNTAIN PORTION OF THE MOHAVE COUNTY GENERAL AREA, MOHAVE COUNTY, ARIZONA WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on February 1, 1993, a public hearing was conducted to determine whether approval should be granted to David Hollingsworth of Kingman, Arizona, for a zone change from the existing A-R/36A (Agricultural Residential/Thirty-six Acre Minimum Lot Size) zone to A-R/7A, 11A &19A (Agricultural Residential/Seven, Eleven and Nineteen Acre Minimum Lot Size) zones, located in the northwest foothills of the Hualapai Mountains, located in the Hualapai Mountain portion of the Mohave County Genera area, and WHEREAS, the subject property is located approximately four (4) miles southeast of the Kingman City limits, on Hualapai Mountain Road. The subject property is approximately one (1) mile southeast of Hualapai Mountain Road and is accessed via Lazy Y-U Drive, Pack Saddle Drive and Saddletree Drive, and WHEREAS, review of floodplain map #040058-2350C indicates this area to be wi thin Flood Zone C. The terrain is rugged mountain foothill country. Well constructed gravel base roads serve these properties. The site is currently vacant and bordered on all sides by vacant land. The owner is requesting a division into three (3) parcels. The zone change is for A-R/7A, A-R/IIA . . PAGE 2 OF 4 BK 2171 FG 296 (FEE~93- 6152i ,:.; Resolution No. 93-43 Page 2 and A-R/19A Parcel designations from this original forty (40) acre parcel, and WHEREAS, Lazy Y-U Ranch, Phase I is the division of three (3) Sections plus eighty (80) acres, into fifty (50) parcels of forty (40) acres of more each. The developers plan to divide an additional six (6) Sections of land in the future, and WHEREAS, all roads are easements and as such do not create parcel divisions, according to the state Real Estate office. The road designation is designated as follows: "easements shown.. . are perpetual in nature and are created for ingress/egress, drainage and public utility purposes for the benefit of each of the parcels and their owners and the public". The project attorneys recommended this wording to accommodate the public, and WHEREAS, this rezoning constitutes the tenth (10th) rezoning in Phase I of Lazy Y-U Ranches. Parcel 22 located directly west of this property was approved for rezoning by the Mohave County Board of Supervisors at their meeting on December 7, 1992, and WHEREAS, there is no specific Area Plan for this area, and it is not within the Building Overlay area, and WHEREAS, the applicant desires to split this thirty-nine plus (39.6) acre parcel into one nineteen plus (19+) acre parcel, one eleven plus (11+) acre parcel and one seven plus (7+) acre parcel, and WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on January 13, 1993, the Commission recommended APPROVAL of the requested rezoning with applicant understanding and accepting the following conditions: .. . . The eastern parcel be Residential/Seven Acre southwestern parcel be Residential/Eleven Acre northwestern parcel be Residential/Nineteen Acre zoned A-R/7A (Agricultural Minimum Lot Size), the zoned A-R/1lA (Agricultural Minimum Lot Size), and the zoned A-R/19A (Agricultural Minimum Lot Size). 2. Submittal and recordation of a Parcel plat prepared in accordance with Article 3.16 of the Mohave County Subdivision Regulations. 3. The establishment of a minimum lot size based on the size of parcels per the recorded Parcel Plat. 4. Each parcel shall have legal access. 5. The Parcel Plat shall show any surface drainage or FEMA flood zones. 6. As a condition to this rezone, the corrected street names and signs need to be in place prior to the Board of Supervisors approval. 7. No building/zoning permits shall be issued until after Parcel Plat recordation. 8. That appropriate zoning/building/environmental permits be obtained. 9. The rezone shall not become effective for at least thirty (30) days after final approval of the change in classification by the Board of Supervisors. Being March 3, 1993, as per ARS 11-829E. 10. If these conditions are not met within one (1) year this approval shall be void, I f at the expiration of this period the property has not been improved for the use for which it was conditionally approved, the Board after notification by registered mail to the owner and applicant who requested the rezoning shall schedule a public hearing to grant an extension, determine compliance with the schedule for development or cause the property to revert to its former zoning classification in accordance with Arizona Revised Statutes Annotated, Title 11, Chapter 6, 11-832. 11. The eastern parcel shall meet or exceed seven (7) acres, exclusive of road easements or rights-of-way;the . . . PAGE + OF 4 BK 2171 PG 298 (FEEt93- 6152) , .- Resolution No. 93-43 Page 4 southwest parcel shall meet or exceed eleven (11) acres, exclusive of road easements or rights-of-way; and the northwest parcel shall meet or exceed nineteen (19) acres, exclusive of road easements or rights-of- way. At the request of Roqer Esquerra, cartoqrapher, staff recommends Final Plat and Parcel Plat boundaries be a triple wide line as the 1/8" blue line border obscures dimensions. WHEREAS, the notice of hearing was published in the Kingman Standard, a newspaper of general circulation in Kingman, Mohave County, Arizona, on January 16, 1993, and posted January 14, 1993 as required by Arizona Revised Statutes, and the Mohave County Zoning Regulations.
