A RESOLUTION SETTING FORTH THE REZONING OF PARCEL 6S-A, SECTION
7, TOWNSHIP 23 NORTH, RANGE 16 WEST, FROM: A-R/10A (AGRICULTURAL
RESIDENTIAL/TEN ACRE MINIMUM LOT SIZE) ZONE, PROPOSED TO BE: A-
R/5A (AGRICULTURAL RESIDENTIAL/FIVE ACRE MINIMUM LOT SIZE) ZONE,
LOCATED 2,800 FEET WEST OF STOCKTON HILL ROAD AND NORTH OF AN
UNNAMED 100 FOOT ROAD EASEMENT, LOCATED IN THE LONG MOUNTAIN
PORTION OF THE MOHAVE COUNTY GENERAL AREA.
WHEREAS, at the regular meeting of the Mohave County Board
of Supervisors held on February 1, 1993, a public hearing was
conducted to determine whether approval should be granted to
Joseph Thelen of San Diego, California for a zone change from the
existing A-R/I0A (Agricultural Residential/Ten Acre Minimum Lot
Size) zone to A-R/5A (Agricultural Residential/Five Acre Minimum
Lot Size) zone, located 2,800 feet west of Stockton Hill Road and
north of an unnamed 100 foot road easement, located in the Long
Mountain portion of the Mohave County General area, and
WHEREAS, Section 7 is approximately eight (8) miles North of
the Butler area and directly east of Stockton Hill Road. The
property is accessed from Stockton Hill Road via an unnamed dirt
road one-quarter (.25) miles north of Calle Salinas Road), east
approximately one-half (.5) mile to the southwest corner of the
subject property. The property can also be accessed from
Stockton Hill Road via Calle Salinas Road east approximately
three-quarter (.75) mile to

an unnamed dirt roadway easement
thence north approximately one-

WHEREAS, the terrain on this site is primarily mountainous,
limiting the possible building sites, and

WHEREAS, review of floodplain map #040058-2155B indicates
this Parcel to be clear of a designated floodplain. The property
is currently vacant. Surrounding land uses consist primarily of
vacant land, with most of the area used as grazing land. The
property and immediate surrounding area is currently not serviced
by electric power or other public utilities, and
WHEREAS, the applicant desires to split this fifteen plus
(15+) acre parcel into three five plus (5+) acre parcels, and
WHEREAS, this rezone is in compliance with the Long Mountain
Area Plan.
WHEREAS, at the public hearing before the Mohave County
Planning and zoning Commission on January 13, 1993, the
Commission recommended APPROVAL of the requested rezoning with
applicant understanding and accepting the following conditions:
1. The three (3) parcels be zoned A-R/5A (Agricul tural-
Residential/Five Acre Minimum Lot Size).
2. Submittal and recordation of a Parcel Plat prepared in
accordance with Article 3.16 of the Mohave County
Subdivision Regulations.
3. The establishment of a minimum lot size based on the
size of parcels per the recorded Parcel Plat.
4. Each parcel shall have legal access.
5. The three (3) parcels shall meet or exceed five (5)
acres exclusive of road easements or rights-of-way.
6. The Parcel plat shall show any surface drainage or FEMA
flood zones.
7. No building/zoning permits shall be issued until after
Parcel Plat recordation.
8. That appropriate zoning/building/environmental permits
be obtained.

9. The Board of Supervisors accept the abandonment of the
existing fifty (50') foot roadway and utility easement
on the south s ide of Parcel 6 5-A3 . In addition the
granting of a thirty (30') foot roadway and utility
easement on the east side of Parcels 65-A2 and 65-A3
and an eight (8') foot Public Utility Easement (PUE)
along the southern boundary of Parcel 65-A3. This shall
be approved through the recording of the resolution
authorizing this zone change, and that the
dedication/ granting statement and dedication/granting
be shown on the Parcel Plat.
10. The rezone shall not become effective for at least
thirty (30) days after final approval of the change in
classification by the Board of Supervisors. Being
March 3, 1993, as per ARS 11-829E.
11. I f these conditions are not met wi thin one (1) year
this approval shall be void. I f at the expiration of
this period the property has not been improved for the
use for which it was conditionally approved, the Board
after notification by registered mail to the owner and
applicant who requested the rezoning shall schedule a
public hearing to grant an extension, determine
compliance with the schedule for development or cause
the property to revert to its former zoning
classification in accordance with Arizona Revised
Statutes Annotated, Title II, Chapter 6, 11-832.
At the request of Roqer Esquerra, cartoqrapher, staff recommends
Final Plat and Parcel plat boundaries be a triple wide line as
the 1/8" blue line border obscures dimensions.
WHEREAS, the notice of hearing was published in the Kingman
Standard, a newspaper of general circulation in Kingman, Mohave
County, Arizona, on January 16, 1993, and posted January 15, 1993
as required by Arizona Revised Statutes, and the Mohave County
Zoning Regulations.
NOW THEREFORE BE IT RESOLVED, that the Board
of Supervisors,
1993 approved
Mohave County
at their regular meeting on Monday February 1,
this change of zoning as recommended by the
Planning and Zoning Commission and outlined herein.
