PAGE 1 OF ~ ~ 1 ~... ,,:: .!Jj MOHAVE COUNTY BOARD OF SUPERVISORS ~>;, . ~~, RECORDIHG FEE 0.00 He .'v<..liE~ RESOLUTION NO. 93-41 A RESOLUTION SETTING FORTH THE REZONING OF PARCEL 195-A, SECTION 25, TOWNSHIP 23 NORTH, RANGE 17 WEST, FROM: A-R/IOA (AGRICULTURAL RESIDENTIAL/TEN ACRE MINIMUM LOT SIZE) ZONE, PROPOSED TO BE: A- R/5A (AGRICULTURAL RESIDENTIAL/FIVE ACRE MINIMUM LOT SIZE) ZONE, LOCATED 2,000 FEET WEST OF STOCKTON HILL ROAD AND NORTH OF WILKS RANCH ROAD, LOCATED IN THE LONG MOUNTAIN PORTION OF THE MOHAVE COUNTY GENERAL AREA, MOHAVE COUNTY, ARIZONA WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on February 1, 1993, a public hearing was conducted to determine whether approval should be granted to Tillie Eaquibel of San Diego, California for a zone change from the existing A-R/I0A (Agricultural Residential/Ten Acre Minimum Lot Size) zone to A-R/5A (Agricultural Residential/Five Acre Minimum Lot Size) zone, located 2000 feet west of Stockton Hill Road and north of Wilks Ranch Road, located in the Long Mountain portion of the Mohave County General area, and WHEREAS, Section 25 is located approximately five (5) miles north of the Butler area with Stockton Hill Road traversing the northwest corner of the section. The property is accessed from Stockton Hill Road via Calle Charcas Road (future Wilks Ranch Road) east approximately sixteen-hundred (1600') feet to the southwest corner of the subject property, and WHEREAS, review of floodplain map #040058-2155B indicates this Parcel to be clear of a designated floodplain. The property is currently vacant, and the terrain is primarily flat with a small wash running through the northern portion of the property. Surrounding land uses consist primarily of vacant land. Electric power is in close proximity to this parcel, and WHEREAS, the applicant desires to split this fifteen plus (15.05) acre parcel into three five plus (5+) acre parcels, and WHEREAS, this rezoning is in compliance with the Long Mountain Area Plan, and WHEREAS, at the Planning and Zoning Commission recommended public hearing before the Mohave County Commission on January 13, 1993, the APPROVAL of the requested rezoning with applicant understanding and accepting the following conditions: 1. The three (3) parcels be zoned A-R/5A (Agricultural- Residential/Five Acre Minimum Lot Size). 2. Submittal and recordation of a Parcel Plat prepared in accordance with Article 3.16 of the Mohave County Subdivision Regulations. 3. The establishment of a minimum lot size based on the size of parcels per the recorded Parcel Plat. 4. Each parcel shall have legal access, 5. The three (3) parcels shall meet or exceed five (5) acres exclusive of road easements or rights-of-way. 6. The Parcel Plat shall show any surface drainage or FEMA flood zones. 7. No building/zoning permits shall be issued until after Parcel Plat recordation. 8. The Board of Supervisors accept the abandonment of the existing fifty (50') foot roadway easement along the eastern, southern and western boundaries of the subject property to be replaced by the dedication of a thirty (30') foot road right-of-way along the east boundary, and a thirty-fiv8 (35') foot road right-of-way dedication along the southern and western boundaries of . . Also the dedication of twenty (20') foot radius curves at the southeast and southwest corners of the subject property. In addition the granting of and eight (8') foot public utility easement along the southern boundary of this parcel. This shall be approved through the recording of the resolution authorizing this zone change, and that the dedication- granting statement and dedication-granting be shown on the Parcel Plat. 9. That appropriate zoning/building/environmental permits be obtained. 10. The rezone shall not become effective for at least thirty (30) days after final approval of the change in classification by the Board of Supervisors. Being March 3, 1993, as per ARS 11-829E. 11. I f these conditions are not met within one (1) year this approval shall be void. I f at the expiration of this period the property has not been improved for the use for which it was conditionally approved, the Board after notification by registered mail to the owner and applicant who requested the rezoning shal1 schedule a public hearing to grant an extension, determine compliance with the schedule for development or cause the property to revert to its former zoning classification in accordance with Arizona Revised Statutes Annotated, Title 11, Chapter 6, 11-832. At the request of Roqer Esquerra, cartoqrapher, staff recommends Final Plat and Parcel Plat boundaries be a triple wide line as the 1/8" blue line border obscures dimensions. WHEREAS, the notice of hearing was published in the Kingman Standard, a newspaper of general circulation in Kingman, Mohave County, Arizona, on January 16, 1993, and posted on January 15, 1993 as required by Arizona Revised Statutes, and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday February 1, 1993 approved . .
