RESOLUTION 93-36
A RESOLUTION SETTING FORTH AN EXTENSION OF TIME FOR A ZONING USE
PERMIT (ZUP) FOR THE ESTABLISHMENT OF A KENNEL ON THE E~ OF THE
NORTHERLY 770 FEET OF PARCEL 302, SECTION 30, TOWNSHIP 21 NORTH,
RANGE 18 WEST, LOCATED IN THE GOLDEN VALLEY AREA, MOHAVE COUNTY,
ARIZONA
WHEREAS, at the regular meeting of the Mohave County Board
of Supervisors held on February 1, 1993, a public hearing was
conducted to determine whether approval should be granted to
William Shuell of Phoenix, Arizona, for a Zoning Use Permit (ZUP)
for the establishment of a kennel in an A-R (Agricultural-
Residential) zone, of the El/2 of the northerly 770 feet of Parcel
302, Section 30, Township 21 North, Range 18 West, occupying the
southwest corner of Dubin Drive and Colorado Road, located in the
Golden Valley area, and
WHEREAS, Section 30 is located approximately six (6) miles
west of the Highway 68/93 junction and approximately two and one-
half (2.5) miles south of Highway 68. Parcel 302 has frontage on
the west side of Colorado Road and is bounded on the north by
Dubin Drive. The property occupies the northeast quarter of
Parcel 302, and
WHEREAS, review of floodplain map #040058-2325B indicates
this area is clear of flooding potential. Surrounding land uses
consist of mostly vacant land. The applicant wishes to establish
a dog kennel for boarding and raising greyhounds in conjunction
with a home on this ten (10) acre parcel, and
WHEREAS, the applicant hnd indicated she is working to meet
the requirements of the original approval and desires additional

time to work with requisite agencies to meet their requirements.
Mohave County Environmental Health Division indicated they have
been in contact with the applicant.
WHEREAS, the
first extension of
Resolution 91-322.

WHEREAS, the applicant has indicated she has a septic

WHEREAS, at the public hearing before the Mohave County
Planning and zoning Commission on January 13, 1993, the
Commission recommended APPROVAL of the requested extension of
time wi th applicant understanding and accepting the following
conditions:
1. Continued compliance with conditions of Resolution No.
90-279.
2. provision of a site plan in accordance with Section
27.P to accompany any building permits.
3. This extension of time be granted for this use until
October 1, 1993.
4, If construction or use has not commenced within one (1)
year of Board approval of the Zoning Use Permit or if
the use has been discontinued for six (6) months, then
approval shall terminate at that date.

Supervisors, if in the opinion of the Commission and
Board the continued use of the property would be
contrary to the public health, safety, and welfare.
6. If these conditions are not met within one (1) year
this approval shall be void. If at the expiration of
this period the property has not been improved for the
use for which it was conditionally approved, the Board
after notification by registered mail to the owner and
applicant who requested the ZUP shall schedule a public
hearing to grant an extension, determine compliance
with the schedule for development or cause the property
to revert to its former zoning classification in
accordance with Arizona Revised Statutes Annotated,
Title 11, Chapter 6, 11-832.
WHEREAS, the notice of hearing was published in the Kingman
Standard, a newspaper of general circulation in Kingman, Mohave
County, Arizona, on January 16, 1993, as required by Arizona
Revised Statutes, and the Mohave County Zoning Regulations.
NOW THEREFORE BE IT RESOLVED, that the Board
at their regular meeting on Monday February I,
this change of zoning as recommended by the
Planning and Zoning Commission and outlined herein.
