'-' 7 MICROFILMED RESOLUTION 93-33 A RESOLUTION SETTING FORTH THE REZONING OF LOT 1947, MEADVIEW UNIT 5, SECTION 15, TOWNSHIP 30 NORTH, RANGE 17 WEST, FROM: C-2 (GENERAL COMMERCIAL) ZONE, PROPOSED TO BE: C-M (COMMERCIAL MANUFACTURING) ZONE, LOCATED 1,000 FEET SOUTH OF NEWPORT DRIVE BETWEEN GREGG DRIVE AND GREGG PLAZA, LOCATED IN THE MEADVIEW AREA, MOHAVE COUNTY, ARIZONA WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on February 1, 1993, a public hearing was conducted to determine whether approval should be granted to Rodney and Donna Honberger of Meadview, Arizona, for a zone change from the existing C-2 (General Commercial) zone to C-M (Commercial Manufacturing) zone, located 1,000 feet south of Newport Drive Between Gregg Drive and Gregg Plaza, located in the Meadview area, and WHEREAS, Township 30 North, Range 17 West is located approximately thirty-eight (38) miles northeast of the pierce Ferry & Highway 93 junction. Meadview Unit 5 is located approximately one (1) mile south of "central" Meadview. Access to the site from Pierce Ferry Road is via Newport Drive west approximately three hundred (300') feet to Gregg Drive thence south approximately one thousand (~,OOO') feet on the west side of the street. The junction of Pierce Ferry Road and Newport Drive is approximately one mile south of the intersection of Pierce Ferry Road and Meadview Boulevard, with Meadview Boulevard being the primary access to "central" Meadview. A street named Gregg Plaza forms a loop on Gregg Drive which encircles this lot and two other lots, Newport Drive is forty (40') feet wide and bladed. Gregg Drive and Gregg Plaza are thirty (30') feet wide and rough bladed, and . . PAGE 2 OF 4 BK 2171 PG 261 (FEEt93- 61+2) Resolution No. 93-33 Page 2 WHEREAS, review of floodplain map #040058-1275B indicates this area to be clear of a designated floodplain, The site is currently vacant. Surrounding uses consist of USA land to the east across Gregg Drive, with the remainder being vacant, commercially zoned land. Review of land use maps indicate the nearest residences are approximately one thousand (1,000') feet to the north and south. Field inspection indicates other scattered residences to the west. This particular lot occupies a knoll-like site and has good visibility. The lot slopes up to the west so that Gregg Plaza is higher in elevation than Gregg Drive, and ';...;-,,~; WHEREAS, the applicant desires to rezone this lot to C-M (Commercial-Manufacturing) in order to establish a solid waste disposal transfer station. The following is a synopsis of the operation as related to staff by the applicant: Trucks would collect the waste from individual sites, deliver it .to this site; The waste would then be transferred into larger containers which would then be hauled to the nearest available landfill, in this case being the Cerbat Landfill; The larger container would have a compactor attached to compress the materials; The transfer would take place entirely within an enclosed building. The only outside activity would be the parking of the trucks used in the operation. This procedure would be similar in nature to warehousing which is permitted in C-M zoning, and WHEREAS, there is no area plan for this portion of the County. WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on January 13, 1993, the Commission recommended APPROVAL of the requested Zoning Use Permit contingent upon the following conditions: . . PAGE 3 OF 4 BK 2171 PG 262 (FEE~~3- 6142) Resolution No, 93-33 Page 3 1. The applicant comply with all applicable provisions of Sections 25, 26, 27, and 31 of the Mohave County Zoning Regulations. Compliance with Section 27.P (Site Plan Requirements) and Ordinance 87-1 (Dark Sky Ordinance) is also required. 2. That appropriate zoning/building/environmental permits be obtained. 3. That access be restricted to Gregg Drive. 4. A buffer in the form of an eight (8') foot view obscuring fence be placed around the perimeter of the property except approved access points. No public access points to be provided on Gregg Plaza. 5, Applicant submit proof of hookup to an approved sewage treatment facility and approved water system, 6. Adequate parking shall be implemented in accordance with the Mohave County Zoning Ordinance. 7. Newport Drive and Gregg Drive shall be improved from Piece Ferry Road up to and contiguous to the site. The road improvement shall be to Standard #161 (unpaved standard) or better. If Gregg Plaza is used for this operation it also shall be improved up to and contiguous to the site. The improvement shall be to the same standard. 8. The applicant shall pave all driveway access and parking in accordance with Mohave County Standard Specification #171, or better. 9. Any remainder of the lot not used for development shall be maintained free of debris and the vegetation controlled to mlnlmize potential fire hazards. Grasses /weeds shall be cut regularly to assure less than eight (8 ") inches of growth. I f crushed rock is used then the soil shall be maintained in a weed free condition. 10. The rezone shall not become effective for at least thirty (30) days after final approval of the change in classification by the Board of Supervisors. Being March 3, 1993 as per ARS 11-829E. 11. I f these conditions are not met within one (1) year this approval shall be void. If at the expiration of . . PAGE 4 OF 4- BK 2171 PG 263 (FEE~93- 6142) Resolution No. 93-33 Page 4 this period the property has not been improved for the use for which it was conditionally approved, the Board after notification by registered mail to the owner and applicant who requested the rezoning shall schedule a public hearing to grant an extension, determine compliance with the schedule for development or cause the property to revert to its former zoning classification in accordance with Arizona Revised Statutes Annotated, Title 11, Chapter 6, 11-832. WHEREAS, the notice of hearing was published in the Kingman Standard, a newspaper of general circulation in Kingman, Mohave County, Arizona, on January 16, 1993, and posted January 15, 1993 as required by Arizona Revised Statutes, and the Mohave County Zoning Regulations.
