PAGE 1 OF 4 HOHAVE COUNTY BOARD OF SUPERVISORS RECORDING FEE 0.00 He ~\)~~ RESOLUTION NO. 93-31 A RESOLUTION SETTING FORTH APPROVAL OF A ZONING USE PERMIT FOR THE ESTABLISHMENT OF A RETAIL PLANT NURSERY IN AN A-R (AGRICULTURAL RESIDENTIAL) ZONE LOCATED IN THE WI/2 E1/2 LOT 16, BLOCK A, FORT MOHAVE MESA RANCHES, SECTION 26, TOWNSHIP 19 NORTH, RANGE 22 WEST, LOCATED IN THE SOUTH MOHAVE VALLEY AREA, MOHAVE COUNTY, ARIZONA WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on February 1, 1993, a public hearing was conducted to determine whether approval should be granted to Mohave Development, Inc. of Westlake Village, California, for a Zoning Use Permit (ZUP) for the establishment of a retail plant nursery in an A-R (Agricultural-Residential) zone, located in the Wl/2 El/2 Lot 16, Block A, Fort Mohave Mesa Ranches, Section 26, Township 19 North, Range 22 West, located one-hundred and sixty (160') west of Calle Valle Vista an north of Joy Lane, Located in the South Mohave Valley area, and WHEREAS, Section 26 is located approximately three (3) miles south of Bullhead City's southernmost border and lies immediately east of Highway 95. The subject property is accessed from Highway 95 via Joy Lane east approximately one quarter (.25) mile to the site which is approximately one hundred sixty (160') feet west of the northwest corner of Joy Lane and Calle Valle Vista, and WHEREAS, review of floodplain map #040058-2445C indicates this area to be within a designated floodplain. The site is currently vacant. Surrounding land uses consist of an existing nursery to the east and southeast, an R-V park to the southwest and vacant land to the north. This site is part of a proposed commercial subdivision, Joy Lane Plaza, Tract 4098. The applicant intends to establish additional inventory to the existing retail plant nursery to the east, The applicant has not disclosed whether this is a temporary use or if it will be incorporated into the proposed development. However, it appears that the proposed use is of a temporary nature, and WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on January 13, 1993, the Commission recommended APPROVAL of the requested zoning Use Permit contingent upon the following conditions: 1. The applicant comply with all applicable provisions of Sections 25, 26, 27, and 31 of the Mohave County Zoning Regulations. Compliance with Section 27. P (Site Plan Requirements) and Ordinance 87-1 (Dark Sky Ordinance) is also required. 2. The letter of August 8, 1992 regarding status of the adjoining nursery use and the status of Joy Lane Plaza subdivision shall be considered to apply to this site. 3. That appropriate zoning/building/environmental permits be obtained. 4. That access be restricted to Joy Lane, 5. In view of the residential development in this area that a buffer in the form of a six (6') view obscuring fence be placed on the north perimeter of this site. 6. Applicant submit proof of hookup to an approved sewage treatment facility and community water system. 7 . Adequate parking shall be implemented in accordance with the Mohave County Zoning Ordinance, 8. The applicant shall pave all driveway access and parking in accordance with Mohave County Standard Specification #171, or better. . . Any remainder of the lot not used for development shall be maintained free of debris and the vegetation controlled to minimize potential fire hazards. Grasses /weeds shall be cut regularly to assure less than eight (8") inches of growth. If crushed rock is used then the soil shall be maintained in a weed free condition. 10. Any permitted open lot storage must be related to or be an accessory to the primary business. The storage area shall be covered with a dust-proof surface. If crushed rock is used for the dust-proof surface then the soil shall be maintained in a weed free condition. Any open lot storage shall be completely enclosed by a view- obscuring fence which extends two (2') feet above the highest item to be stored, with a minimum of six (6') feet and a maximum of eight (8') feet in height. Fencing shall display no advertising. 11. If construction or use has not commenced within one (1) year of Board approval of the Zoning Use Permit or if the use has been discontinued for six (6) months, then approval shall terminate at that date. 12. This Zoning Use Permit is subject to revocation upon sixty (60) days notification by the Board of Supervisors, if in the opinion of the Commission and Board the continued use of the property would be contrary to the public health, safety, and welfare. 13. If these conditions are not met within one (1) year this approval shall be void. If at the expiration of this period the property has not been improved for the use for which it was conditionally approved, the Board after notification by registered mail to the owner and applicant who requested the ZUP shall schedule a public hearing to grant an extension, determine compliance with the schedule for development or cause the property to revert to its former zoning classification in accordance with Arizona Revised Statutes Annotated, Title 11, Chapter 6, 11-832. WHEREAS, the notice of hearing was published in the Kingman Standard, a newspaper of general circulation in Kingman, Mohave County, Arizona, on January 16, 1993 and posted on January 14, 1993 as required by Arizona Revised Statutes, and the Mohave County zoning Regulations. . . PAGE 4 OF' ~y\ '2.171. ~G I '2~; \~'E.~""'a- ~1.'\'O" Resolution No. 93-31 Page 4 NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday February 1, 1993 approved the granting of this extension of time for a conditional Zone Change as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
