IND. 1 MICROALMED ,a RESOLUTION NO. 93-28 RESOLUTION SETTING FORTH DENIAL OF A REQUEST FOR AN EXTENSION OF TIME FOR THE APPROVED PRELIMINARY SUBDIVISION PLAN FOR PERRY MEADOWS, TRACT 4073, BEING A SUBDIVISION OF A PORTION OF SECTION 13, TOWNSHIP 18 NORTH, RANGE 22 WEST, LOCATED IN THE SOUTH MOHAVE VALLEY AREA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on February 1, 1993, a public hearing was conducted to determine whether approval should be granted to Goldrush Bullhead City Associates Ltd., and Boom Ltd., of San Diego, California an extension of time for the approved preliminary plan of Perry Meadows, Tract 4073, being.a portion of Section 13, Township 18 North, Range 22 West, located in the South Mohave Valley area, and WHEREAS, the owner/developer of this tract is Goldrush Bullhead City Associates Ltd., and Boom, Inc., a General Partner in Goldrush Bullhead City Associates Ltd., of San Diego, California. The engineer responsible for the preparation of the drainage report and design of the approved preliminary plan for this subdivision was T.A.J. Gookin, P.E. and L.S. Gookin Engineers, Scottsdale Arizona. The sketch plan was prepared and the preliminary plan submittal was made by N.J. Devlin on behalf of the owner/developer and Gookin Engineers and, . . PAGE 2 OF BK 21ii PG ;) 24~ (~EE:93- 6137) Resolution No. 93-28 Page 2 WHEREAS, the preliminary plan depicts three hundred twenty (320) acres subdivided into five hundred fifty-six (556) single family residential lots and eighteen (18) parcels. The lots range in size from eleven thousand nine hundred (11,600) square foot to fifteen thousand (15,000) square feet and, WHEREAS, the preliminary plan for this tract was approved by the Mohave County Board of Supervisors on May I, 1989, via P&ZC Resolution 89-57. Article 3.10-1 states, "Upon application to the commission and prior to the expiration, of the time limit, extensions in increments of one (I) year may be granted by the Board if the subdivider is actively processing the Final Plat. . ~...~ If such action is not taken than all proceedings re~ating to the plat shall be terminated.", and WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on January 13, 1993, the Commission recommended DENIAL of the requested extension of time with the applicant understanding and accepting the following conditions: 1. It has been one (1) year and seven (7) months since the due date for this extension. The extension of time was due on May 1, 1991. This would be, in effect, the first extension of time and would only carry this project to May 1, 1992. A separate request, with appropriate fees, is here to bring this project to May 1, 1993. At that time a third extension would be necessary, if the plat was still in process and not recorded. . . PAGE 3 OF J BK 2171 PG 245 CFEE;93- 6137) Resolution No. 93-28 Page 3 2. A portion of the property is under new ownership. 3. Mr. Cairncross, a principal owner, in a telephone conservation with staff stated that they are no longer represented by an engineer but would hire an engineer when they proceed with project. 4. Mr, Tony Trujillo, owner of one-half of the property, contacted this office on December 16, 1992, with regard to this extension. In this conversation, he stated that he is not interested in extending the approved Preliminary Plan for the South ~ of the East ~ of Section 13, as he has an alternate use for the property. 5. Article 3.10-1, in staffs opinion, is satisfied. There is no Engineer of Record, no movement since expiration of May 1, 1991. not being therefore WHEREAS, the notice of hearing was published in the Kingman Standard, a newspaper of general circulation in Kingman, Mohave County, Arizona, on January 16, 1993 and as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFORE BE IT FURTHER RESOLVED, that the Board of Supervisors, at their regular meeting on Monday February 1, 1993 denied this extension of time for the preliminary plan of Perry Meadows, Tract 4073 as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
