RESOLUTION NO. 93-20
A RESOLUTION SETTING FORTH THE REZONING OF PARCEL 29-6, SECTION
29, TOWNSHIP 24 NORTH, RANGE 14 WEST, FROM: A-R/36A (AGRICULTURAL
RESIDENTIAL/THIRTY-SIX ACRE MINIMUM LOT SIZE) ZONE, PROPOSED TO
BE: A-R/I0A (AGRICULTURAL RESIDENTIAL/TEN ACRE MINIMUM LOT SIZE)
ZONE, LOCATED IN THE MUSIC MOUNTAIN PORTION OF THE MOHAVE COUNTY
GENERAL AREA, MOHAVE COUNTY, ARIZONA
WHEREAS, at the regular meeting of the Mohave County Board
of Supervisors held on January 4, 1993, a public hearing was
conducted to determine whether approval should be granted to
Roger Lang, and represented by Richard F. Sibbi tt, of Irvine,
California, for a zone change from the existing A-R/36A
(Agricultural Residential/Thirty-six Acre Minimum Lot Size) zone,
to A-R/I0A (Agricultural Residential/Ten Acre Minimum Lot Size)
zone, located in the Music Mountain portion of the Mohave County
General area, and
WHEREAS, the subject property is located approximately
twenty miles (20) northeast of the City of Kingman and is
approximately one and one-quarter (1.25) miles north of Highway
66. This property is accessed from Highway 66 via Antares Road
north approximately one (1) mile, thence east approximately
three-quarters (.75) mile on California Drive to Bach Road,
thence north approximately one-quarter (.25) mile to the
southwest corner of the subject property, and

WHEREAS, review of floodplain map #040058-2025B indicates
this area to be clear of a designated floodplain. The property is
currently vacant and bordered on all sides by vacant land. The
applicant desires to split this thirty-nine plus (39.36) acre
parcel into two ten (10) acre parcels and one (1) nineteen (19+)
acre parcel, and
WHEREAS, at the public hearing before the Mohave County
Planning and Zoning Commission on December 9,
1992, the
Commission recommended a conditional APPROVAL of the requested
rezoning with the applicant understanding and accepting the

following conditions:
1. The two (2) western parcels be zoned A-R/ lOA
(Agricultural-Residential/Ten Acre Minimum Lot Size),
and the eastern parcel be zoned A-R/17A (Agricultural-
Residential/Seventeen Acre Minimum Lot Size) zone.
2. Submittal and recordation of a Parcel Plat prepared in
accordance with Article 3.16 of the Mohave County
Subdivision Regulations.
3. The establishment of a minimum lot size based on the
size of parcels per the recorded Parcel Plat.
4. Each parcel shall have legal access.
5. The two (2) western parcels shall meet or exceed ten
(10) acres, and the eastern parcel shall meet or exceed
seventeen (17) acres exclusive of road easements or
rights-of-way-
6. The parcel plat shall show any surface drainage or FEMA
flood zones.

7. The Board of Supervisors accept the granting of a
thirty (30~) foot ingress/egress and public utility
easement along the boundary of Parcel 29-6B and Parcel
29-6C. This shall be approved through the rezoning of
the resolution authorizing this zone change, and that
the dedication/granting statement and dedication-
granting be shown of the Parcel Plat.
8. No building/zoning permits shall be issued until after
Parcel Plat recordation.
9. That appropriate zoning/building/environmental permits
be obtained.
10. The rezone shall not become effective for at least
thirty (30) days after final approval of the change in
classification by the Board of Supervisors. Being
February 3, 1993, as per ARS 11-829E.
11. I f these conditions are not met within one (1) year
this approval shall be void. If at the expiration of
this period the property has not been improved for the
use for which it was conditionally approved, the Board
after notification by registered mail to the owner and
applicant who requested the rezoning shall schedule a
public hearing to grant an extension, determine
compliance with the schedule for development or cause
the property to revert to its former zoning
classification in accordance with Arizona Revised
Statutes Annotated, Title 11, Chapter 6, 11-832.
At the request of Roqer Esquerra, cartoqrapher, the Planninq
Commission recommends Final Plat and Parcel Plat boundaries be a
triple wide line as the 1/8" blue line border obscures
dimensions.
WHEREAS, the notice of hearing was published in the Kingman
Standard, a newspaper of general circulation in the county seat,
Kingman, Mohave County, Arizona, on December 19, 1992, and posted
December 18, 1992, as required by Arizona Revised Statutes and
the Mohave County Zoning Regulations.

NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors,
at their regular meeting on Monday, January 4, 1993 approved this
change in zoning as recommended by the Mohave County Planning and
zoning Commission and outlined herein.
