A RESOLUTION SETTING FORTH THE REZONING OF A PORTION OF PARCEL
109, SECTION 19, TOWNSHIP 23 NORTH, RANGE 16 WEST, FROM: A-R/I0A
(AGRICULTURAL RESIDENTIAL/TEN ACRE MINIMUM LOT SIZE) ZONE,
PROPOSED TO BE: A-R/4A (AGRICULTURAL RESIDENTIAL/FOUR ACRE
MINIMUM LOT SIZE) ZONE, LOCATED IN THE LONG MOUNTAIN PORTION OF
THE MOHAVE COUNTY GENERAL AREA, MOHAVE COUNTY, ARIZONA
WHEREAS, at the regular meeting of the Mohave County Board
of Supervisors held on January 4, 1993, a public hearing was
conducted to determine whether approval should be granted to
Joseph and Nikki Thelen of San Diego, California, for a zone
change from the existing A-R!10A (Agricultural Residential/Ten
Acre
Minimum
Size)
to
A-R/4A
(Agricultural
Lot
zone,
Residential/Four Acre Minimum Lot Size) zone, located one
thousand (1,000') feet west of North Bank Street and north of
Calle Charcas, in the Long Mountain portion of the Mohave County
General area, and
WHEREAS, Section 19 is approximately six (6) miles north of
the Butler area and approximately one-half (.5) mile east of
Stockton Hill Road. The property is accessed from Stockton Hill
Road via Calle Charcas Avenue east approximately two (2) miles to
the southwest corner of the subject property, and

WHEREAS, review of floodplain map #040058-2155B indicates
this parcel to be clear of a designated floodplain. The property
is currently vacant. Surrounding land uses consist primarily of
vacant land with a few scattered residences. The applicant
desires to split this twelve (12+) acre parcel into three (4+)
acre parcels, and
WHEREAS, this rezone request conforms to the Long Mountain
Area Plan, and
WHEREAS, at the public hearing before the Mohave County
Planning and Zoning Commission on December 9,
1992,
the
Commission recommended a conditional APPROVAL of the requested
rezoning with the applicant understanding and accepting the
following conditions:
1. The three (3) parcels be zoned A-R/4A (Agricultural-
Residential/Four Acre Minimum Lot Size).
2. Submittal and recordation of a Parcel Plat prepared in
accordance with Article 3.16 of the Mohave County
Subdivision Regulations.
3. The establishment of a minimum lot size based on the
size of parcels per the recorded Parcel Plat.
4. Each parcel shall have legal access.
5. The three (3) parcels shall meet or exceed four (4)
acres exclusive of road easements or rights-of-way.
6. The parcel plat shall show any surface drainage or FEMA
flood zones.
7. No building/zoning permits shall be issued until after
Parcel Plat recordation.

8. That appropriate zoning/building/environmental permits
be obtained.
9. The Board of Supervisors accept the dedication of a
twenty-five (25') foot road right-of-way along the west
boundary of the subject property. Also the dedication
of twenty (20') foot radius curve at the southwest
corner of the subject property. In addition the
granting of and eight (8') foot public utility easement
along the west boundaries of this parcel. This shall be
approved through the recording of the resolution
authorizing this zone change, and that the
dedication/granting statement and dedication/granting
be shown on the Parcel Plat.
10. The rezone shall not become effective for at least
thirty (30) days after final approval of the change in
classification by the Board of Supervisors. Being
February 3, 1993, as per ARS 11-829E.
11. I f these conditions are not met within one (1) year
this approval shall be void. If at the expiration of
this period the property has not been improved for the
use for which it was conditionally approved, the Board
after notification by registered mail to the owner and
applicant who requested the rezoning shall schedule a
public hearing to grant an extension, determine
compliance with the schedule for development or cause
the property to revert to its former zoning
classification in accordance with Arizona Revised
Statutes Annotated, Title 11, Chapter 6, 11-832.
At the request of Roqer Esquerra, cartoqrapher, the Planninq
Commission recommends Final Plat and Parcel Plat boundaries be a
triple wide line as the 1/8" blue line border obscures
dimensions.
WHEREAS, the notice of hearing was published in the Kingman
Standard, a newspaper of general circulation in the county seat,
Kingman, Mohave County, Arizona, on December 19, 1992, and posted
December 18, 1992, as required by Arizona Revised Statutes and
the Mohave County Zoning Regulations.

NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors,
at their regular meeting on Monday, January 4, 1993 approved this
change in zoning as recommended by the Mohave County Planning and
Zoning Commission and outlined herein.
