A RESOLUTION SETTING FORTH AN AMENDMENT TO THE ZONING ORDINANCE
CHANGING CERTAIN PROPERTY HEREIN DESCRIBED AS: REZONING OF A
PORTION OF THE NW~ AND THE S~ SECTION 4, A PORTION OF THE SE~
SECTION 5, A PORTION OF THE NE~ AND S~ SECTION 8, AND ALL OF
SECTION 9, TOWNSHIP 20 NORTH, RANGE 17 WEST, BEING A PORTION OF
THE LAND IDENTIFIED IN THE McCONNICO AREA PLAN AS 3A (INDUSTRIAL
POTENTIAL), FROM: "A" (GENERAL) AND A-R (AGRICULTURAL
RESIDENTIAL) ZONE, PROPOSED TO BE: M-X (HEAVY MANUFACTURING)
ZONE, LOCATED IN THE McCONNICO AREA, MOHAVE COUNTY, ARIZONA
WHEREAS, at the regular meeting of the Mohave County Board
of Supervisors held on January 4, 1993, a public hearing was
conducted to determine whether approval should be granted for an
amendment to the Zoning Ordinance changing certain property
herein described as: REZONING of a portion of the NWl:!: and S~
Section 4, a portion of the SEl:!: Section 5, a portion of the NEl:!:
and S~ Section 8, and all of Section 9, Township 20 North, Range
17 West, being a portion of the land identified in the McConnico
Area Plan as 3A (Industrial Potential) from the existing "A"
(General) and A-R (Agricultural Residential) zones, to M-X (Heavy
Manufacturing) zone, located in the McConnico area, and
WHEREAS, the subject property is accessed at several
controlled access points or via at-grade crossings of the Santa
Fe Railroad via easements. To arrive at the site, you may exit
Interstate 40 at the east or west off-ramp of the McConnico Exit,
or via old Route 66 from Kingman, and

WHEREAS, the Planning and Zoning Commission, per their
authority [ARS 11-829.D], "D. The planning commission may on its
own motion propose an amendment to the zoning ordinance and may,
after holding a public hearing as required by this chapter,
transmit the proposal to the board which shall thereupon proceed
as set forth in this chapter for any other amendment", and
WHEREAS, the Planning Commission with this action is
amending only the underlying zoning to M-X (Heavy Manufacturing)
and NOT approving a specific use of the property in question, and
WHEREAS, by Mohave County Ordinance a building or premises
shall be used only for the authorized purposes as each individual
and subsequent use is approved by the Board of Supervisors after
recommendation by the Mohave County Planning
and
Zoning
Commission, subject to such conditions and restrictions as they
may impose, and
WHEREAS, this action sought by the Commission will not set
an authorized purpose in the area subject to the rezone action,
and
WHEREAS, the action will be beneficial in an application for
federal infrastructure funding.
Such funding is specific to
access and onsite construction of infrastructure, and

WHEREAS, at the public hearing before the Mohave County
Planning and zoning Commission on December 9,
1992,
the
Commission recommended a conditional APPROVAL of the requested
rezoning with the following conditions noted:
1. That this action is to set the zoning in the area
identified as M-X (Heavy Manufacturing) and by its
action DOES NOT establish an authorized purpose.
2. That any authorized use request follow the requirements
of Section 24 and in particular the Special provisions
set forth therein.
3. That any future industrial use of the property within
the area between the east and west bound rails of the
Santa Fe Railroad be accessed via an approved public
access that does NOT utilize an at-grade crossing as a
permanent access.
WHEREAS, the notice of hearing was published in the Kingman
Standard, a newspaper of general circulation in the county seat,
Kingman, Mohave County, Arizona, on December 19, 1992, and posted
December 18, 1992, as required by Arizona Revised Statutes and
the Mohave County Zoning Regulations.
NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors,
at their regular meeting on Monday, January 4, 1993 approved this
change in zoning as recommended by the Mohave County Planning and
outlined herein.
