A RESOLUTION SETTING FORTH THE ABANDONMENT OF CERTAIN
INGRESS /EGRESS, ROADWAY AND UTILITY EASEMENTS OF SECTION 8 AND
THE SOUTHERN MOST PORTION OF SECTION 5, TOWNSHIP 16 NORTH, RANGE
19 WEST, LOCATED IN THE FRANCONIA PORTION OF THE MOHAVE COUNTY
GENERAL AREA, MOHAVE COUNTY, ARIZONA
WHEREAS, at the regular meeting of the Mohave County Board
of Supervisors held on January 4, 1993, a public hearing was
conducted to determine whether approval should be granted to
Franconia Technologies of Tempe, Arizona, for the abandonment of
certain ingress/egress, roadway and utility easements of Section
8 and the southern most portion of Section 5, Township 16 North,
Range 19 West, located in the Franconia portion of the Mohave
County General area, and
WHEREAS, this petition for abandonment is at the request of
Stephen B. Smith (Franconia Technologies), property owner of
properties described within .the Petition of Abandonment, and
WHEREAS, the petition describes nine (9) different easements
(SEE EXHIBIT B)
across and bordering thirteen (13) different yet contiguous
properties, either owned or leased by the applicant.
Since the
County can only abandon those easements which include a Public
interest, the private easements will have to be extinguished by
separate instrument by the owner and all parties involved, and

WHEREAS, this area is a typical desert landscape.
This
parcel is be accessed by Interstate 40 at the Franconia Station
Interchange, Mile Post 13.5.
The subject property includes
Section 8 and portions of Section 5 directly north of Section 8,
Township 16 North, Range 19 West, and
WHEREAS, at the public hearing before the Mohave County
Planning and Zoning Commission on December 9,
1992,
the
Commission recommended conditional APPROVAL of the requested
abandonments with the applicants understanding and accepting the
following conditions noted:
1.
Evidence from Citizens utilities Company is willing to
extinguish their easements.
WHEREAS, the notice of hearing was published in the Kingman
Standard, a newspaper of general circulation in the county seat,
Kingman, Mohave County, Arizona, on December 19 and 26, 1992, and
posted December 18, 1992 as required by Arizona Revised Statutes,
and the Mohave County Zoning Regulations.
NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors,
on Monday, January 4, 1993 APPROVED this

WE, the undersigned resident taxpayers of Mohave County, Arizona hereby pray that the
easements as detailed below and as better described by the map attached hereto be abandoned:
1. An easement for road easement along the South boundary of Section 5, Township
16 North, Range 19 West of the Gila and Salt River Base and Meridian, Mohave
County, Arizona, and rights incident thereto. (South boundary of Parcels 8, 6, 9,
10, 17, 11).
2. An easement for road easement along the West boundary of the South half of the
Southwest quarter of the Southeast quarter of the Southeast quarter (S 1/2 SW 1/4
SE 1/4 SE 1/4) (parcel 17) of Section 5 and an easement for road easement along
the East boundary of the South half of the South half of the Southwest quarter of
the Southeast quarter (S 1/2 S 1/2 SW 1/4 SE 1/4) (parcel 10) of Section 5,
Township 16 North, Range 19 West of the Gila and Salt River Base and
Meridian, Mohave County, Arizona, and rights incident thereto.
3. An easement for road easement along the West boundary of the South half of the
South half of the Southwest quarter of the Southeast quarter (S 1/2 S 1/2 SW 1/4
SE 1/4) (parcel 10) of Section 5 and an easement for road easement along the
East boundary of the South half of the South half of the Southeast quarter of the
Southwest quarter (S 1/2 S 1/2 SE 1/4 SW 1/4) (parcel 9) of Section 5, Township
16 North, Range 19 West of the Gila and Salt River Base and Meridian, Mohave
County, Arizona, and rights incident thereto.
4. An easement for road easement along the West boundary of the South half of the
South half of the Southeast quarter of the Southwest quarter (S 1/2 S 1/2 SE 1/4
SW 1/4) (Parcel 9) of Section 5; an easement for road easement along the West
boundary of the North half of the Southwest quarter of the Southeast quarter of

9. An easement for electric power transmission line along the North-South mid-
section line of the South half (S 1/2) (parcels 4 and 5) of Section 8, Township 16
North, Range 19 West of the Gila and Salt River Base and Meridian, Mohave
County, Arizona, and rights incident thereto.
