A RESOLUTION AMENDING RESOLUTION NO. 92-352 PROVIDING FOR THE
REZONING OF S~ PARCEL 527, SECTION 6, TOWNSHIP 22 NORTH, RANGE 16
WEST, FROM: A-R/I0A (AGRICULTURAL RESIDENTIAL/TEN ACRE MINIMUM
LOT SIZE) ZONE, PROPOSED TO BE: A-R/5A (AGRICULTURAL
RESIDENTIAL/FIVE ACRE MINIMUM LOT SIZE) ZONE, LOCATED IN THE
NORTH KINGMAN PORTION OF THE MOHAVE COUNTY GENERAL AREA, MOHAVE
COUNTY, ARIZONA.
RESOLUTION NO. 93-13
WHEREAS, at the regular meeting of the Mohave County Board
of Supervisors held on January 4, 1993, a public hearing was
conducted to amend Resolution No. 92-352 which approved the
rezoning of S~ Parcel 527, Section 6, Township 22 North, Range 16
West, From: A-R/I0A (Agricultural Residential/Ten Acre Minimum
Lot Size) zone to A-R/5A (Agricultural Residential/Five Acre
Minimum Lot Size) zone, located north of Calle Castano between
Indiana and Maryland Drives in the North Kingman portion of the
Mohave County General area, and
WHEREAS, Section 6 is approximately three (3) miles north of
the Butler area and approximately two (2) miles east of Stockton
Hill Road. The subject property is accessed via Cactus Wren Road
East to Cherum Road, thence north approximately one-half (.5)
mile to Calle Castano, thence east approximately one (1) mile to
the southwest corner of the subject property, and

WHEREAS ,

the
floodplain map
#040058-2155B
indicates this parcel to be clear of a designated floodplain.
The property is currently vacant.
Surrounding land uses consist
primarily of vacant land.
The applicant desires to split this
eighteen plus (18+) acre parcel into two (2) five plus (5+) acre
parcels and one (1) eight (8) acre parcel, and
WHEREAS, on October 14, 1992, the Mohave County Planning and
Zoning Commission recommended conditional approval of the above
referenced zone change.
On November 2, 1992, the Board of
Supervisors approved the recommendation of approval from the
Planning and Zoning Commission.
During the actual survey, the

representative/surveyor discovered that the required eight (8)
acre zone designation for the western parcel cannot be met. For
this reason the owner is seeking an amendment to Resolution 92-
352 to allow for a seven (7) acre minimum lot size zone
designation for the western parcel, and
WHEREAS, the Planning and Zoning Commission at their meeting
on December 9, 1992 did recommend APPROVAL of this request to
amend Resolution No.
92-352 contingent upon the following
conditions with old language otrucJc, new language is bolded:
1. The two eastern parcels be zoned A-R/5A (Agricultural-
Residential/Five Acre Minimum Lot Size) and the \i'eotern
p~rcel bc zoned ~ R/9^ (^gricultur~l Reoidenti~l/Eight
^cro Minimum Lot Size), and the western parcel be zoned
A-R/7A (Agricultural-Residential/Seven Acre Minimum Lot

2. Submittal and recordation of a Parcel Plat prepared in
accordance with Article 3.16 of the Mohave County
Subdivision Regulations.
3. The establishment of a minimum lot size based on the
size of parcels per the recorded Parcel Plat.
4. Each parcel shall have legal access.
5. The two eastern parcels shall meet or exceed five (5)
acres and the \:eotern p.::lrcel eight .::lcreo western parcel
seven (7) acres exclusive of road easements or rights-
of-way.
6. The Parcel Plat shall show any surface drainage or FEMA
flood zones.
7. No building/zoning permits shall be issued until after
Parcel Plat recordation.
8. That appropriate zoning/building/environmental permits
be obtained.
9. The Board of Supervisors accept the abandonment of the
existing sixty foot (60') ingress/egress easement on
the western boundary and a thirty foot ingress/egress
easement on the eastern boundary of this property to be
replaced by the dedication of a thirty foot (30') road
right-of-way along the eastern and western boundaries
of the subject property. In addition the granting of
an eight foot public utility easement along the
southern boundary of the subject property. This shall
be approved through the recording of the resolution
authorizing this zone change, and that the granting
statement and dedication be shown on the Parcel Plat.
10. The abandonment shall only pertain to the
ingress/egress easements, the existing utility
easements shall remain and be indicated and referenced
to record on the parcel plat.
11. The rezone shall not become effective for at least
thirty (30) days after final approval of the change in
classification by the Board of Supervisors. Being
December 2, 1992, as per ARS 11-829E.
12. I f these conditions are not met wi thin one (1) year
this approval shall be void. If at the expiration of
this period the property has not been improved for the
use for which it was conditionally approved, the Board

after notification by registered mail to the owner and
applicant who requested the rezoning shall schedule a
public hearing to grant an extension, determine
compliance with the schedule for development or cause
the property to revert to its former zoning
classification in accordance with Arizona Revised
Statutes Annotated, Title 11, Chapter 6, 11-832.
At the request of Roqer Esquerra, cartoqrapher, the Planninq
Commission recommends Final Plat and Parcel Plat Boundaries be a
triple wide line as the 1/8" blue line border obscures
dimensions.
WHEREAS, the notice of hearing was published in the Kingman
Standard, a newspaper of general circulation in the county seat,
Kingman, Mohave County, Arizona on December 19, 1992, and posted
December 18, 1992, as required by Arizona Revised Statutes and
Mohave County Zoning Regulations.
NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors,
at their regular meeting on Monday, January 4, 1993, approved
this modification to Resolution No. 92-352 as recommended by the
Mohave County Planning and Zoning Commission and outlined herein.
