PAGE 1 OF ~ nUHAVE COUHTY BOARD OF SUPERVISORS RECORDING FEE 0.00 we .4 RESOLUTION NO. 93-12 A RESOLUTION SETTING FORTH THE REZONING OF S~ NW~ PARCEL 222, SECTION 4, TOWNSHIP 21 NORTH, RANGE 18 WEST, FROM: A-R/SA (AGRICULTURAL RESIDENTIAL/FIVE ACRE MINIMUM LOT SIZE) ZONE, PROPOSED TO BE: A-R/2A & lA (AGRICULTURAL RESIDENTIAL/TWO AND ONE ACRE MINIMUM LOT SIZE) ZONES, LOCATED IN THE GOLDEN VALLEY AREA, MOHAVE COUNTY, ARIZONA WHEREAS, at the regular meeting of the Mohave County Board of supervisors held on January 4, 1993, a public hearing was conducted to determine whether approval should be granted to Jack L. and Cletis Bullard of Kingman, Arizona, for a zone change from the existing A-R/5A (Agricultural Residential/Five Acre Minimum Lot Size) zone, to A-R/2A & 1A (Agricultural Residential/Two and One Acre Minimum Lot Size) zones, located six hundred fifty-nine (659') feet north of Burro Drive on the east side of Magma Drive in the Golden Valley area, and WHEREAS, Section 4 is approximately one-half (.5) mile north of Arizona Sate Highway 68. The property is accessed from State highway 68 via Maverick Road north approximately one (1) mile, thence east approximately thirteen hundred (1300') feet on Burro Drive, thence north approximately six hundred and sixty (660') feet to the southwest corner of the subject property, and . . Resolution No. 93-12 Page 2 , o PAGE 2 OF , BK 2159 PG 101 (FEE~93- 929) WHEREAS, review of floodplain map #040058-2150B indicates this parcel to be located within a FEMA designated Special Flood Hazard Area. This area requires a Floodplain Use Permit for any development. There is one single family home currently on the site. Surrounding land uses consist primarily of vacant land and single family residences scattered throughout the area. The applicant desires to split this five (5) acre parcel into two one (1+) acre parcels, and one two (2+) acre parcel, and WHEREAS, this property is located within the Valley pioneer Water District and the Building Overlay zone, and ~':'.;J' . WHEREAS, at the public hearing before the Mohave County Planning and zoning Commission on December 9, 1992, the Commission recommended a conditional APPROVAL of the requested rezoning with the applicant understanding and accepting the following conditions: 1. The two western parcels to be zoned A-R/IA (Agricultural-Residential/one Acre Minimum Lot Size), and the east parcel to be zoned A-R/2A (Agricultural Residential/Two Acre Minimum Lot Size. 2. Submittal and recordation of a Parcel Plat prepared in accordance with Article 3.16 of the Mohave County Subdivision Regulations. 3. The establishment of a minimum lot size based on the size of parcels per the recorded Parcel Plat. 4. Each parcel shall have legal access. 5. The two (2) western parcels shall meet or exceed one (1) acre, and the eastern parcel shall meet or exceed two (2) acres exclusive of road easements or rights-of- way. ..... . . No building/zoning permits shall be issued until after Parcel Plat recordation. 8. The Board of Supervisors accept the dedication of a thirty (30') foot road right-of-way along the west boundary. In addition the granting of and eight (8') foot public utility easement along the west boundary of this parcel. This shall be approved through the recording of the resolution authorizing this zone change, and that the dedication/granting statement and dedication/granting be shown on the Parcel Plat. 9. That appropriate zoning/building/environmental permits be obtained. 10. The rezone shall not become effective for at least thirty (30) days after final approval of the change in classification by the Board of Supervisors. Being February 3, 1993, as per ARS 11-829E. -~' 11. I f these conditions are not met wi thin one (1) year this approval shall be void. I f at the expiration of this period the property has not been improved for the use for which it was conditionally approved, the Board after notification by registered mail to the owner and applicant who requested the rezoning shall schedule a public hearing to grant an extension, determine compliance with the schedule for development or cause the property to revert to its former zoning classification in accordance with Arizona Revised Statutes Annotated, Title 11, Chapter 6, 11-832. At the request of Roqer Esquerra, cartoqrapher, the Planninq Commission recommends Final Plat and Parcel plat boundaries be a triple wide line as the 1/8" blue line border obscures dimensions. WHEREAS, the notice of hearing was published in the Kingman Standard, a newspaper of general circulation in the county seat, Kingman, Mohave County, Arizona, on December 19, 1992, and posted December 18, 1992, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. ~ . . Resolution No. 93-12 Page 4 PAGE 4 OF 4 BK 2159 PG 103 CFEE~93- 929) NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, January 4, 1993 approved this change in zoning as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
