PAGE 1 OF 4 nOHAVE COUNTY BOARD OF SUPERVISORS RECORDING FEE Q.OO He RESOLUTION NO. 93-11 A RESOLUTION SETTING FORTH THE REZONING OF E~ SE~ PARCEL 91, SECTION 15, TOWNSHIP 21 NORTH, RANGE 18 WEST, FROM: A-R/2A (AGRICULTURAL RESIDENTIAL/TWO ACRE MINIMUM LOT SIZE) ZONE, PROPOSED TO BE: A-R/1A (AGRICULTURAL RESIDENTIAL/ONE ACRE MINIMUM LOT SIZE) ZONE, LOCATED IN THE GOLDEN VALLEY AREA, MOHAVE COUNTY, ARIZONA WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on January 4, 1993, a public hearing was conducted to determine whether approval should be granted to Cloyde Johnson of Moreno Valley, California, for a zone change from the existing A-R/2A (Agricultural Residential/Two Acre Minimum Lot Size) zone, to A-R/IA (Agricultural ReSidential/One Acre Minimum Lot Size) zone, occupying the northwest corner of Arivaca Road and Abrigo Drive in the Golden Valley area, and WHEREAS, Section 15 is approximately one-half (.5) mile south of Arizona Sate Highway 68. The property is accessed from State highway 68 via Aztec Road south approximately one-quarter (.25) mile to Crystal Drive, thence west approximately one- quarter (.25) mile, thence south approximately five hundred (500') feet to the northeast corner of the subject property, and WHEREAS, review of floodplain map #040058-2325B indicates this parcel to be clear of a designated floodplain. Surrounding land uses consist primarily of vacant to the south and west and single family residences to the north and east. The applicant desires to split this four (4+) acre parcel into three one (1+) acre parcels, and WHEREAS, this rezone will constitute the first request for one (1) acre lots in Parcel 91. The rest of Parcel 91 has lots of five (5) acres or greater. Parcel 92, located directly East, has had six (6) one acre lot splits, and seven (7) two acre lot splits. The remaining three lots in Parcel 92 are five ( 5 ) acres. The remaining parcels in Section 15 are predominantly -'. forty (40) acre parcels, and WHEREAS, this property is located in the Valley Pioneer Water District and the Building Overlay Zone, and WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on December 9, 1992, the Commission recommended a conditional APPROVAL of the requested rezoning with the applicant understanding and accepting the following conditions: 1. The three parcels to be zoned A-R/IA (Agricultural- Residential/One Acre Minimum Lot Size). 2. Submittal and recordation of a Parcel Plat prepared in accordance with Article 3.16 of the Mohave County Subdivision Regulations. 3. The establishment of a minimum lot size based on the size of parcels per the recorded Parcel Plat. /. . . Resolution No. 93-11 Page 3 PAGE 3 OF 4 BK 2159 PG 98 (FEE~93- 928) 4. Each parcel shall have legal access. 5. The three (3) parcels shall meet or exceed one (1) acre exclusive of road easements or rights-of-way. 6. The parcel plat shall show any surface drainage or FEMA flood zones. 7. No building/zoning permits shall be issued until after Parcel Plat recordation. 8. The Board of Supervisors accept the dedication of a thirty (30') foot road right-of-way along the east boundary, and a thirty-five (35') foot dedication along the southern boundary of the subject property. Also the dedication of a twenty (20') foot radius curve at the southeast corner of the subject property. In addition the granting of and eight ( 8') foot public utility easement along eastern and southern boundaries of this parcel. This shall be approved through the recording of the resolution authorizing this zone change, and that the dedication-granting statement and dedication- granting be shown on the Parcel Plat. 9. That appropriate zoning/building/environmental permits be obtained. 10. The rezone shall not become effective for at least thirty (30) days after final approval of the change in classification by the Board of Supervisors. Being February 3, 1993, as per ARS 11-829E. 11. I f these conditions are not met within one ( 1) year this approval shall be void. If at the expiration of this period the property has not been improved for the use for which it was conditionally approved, the Board after notification by registered mail to the owner and applicant who requested the rezoning shall schedule a public hearing to grant an extension, determine compliance with the schedule for development or cause the property to revert to its former zoning classification in accordance with Arizona Revised Statutes Annotated, Title 11, Chapter 6, 11-832. At the request of Roqer Esquerra, cartoqrapher, the Planninq Commission recommends Final Plat and Parcel Plat boundaries be a triple wide line as the 1/8" blue line border obscures dimensions. ~ . . Resolution No. 93-11 PAGE 1- OF BK 2159 PG Page 4 -4 99 (FEE;93- 928) WHEREAS, the notice of hearing was published in the Kingman Standard, a newspaper of general circulation in the county seat, Kingman, Mohave County, Arizona, on December 19, 1992, and posted December 18, 1992, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, January 4, 1993 approved this change in zoning as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
