PAGE 1 OF + MOHAVE COUNTY BOARD OF SUPERVISORS RECORDIHG FEE 0.00 He ,4 RESOLUTION NO. 93-9 ZONING USE WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on January 4, 1993, a public hearing was conducted to determine whether approval should be granted to E. R. Realty of Kingman, Arizona, for an extension of time for a zoning Use Permit (ZUP) to establish a mobile home as a sales office in an A-R (Agricultural Residential) zone, located in a portion of the E~ Parcel 250, Section 11, Township 21 North, Range 19 West, occupying the northwest corner of Highway 68 and Cove Road in the Golden Valley area, and WHEREAS, Section 11 is approximately eight (8) miles west of the Highway 68 and 93 junction and is bisected by Highway 68. The subject property occupies the northwest corner of Cove Road and Highway 68 extending north along Cove Road to Chino Drive, and WHEREAS, review of floodplain map #040058-2325B indicates this parcel is clear of a designated floodplain. The applicant seeks to establish the sales office for the selling of lots within Crystal Springs Estates. This request for a temporary sales trailer is similar to a number of requests that have been approved in the South Mohave Valley area, and WHEREAS, the followinq are approval conditions for the ZUP to allow the establishment of a sales office in an A-R zone as recommended Qy the Commission and approved Qy the Board as contained in Resolution 91-163: 1. This permit shall be a temporary permit for a one year period with provision for one extension of one year. 2. The site shall have appropriate landscaping for the surroundings, shall provide temporary adequate off- street parking as provided in the site plan. 3. At the expiration of this approval the property shall revert to original zoning and condition except such improvements that can be incorporated into the parcel's future use. 4. The mobile home shall have an affixed HUD label. 5. The mobile home shall be used as a sales office only and not as a residence or watchman's quarters. 6. The access and parking area be paved if the sales office use extends beyond one (1) year from the date of Board approval. 7. That appropriate zoning/building permits be obtained. ,. , ( . . The site, at the time of this writinq is vacant. The applicant has approached some members of the commission to see if there may be some problems with the extension. This was done in order to see if the necessary permits to establish the office could be acquired from staff prior to the December 2L 1992 meetinq. It was reported to staff that the response was positive and staff will proceed to issue ~ permit with conditions, and WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on December 9, 1992, the Commission recommended conditional APPROVAL of the requested extension of time with the applicant understanding and accepting the following conditions: 1. Continued compliance with Conditions 1-5 & 7 of Resolution No. 91-264. Compliance with Condition #6 is waived by approval of this action. 2. This extension of time be granted for this use until June 3, 1993. 3. If construction or use has not commenced within one (1) year of Board approval of the Zoning Use Permit or if the use has been discontinued for six (6) months, then approval shall terminate at that date. 4. This Zoning Use Permit is subject to revocation upon sixty (60) days notification by the Board of Supervisors, if in the opinion of the Commission and Board the continued use of the property would be contrary to the public health, safety, and welfare. ..,....~ . . . If at the expiration of this period the property has not been improved for the use for which it was conditionally approved, the Board after notification by registered mail to the owner and applicant who requested the ZUP shall schedule a public hearing to grant an extension, determine compliance with the schedule for development or cause the property to revert to its former zoning classification in accordance with Arizona Revised Statutes Annotated, Title 11, Chapter 6, 11-832. WHEREAS, the notice of hearing was published in the Kingman Standard, a newspaper of general circulation in the county seat, Kingman, Mohave County, Arizona, on December 19, 1992, and posted December 18, 1992, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. J,""'> NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, January 4, 1993 approved this extension of time for the zoning Use Permit, as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
