A RESOLUTION SETTING FORTH THE DENIAL OF A REQUEST FOR AN
EXTENSION OF TIME FOR THE REZONING OF LOT 13, BLOCK K, GOLDEN
SAGE RANCHOS #55, FROM: A-R (AGRICULTURAL RESIDENTIAL) ZONE,
PROPOSED TO BE: C-M (COMMERCIAL MANUFACTURING) ZONE, LOCATED IN
THE GOLDEN VALLEY AREA, MOHAVE COUNTY, ARIZONA
WHEREAS, at the regular meeting of the Mohave County Board
of Supervisors held on January 4, 1993, a public hearing was
conducted to determine whether approval should be granted or
denied to Phyllis D. Spradling of Bullhead City, Arizona for an
extension of time on a zone change from existing A-R
(Agricultural Residential) zone to C-M (Commercial Manufacturing)
zone, located in the Golden valley area, and
WHEREAS, the subject property is located approximately three
(3) miles west of the Highway 93/68 intersection.
Lot 13 is a
2.3 acre parcel located seven hundred twenty-seven (727') feet
south of the southeast corner of Heber Road and Highway 68 in
Block K.
Block K of Golden Sage Ranchos #55 is traversed by
Highway 68, and
WHEREAS, the zone change, approved on November 4, 1992 by
the Board of Supervisors, was requested so the applicant could
establish a sheet metal shop and related storage. This area has

developed with mixed uses. The subject property is surrounded by
single family structures and mobile ~omes, and
WHEREAS, approximately three hundred thirty (330') feet
north of this parcel is the area projected for commercial uses.
A review of the Sacramento Valley Area Plan (April, 1980) and the
updated version of August, 1989, revealed the property did not
show up in the projected commercial overlay.
However, this
property was located in an area projected for multiple family
residential uses and may be implemented in the future.
The area
had favorable response to multiple family applications, and
WHEREAS, this request was originally heard at the May 9,
1990 Planning and Zoning meeting and was rescheduled along with a
proposed amendment to the Golden Valley Area Plan for this
section.
The Planning staff prepared a recommendation for this
rezone based upon the acceptance or rejection of the amendment to
the area plan, and
WHEREAS, the followinq are approval conditions for the
rezone request as recommended Qy the Commission and approved Qy
the Board as contained in Resolution 90-277:

1. The applicant comply with all applicable provisions of
Sections 25, 26, 27, and 31 of the Mohave County Zoning
Ordinance.
2. The development shall have adequate parking facilities.

3. Arizona Department of Environmental Quality approves
the water supply and distribution system.
4. Arizona Department of Health Services or Mohave County
Health Department approves the method or design of the
sewage systems proposed for this development.
5. All paving (driveways and parking) be paved in
accordance with Mohave County Standard Specification
#171 or better, and that such paving be completed
within ninety (90) days of the certification of
occupancy granted the building.

A solid masonry, concrete or earthen product wall not
less than six (6') feet in height or approved
landscaped berms, landscape screening or combinations
thereof shall be required along and adjacent to any
side or rear property line abutting any rural or
residential zone boundary, or any alley abutting such
zone boundary. Further, any access gates shall be
constructed of view-obscuring materials to provide
effective site screening. Approval of the alternative
screening methods listed above shall be by the Board of
Supervisors upon recommendation of the Commission.
7. Building/zoning permit(s) shall be obtained.
8. Lot 13, Block K, Golden Sage Ranchos #55 shall revert
to 2.3 acres minimum lot size.
9. This rezone shall not become effective for at least
thirty (30) days after final approval of the change in
classification by the Board.
An extension of time was qranted via Resolution 91-294. The
followinq are approval conditions for the extension:
1. Compliance with all conditions of Resolution 90-277.
2. The zoning of this parcel shall be C-M/2A (Commercial
Manufacturing/Two Acres Minimum Lot Size).
3. The zoning shall not be in effect until all conditions
are met.
4. If these conditions are not met within one (1) year
this approval shall be void. If at the expiration of
this period the property has not been improved for the
use for which it was conditionally approved, the Board

WHEREAS, the applicant is asking for an additional extension
indicating that economic factors have delayed development of the
site, and
WHEREAS, the Planning Commission, at their meeting on
Wednesday, December 9, 1992, recommended this request for an
extension of time of the approved rezone from A-R to C-M be
DENIED and the zoning REVOKED based upon the following:
1. A written statement from the property owner, dated
December 4, 1992, indicates she wishes to cancel the
request for an extension of time thus allowing the
zoning approval to expire. The letter also indicated
she approved of the zoning returning to A-R
(Agricultural-Residential).
WHEREAS, the notice of hearing was published in the Kingman
Standard, a newspaper of general circulation in the county seat,
Kingman, Mohave County, Arizona, on December 19, 1992, and posted
December 18, 1992 as required by Arizona Revised Statutes, and
the Mohave County Zoning Regulations.

NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors,
at their regular meeting on Monday, January 4, 1993 denied this
requested extension of time as recommended by the Mohave County
Planning and Zoning Commission and outlined herein.
