PAGE 1 OF ~ HOHAVE COUNTY BOARD OF SUPERVISORS RECORDING FEE 0.00 He ---- RESOLUTION NO. 93-85 A RESOLUTION SETTING FORTH .APPROVAL OF THE REZONING OF PARCEL 246-C, SECTION 6, TOWNSHIP 21, RANGE 18 WEST, FROM: A-R/10A (AGRICULTURAL-RESIDENTIAL/TEN ACRE MINIMUM LOT SIZE) ZONE, PROPOSED TO BE: A-R/2A (AGRICLUTURAL-RESIDENTIAL/TWO ACRE MINIMUM LOT SIZE) ZONE, LOCATED DIRECTLY NORTH OF CHINO ROAD, BETWEEN LIGURTA ROAD AND LA OSA ROAD IN THE GOLDEN VALLEY AREA, MORAVE COUNTY, ARIZONA WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on Monday, AprilS, 1993, a public hearing was conducted to determine whether approval should be granted to Stephen and Sonia Sato of La Palma, CA., for~a zone change from the existing A-R/10A (Agricultural Residential/Ten Acre Minimum Lot Size) zone to A-R/2A (Agricultural Residential/Two Acre Minimum Lot Size) zone located north of Chino Road, Section 6, Township 21 North, Range 18 West, and WHEREAS, Section 6 is located approximately one-half (.05) miles north of Highway 68, and is bounded by Colorado Road on the east, Chino Road on the south, Teddy Roosevelt Road on the west and Agua Fria Road on the north. The property is accessed from Highway 68 via Teddy Roosevelt Road north approximately fourteen- hundred (1,400') feet to Chino Road thence east twelve-hundred ,., /_~""'\ \ ..,-".:.J \'~~,.:~-_.;' '~"-""" . . page 2 Resolution 93-85 PAGE 2 OF 4 BK 2200 PG 717 (FE'.Et93-1861&) (1,200') feet to La Oso Road to the northwest corner of the subject property, and WHEREAS, review of floodplain map #040058-2155B indicates this parcel to be located within a FEMA SPECIAL FLOOD HAZARD AREA. The property is currently vacant. Surrounding land uses consist primarily of vacant land with a few scattered residences. An electric power line runs along the west side of Ligurta Road, along the east boundary of this parcel, and WHEREAS, the applicant desires to split this twelve plus I'~ (':"';'51 (12.88) acre parcel into a two (2+) acre parcel, a four (4+) acre ,j0.7 ; !t~ . --I parcel and a five (5+) acre parcel, and WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on March 10, 1993, the Commission Recommended APPROVAL of the requested zone change with the applicant understanding and accepting the following conditions: 1. The eastern parcel be zoned A-R/5A (Agricultural- Residential/Five Acre Minimum Lot Size), the center parcel be zoned A-R/2A (Agricultural-Residential/Two Acre Minimum Lot Size), and the western parcel be zoned A-R/4A (Agricultural-Residential/Four Acre Minimum Lot Size) . 2. Submittal and recordation of a Parcel plat prepared in accordance with Article 3.16 of the Mohave County Subdivision Regulations. 3. Each parcel shall have legal access. The eastern parcel shall meet or exceed five (5) acres, the center parcel shall meet or exceed two (2) acres, and the western parcel shall meet or exceed four (4) acres exclusive of road easements or rights-of-way. 5. The parcel Plat shall show any surface drainage or FEMA flood zones. 6. No building/zoning permits shall be issued until after Parcel Plat recordation. 7 . The Board of supervisors accept the Abandonment of fifteen (15') feet on the east, twenty (20') feet on the west and eight (8') feet on the south of the existing fifty (50') foot Roadway and Utility easement, and the dedication of a thirty (30') foot road right- of-way along the west boundary and a thirty-five (35') foot road right-of-way dedication along the east boundary and the dedication of a forty-two (42') foot road right-of-way along the south side of the subject property. In addition the granting of and eight (8') foot public utility easement along the east and west and south boundaries of this parcel. The dedication, granting and abandonment statement be shown on the Parcel Plat. 8. The rezone shall not become effective for at least thirty (30) days after final approval of the change in classification by the Board of Supervisors, as per ARS 11-829E, and conditions contained herein. 9. If these conditions are not met within one (1) year this approval by the Board of Supervisors shall be void. If at the expiration of this period the property has not been improved for the use for which it was conditionally approved, the Board after notification by registered mail to the owner and applicant who requested the rezoning shall schedule a public hearing to grant an extension, determine compliance with the schedule for development or cause the property to revert to its former zoning classification in accordance with Arizona Revised Statutes Annotated, Title 11, Chapter 6, 11-832. Resolution 93-85 Page 4 WHEREAS, the notice of hearing was published in the Kingman Standard, a newspaper of general circulation in Kingman, Mohave County, Arizona, on March 20 1993, and posted as required by Arizona Revised and the Mohave County zoning Statutes, Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday AprilS, 1993 approved the granting of this zone change as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
