PAGE 1 OF ~ fiOHAVE COUNTY BOARD Of SUPERVISORS RECORDING FEE 0.00 HC RESOLUTION NO. 93-84 A RESOLUTION SETTING FORTH APPROVAL OF THE REZONING OF PARCEL 246--B, SECTION 6, TOWNSHIP 21, RANGE 18 WEST, FROM: A-R!10A (AGRICULTURAL-RESIDENTIAL/TEN ACRE MINIMUM LOT SIZE) ZONE, PROPOSED T'O BE: A-R!2A (AGRICLUTURAL-RESIDENTIAL/TWO ACRE MINIMUM LOT SIZE) ZONE, LOCATED FOUR-HUNDRED AND TWENTY-SEVEN (427') FEET NORTH OF CHINO ROAD, BETWEEN LIGURTA ROAD AND LA OSO ROAD IN THE GOLDEN VALLEY AREA, MOHAVE COUNTY, ARIZONA WHEREAS, at the regular meeting of the Mohave County Board of Supervi.sors held on Monday, AprilS, 1993, a public hearing was conducted to determine whether approval should be granted to Ralph Born of Dammeron Valley, Utah, for a zone change from the existing A-R/10A (Agricultural Residential/Ten Acre Minimum Lot Size) zone to A-R/2A (Agricultural Residential/Two Acre Minimum Lot Size) zone located four-hundred and twenty-seven (427') feet north of Chino Road, Section 6, Township 21 North, Range 18 West, and WHEREAS, Section 6 is located approximately one-half (.05) miles north of Hig~way 68, and Is bounded by Colorado Road on the east, Chino Road on the south, Teddy Ro.osevelt Road on the west and Agua Fria Road on the north. The property is accessed from Highway 68 via Teddy Roosevelt Road north approximately fourteen- - hundred ( 1,400') feet to Chino Road thence east twelve-hundred (1,200') feet to La Oso Road thence north approximately four- J ~~ Resolution No. 93-84 ~ifip PAGE 2 o. 4 c.'l"'e:..'C..~-'a08.~'l:I' "... 2,'2.QO ,._ .."" Page 2 PAGE :2 Of .4 ilK 2200 PG 713 (FEE~93-18615) hundred and thirty (430 -) feet to the northwest corner of the subject property, and WHEREAS, review of floodplain map #040058-2150B indicates this parcel to be located within a FEMA SPECIAL FLOOD HAZARD AREA. The property is currently vacant. Surrounding land uses consist primarily of vacant land with a few scattered residences. An electric power line runs along the west side of Ligurta Road, along the east boundary of this parcel, and WHEREAS , the applicant desires to split this twelve plus ,/.~% t?-:0>.1 .....;::w (12.88) acre parcel into a two (2+) acre parcel, a four (4+) acre parcel and a five (5+) acre parcel, and WHEREAS , at the public hearing before the !-lohave County Planning and Zoning Commission on March 10, 1993, the Commission Recommended APPROVAL of the requested zone change with the applicant understanding and accepting the following ,~onditions: 1. The eastern parcel be zoned A-R/5A (Agricultural- Residential/Five Acre Minimum Lot Size), the center parcel be zoned A-R/2A (Agricultural-Residential/Two Acre Minimum Lot Size), and the western parcel be zoned A-R/4A (Agricultural-Residential/Four Acre Minimum Lot Size) . 2. Submittal and recordation accordance with Article Subdivision Regulations. of a Parcel Plat prepared in 3.16 of the Mohave County 3. The eastern parcel shall meet or exceed five (5) acres, the center parcel shall meet or exceed bro ( 2) acres, and the western parcel shall meet or exceed four (4) acres exclusive of road easements or rights-of-way. 5. The parcel Plat shall show any surface drainage or FEMA flood zones. 6. No building/zoning permits shall be issued until after Parcel Plat recordation. 7 . The Board of Supervisors accept the Abandonment of fifteen (15') feet on the east and twenty PO') feet on the west of the existing fifty. (50') foot Roadway and Utility easement, and the dedication of a thirty (30') foot road right-of-way along the west and a thirty~five ( 35' ) foot dedication along the east boundary. In addition the granting of and eight ( 8') foot public utility easement along the east and west boundaries, and the granting of a thirty ( 30') foot Roadway and Utility easement along the north boundary of the western parcel. The dedication, granting and abandonment statement shall be shown on the Parcel Plat. f~~~ '~ 8. The rezone shall not become effective for at least thirty (30) days after final approval of the change in classification by the Board of Supervisors, as per ARS ll-829E, and conditions contained herein. 9 . If these condi tionsare not met within one ( 1) year this approval by the Board of Supervisors shall be void. If at the expiration of this period the property has not been improved for the use for which it was conditionally approved, the Board after notification by registered mail to the owner and applicant who requested the rezoning shall schedule a public hearing .to grant an extension, determine compliance with the schedule for development or cause the property to revert to its former zoning classification in accordance with Arizona Revised Statutes Annotated, Title 11, Chapter 6, 11-832. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday AprilS, 1993 approved the granting of this zone change as recommended by the Mohave County Planning and zoning Commission and outlined herein.
