A RESOLUTION SETTING FORTH APPROVAL OF A ZONING USE PERMIT (ZUP)
FOR A RESIDENTIAL ESTABLISHMENT, IN A C-1 (NEIGHBORHOOD
COMMERCIAL) ZONE, LOCATED IN THE NEW KINGMAN ADDITION, UNIT 8,
TRACT l101, BLOCK 101, LOT 21, SECTION 29, TOWNSHIP 22 NORTH,
RANGE 16 WEST, LOCATED IN THE NORTHEAST CORNER OF NORTH BANK
STREET AND HEARNE AVENUE IN THE KINGMAN AREA.
WHEREAS, at the regular meeting of the Mohave County Board
of Supervisors held on March 8, 1993, a public hearing was
conducted to determine whether approval should be granted to
Charles E. Schmedeke of Kingman, Arizona, for a Zoning Use Permit
in an C-1 (Neighborhood-Commercial) zone, located in the New
Kingman Addition, Unit 8, Tract 1101, Block 101, Lot 21 in the
Kingman area, and
WHEREAS, Lot 21 is located one-half (.5) miles north of
Northern Avenue and two and one-quarter (2.25) miles east of
Stockton Hill Road.
The property is accessed form Northern
Avenue via North Bank Street north one-half (.5) miles to Hearne
Avenue, and
WHEREAS,
review of the
floodplain map #040058-2165C
indicates this property to be clear of a designated floodplain.
The property is currently zoned C-1, with C-l property to the
north, east, west and directly south, with R-1 (Residential)
zoning located southwest. The property is currently vacant with

an established business to the north, and other properties
directly adjacent being vacant.
The majority of this area has
been developed as a residential area with residential homes
scattered throughout, and
WHEREAS, the applicant desires to establish a custom sewing
and clothing alteration service with an apartment located in the
same building to allow the owner or employee to work and live in
the same establishment,
WHEREAS, at the public hearing before the Mohave County

Planning and Zoning Commission on February 10,
1993, the
Commission recommended APPROVAL of the requested Zoning Use
Permit (ZUP) contingent on the following:
1. The applicant comply with all applicable provisions of
Sections 25, 26, 27, & 31 of the Mohave County Zoning
Regulations. Compliance with Section 27. P (Site Plan
Requirements) and Ordinance 87-1 (Dark Sky Ordinance)
is also required.
2. That the Zoning Use Permit be valid in connection to
the establishment of a commercial business only.
3. That appropriate zoning/building/environmental permits
be obtained.
4. If construction or use has not commenced within one (1)
year of Board approval of the Zoning Use Permit or if
the use has been discontinued for six (6) months, then
approval shall terminate at that date.
5. This Zoning Use Permit is subject to revocation upon
sixty (60) days notification by the Board of
Supervisors, if the opinion of the commission and Board
the continued use of the property would be contrary to
the public health, safety, and welfare.

6 . I f these conditions are not met wi thin one ( 1) year
this approval shall be void. If at the expiration of
this period the property has not been improved for the
use for which it was conditionally approved, the Board
after notification by registered mail to the owner and
applicant who requested the rezoning shall schedule a
public hearing to grant an extension, determine
compliance with the schedule for development or cause
the property to revert to its former zoning
classification in accordance with Arizona Revised
Statutes Annotated, Title 11, Chapter 6, 11-832.
WHEREAS, the notice of hearing was published in the Kingman
Standard, a newspaper of general circulation in Kingman, Mohave
County, Arizona, on February 20, 1993, and posted February 19,
1993, as required by Arizona Revised Statutes, and the Mohave

County Zoning Regulations.
NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors,
at their regular meeting on Monday March 8, 1993 approved this
Zoning Use Permit as recommended by the Mohave County Planning
and Zoning commission and outlined herein.
