PAGE 1 OF 3 MOHAVE COUNTY BOARD OF SUPERVIeORS RECORDING FEE u.OO NC ~ RESOLUTION NO. 93-58 A RESOLUTION SETTING FORTH APPROVAL OF A PETITION OF ABANDONMENT AND REVERSION TO ACREAGE OF TEN (10') FEET OF A PUE & DE, ALSO KNOWN AS PARCEL K-K, AS IT IS CONTIGUOUS TO THE SOUTHWESTERLY BOUNDARY OF LOT 5, BLOCK F, DESERT LAKES GOLF COURSE AND ESTATES, TRACT 4076-A, SITUATED IN SECTION 35, TOWNSHIP 19 NORTH, RANGE 22 WEST, LOCATED IN THE SOUTH MOHAVE VALLEY AREA, MOHAVE COUNTY ARIZONA WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on March 8, 1993, a public hearing was conducted to determine whether approval should be granted to Desert Lakes Development of Mission Viejo, California in an S-D/R (Special-Development/Residential) zone, located within the Desert Lakes Estates and Golf Course Subdivision, and WHEREAS, Desert Lakes Golf Course and Estates is located approximately one-half (.5) mile east of State Highway 95. Lot 5 can be accessed from Highway 95 via Joy Lane Road east approximately three-quarters (.75) mile to Club House Drive thence south/southwest approximately three-quarters (.75) mile to the subject property, and WHEREAS, this petition of abandonment is at the request of Sterling Varner, Property Manager for Desert Lakes Development, and . . .~ .)~.' . ..... Resolution 93-58 Page 2 WHEREAS, review of floodplain map #040058-2445C indicates this lot to be located in a FEMA Special Flood Hazard Area. A floodplain use permit is required for any development in this area. A single-family home is currently under construction on this lot, and WHEREAS, the current zoning for this property is S-D/R, and WHEREAS, the abandonment (reversion to acreage) of lot 5 is being proposed along with the abandonment of a portion of Parcel K-K of this same subdivision so that this portion of Parcel K-K may be combined with Lot 5 to create a new lot with greater square footage, and WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on February 10, 1993, the Commission recommended APPROVAL of the requested Abandonment contingent on the following: 1. That Lot 5 be reverted to acreage. 2. That the only portion to be abandoned is that ten (10') feet of Parcel K-K which is contiguous to the southwesterly boundary of Lot 5. 3. Submittal and recordation of a Parcel Plat prepared in accordance with Article 3.16 of the Mohave County Subdivision Regulations for the newly created lot depicting the new lot lines. '. ...'" 4 . Resolution 93-58 Page 3 5. The newly created lot shall be designated as Lot 5-A and shall be referenced and referred to by a metes and bounds description. 6 . I f these conditions are not met wi thin one (1) year this approval shall be void. If at the expiration of this period the property has not been improved for the use for which it was conditionally approved, the Board after notification by registered mail to the owner and applicant who requested the abandonment shall schedule a public hearing to grant an extension , determine compliance with the schedule for development or cause the property to revert to its former classification in accordance with Arizona Revised Statutes Annotated, Title 11, Chapter 6, 11-832. WHEREAS, the notice of hearing was published in the Kingman Standard, a newspaper of general circulation in Kingman, Mohave County, Arizona, on February 20, 1993, and February 27, 1993, and posted February 19, 1993, as required by Arizona Revised Statutes, and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday March 8, 1993 approved this Abandonment as recommended by the Mohave County Planning and Zoning commission and outlined herein.
