PAGE 1 OF 3 HOHAVE COUNTY BOARD OF SUPERVISORS RECORDING FEE 0.00 NC RESOLUTION NO. 93-55 A RESOLUTION SETTING FORTH APPROVAL OF A ZONING USE PERMIT (ZUP) FOR THE ESTABLISHMENT OF A CELLULAR TELEPHONE TOWER AND EQUIPMENT SITE IN AN R-E/IOA (RESIDENTIAL-RECREATION/TEN ACRE MINIMUM LOT SIZE) ZONE, LOCATED IN THE NORTHWEST CORNER OF SECTION 28, TOWNSHIP 20 NORTH, RANGE 21 WEST, ADJACENT TO BULLHEAD CITY'S EASTERN CITY LIMIT BOARDER, AT THE ALIGNMENT OF BLACK MOUNTAIN ROAD, IN THE BULLHEAD AREA OF MOHAVE COUNTY, ARIZONA WHEREAS, at the regular meeting of the Mohave County board of Supervisors held on March 8, 1993, a public hearing was conducted to determine whether approval should be granted to Citizens Mohave Cellular, of Kingman Arizona, for a Zoning Use Permit (ZUP) in an R-E/10A (Residential-Recreation/Ten Acre Minimum Lot Size) zone, located in the Bullhead area, and WHEREAS, Section 28 is located four (4) miles east of Highway 95 and borders the Bullhead City eastern boundary. The site is accessed from State Highway 95 via Silver Creek Road East approximately three and one-half (3 1/2) miles to a service road for a power transmission line, thence South approximately one- quarter (.25) miles to the subject site, and WHEREAS, review of floodplain map #040058-2270D indicates the area is not within a designated floodplain. The site is being leased by Citizens Utility Company, The surrounding land is primarily vacant with the urban development taking place to the West, and an existing power transmission line located '" . . The terrain is rocky and mountainous, limiting future development in the area, and WHEREAS, The applicant proposes to place a twelve (12') foot by twenty-four (24') foot equipment building and a one-hundred and seventy (170') foot tower The site will enclosed by a chain link fence, and WHEREAS, the Bullhead City General Plan shows the area directly west of this site as a potential medium density residential area, and WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on February 10, 1993, the Commission recommended APPROVAL of the requested Zoning Use Permit (ZUP) contingent on the following: 1. The applicant comply with all applicable provisions of Sections 25, 26, 27, & 31 of the Mohave County Zoning Regulations. Compliance with Section 27.P (Site Plan Requirements) and Ordinance 87-1 (Dark Sky Ordinance) is also required. 2. That appropriate zoning/building/environmental permits be obtained. If construction or use has not commenced within one (1) year of Board approval of the Zoning Use Permit or if the use has been discontinued for six (6) months, then approval shall terminate at that date. 4. This Zoning Use Permit is subject to revocation upon sixty (60) days notification by the Board of Supervisors, if the opinion of the commission and Board the continued use of the property would be contrary to the public health, safety, and welfare. 5 . NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday March 8, 1993 approved this Zoning Use Permit as recommended by the Mohave County Planning and Zoning commission and outlined herein.
