PAGE 1 OF ~ MOHAVE COUNTY BOARO OF SUPERVISORS RECORDING FEE 0.00 He MICROFlUt1ED RESOLUTION NO. 93-52 A RESOLUTION SETTING FORTH APPROVAL OF A ZONING USE PERMIT (ZUP) FOR THE ESTABLISHMENT OF A RADIO COMMUNICATIONS SITE IN AN A- R/36A (AGRICULTURAL-RESIDENTIAL/THIRTY-SIX ACRE MINIMUM LOT SIZE) ZONE, LOCATED IN THE NW 1/4 OF SECTION 32, TOWNSHIP 15 NORTH, RANGE 20 WEST, LOCATED ON ARIZONA STATE LAND, IN THE NORTHWEST PORTION OF SECTION 32, AND WEST OF HIGHWAY 95 IN THE LAKE HAVASU AREA, MOHAVE COUNTY, ARIZONA WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on March 8, 1993, a public hearing was conducted to determine whether approval should be granted to ,<,' James and Carol Vine of Kingman, Arizona, For a Zoning Use Permit (ZUP) for the establishment of a Radio Communications Site in an A-R (Agricultural-Residential) zone, and WHEREAS, Section 32 is located approximately one (1) mile north of Lake Havasu City's northern city limit boundary, and two (2) miles northwest of Lake Havasu Airport and northwest of Highway 95 on Goat Hill. The site is accessed by Goat Hill Road a (4WD) dirt trail accessible to the north of the property via Highway 95, and WHEREAS, Review of floodplain map #04058-2970B indicates the .'... area is located within a designated floodplain. This site is being leased by Vine Communications. The site is currently being . .. -.:- /'"-'- 1 t '1' .. . . The surrounding land is vacant and the terrain is rugged and mountainous, The applicant proposed a sixty (60') foot steel tower on this site to establish a communications facility, however after discussion the Board concluded that the steel tower should not exceed forty-nine (49') feet, and WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on February 10, 1993, the Commission recommended APPROVAL of the requested Zoning Use Permit contingent on the following conditions: 1. The applicant comply with all applicable provisions of Sections 25, 26, 27, & 31 of the Mohave County Zoning Regulations. Compliance with Section 27. P (Site Plan Requirements) and Ordinance 87-1 (Dark Sky Ordinance) is also required. 2. That appropriate zoning/building/environmental permits be obtained. 3. The steel tower shall not exceed forty-nine (49') feet in height. 4. If construction or use has not commenced within one (1) year of Board approval of the Zoning Use Permit or if the use has been discontinued for six (6) months, then approval shall terminate at that date. 5. This Zoning Use Permit is subject to revocation upon sixty (60) days notification by the Board of Supervisors, if the opinion of the commission and Board the continued use of the property would be contrary to the public health, safety, and welfare. ~. .. . 7 '\- .~ # . . ...;... -....., Resolution No. 93-52 Page 3 \. PAGE 3 OF 3 BK 2200 PG 205 (FEE~93-18397) WHEREAS, the notice of hearing was published in the Kingman Standard, a newspaper of general circulation in Kingman, Mohave County, Arizona, on February 20, 1993, and posted February 19, 1993, as required by Arizona Revised Statutes, and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday AprilS, 1993 approved this Zoning Use Permit as recommended by the Mohave County Planning and Zoning commission and outlined herein.
