PG 1 OF :3 FEE 0.00 Ne A RESOLUTION AMENDING RESOLUTION NO. 92-405 SETTING FORTH THE REZONING OF PARCEL 22, LAZY Y-U RANCH PHASE 1, SECTION 11, MICRORLMED TOWNSHIP 20 NORTH, RANGE 16 WEST, FROM: A-R/36A (AGRICULTURAL RESIDENTIAL/THIRTY-SIX ACRE MINIMUM LOT SIZE) ZONE, PROPOSED TO BE: A-R/9A & 19A (AGRICULTURAL RESIDENTIAL/NINE AND NINETEEN ACRE MINIMUM LOT SIZE) ZONES, LOCATED IN THE HUALAPAI MOUNTAIN AREA, MOHAVE COUNTY, ARIZONA RESOLUTION NO. 93-141 - WHEREAS, at the regular meeting of the Mohave County Board ~~c::'~i of Supervisors held on May 3, 1993, a public hearing was " '.' conducted to amend Resolution No. 92-405 which approved the ~_ rezoning of Parcel 22, Lazy Y-U Ranches, Phase I, From: A-R/36A (Agricultural Residential/Thirty six Acre Minimum Lot Size) zone, to A-R/9A, 19A (Agricultural Residential/nine & nineteen Acre Minimum Lot Size) zone, and WHEREAS, the subject property is located approximately four (4) miles southeast of the Kingman City limits, on Hualapai Mountain Road. The subject property is approximately one (1) mile southeast of Hualapai Mountain Road and is accessed via Lazy Y-U Drive, Pack Saddle Drive, Saddletree Drive and Horseshoe Drive, and WHEREAS, review of floodplaiTl map #040058-2350C indicates this area to be wi thin Flood Zone C. The terrain is rugged mountain foothill country. Well constructed gravel base roads serve these properties. The site is currently vacant and bordered on all sides by vacant land. The owner is requesting a division into three (3) parcels. The zone change is for A-R/9A, A-R/9A and A-R/19A Parcel designations from this original forty (40) acre parcel, and WHEREAS, Lazy Y-U Ranch, Phase I is the division of three (3) Sections plus eighty (80) acres, into fifty (50) parcels of forty (40) acres of more each. The developers plan to divide an additional six (6) Sections of land in the future, and --- ... . . The road designation is designated as follows: "Easements shown...are perpetual in nature and are created for ingress/egress, drainage and public utility purposes for the benefit of each of the parcels and their owners and the public." The project attorneys recommended this wording to accommodate the public, and WHEREAS, there is no specific Area Plan for this area, and it is not within the Building Overlay area, and WHEREAS, on December 7, 1992, the Board of Supervisors condi tionally approved the recommendation of approval from the Planning and Zoning Commission. During the Parcel Plat review it was discovered that the zoning designations could not be met. For Fro this reason the owner is seeking an amendment to Resolution 92-405 to allow for a sixteen acre minimum lot size zone designation, and WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on April 14, 1993, the Commission recommended APPROVAL of this request to amend Resolution 92-405 contingent upon the following conditions with the old language struck, and the new language BOLDED: 1. The establishment of a minimum lot size based on the size of parcels per the recorded Parcel Plat. 4. Each parcel shall have legal access. 5. The parcel plat shall show any surface drainage or FEMA flood zones. 6. No building/zoning permits shall be issued until after Parcel Plat recordation. 7. The rezone shall not become effective for at least thirty (30) days after final approval of the change in classification by the Board of Supervisors. Being January 6, 1993, as per ARS 11-829E. 9. I f these conditions are not met wi thin one (1) year this approval shall be void. If at the expiration of this period the property has not been improved for the use for which it was conditionally approved, the Board after notification by registered mail to the owner and applicant who requested the rezoning shall schedule a public hearing to grant an extension, determine compliance with the schedule for development or cause the property to revert to its former zoning classification in accordance with Arizona Revised Statutes Annotated, Title 11, Chapter 6, 11-832. WHEREAS, the notice of hearing was published in the Kingman Standard, a newspaper of general circulation in Kingman, Mohave County, Arizona, on April 17, 1993, and posted April 15, 1993 as required by Arizona Revised Statutes, and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday May 3, 1993, approved this modification to Resolution No. 92-40 as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
