PAGE 1 OF 3 ~. 5 HOHAVE COUNTY BOARD OF SUPERVISORS fti RECORDING FEE 0.00 He RESOLUTION NO. 93-138 IICROALMED REZONING OF PARCEL 92-C, SECTION 19, TOWNSHIP 23 NORTH, RANGE 16 WES~FROM: A-R/IOA (AGRICULTURAL-RESIDENTIAL/TEN ACRE MINIMUM LOT SIZE) ZONE, PROPOSED TO BE: A-R/5A (AGRICULTURAL- RESIDENTIAL/FIVE ACRE MINIMUM LOT SIZE) ZONE, LOCATED APPROXIMATELY EIGHT (8) MILES NORTH OF NORTHERN AVENUE, AND A~PROXIMATELY ONE (1) MILE EAST OF STOCKTON HILL ROAD IN THE LONG 110UNTAIN PORTION OF THE MOHAVE COUNTY GENERAL AREA, MOHAVE COUNTY, ARIZONA WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on May 3, 1993, a public hearing was conducted to determine whether approval should be granted to Donald Bolks of San Diego, CA., for a zone change from the existing A-R/I0A (Agricultural Residential/Ten Acre Minimum Lot Size) zone, to A-R/5A (Agricultural Residential/Five Acre Minimum Lot Size) zone, of Parcel 92C, in the Long Mountain Area, and WHEREAS, the subject property 'is located approximately seven (7) miles north of Northern Avenue and approximately one (1) mile east of Stockton Hill Road. The property is accessed by Stockton Hill Road Via Calle Chavez east approximately eight-hundred (800~) feet to Avenida Ramirez thence south approximately three~ quarters (.75) miles to the northwest corner of the subject property. WHEREAS, review of floodplain map #040058-2155B indicates this Parcel to be clear of a designated floodplain. The property is currently vacant. Surrounding land uses consist primarily of vacant land with a few homes to the southwest. The terrain of the property is primarily flat. The applicant desires to split this '{-i-f.t-e€fr-I?!-\i-&-r!~4Q.~1* acre parcel into ttn-ere (5+) acre parcels, and *two WHEREAS, .this rezone request conforms to the Long Mountain Area Plan, and WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on April 14, 1993, the Commission recommended APPROVAL of the requested zone change with the applicant understanding and accepting the following conditions: .".JL l\or;;~:.:; ,.t... The t~e parcels be zoned A-R/5A (Agricultural- Residential/Five Acre Minimum Lot Size). 2. Submittal and recordation of a Parcel Plat prepared in accordance with Article 3.16 of the Mohave County Subdivision Regulations. 3. The establishment of a minimum lot size based on the size of parcels per the recorded Parcel Plat. 4. Each parcel shall have legal access. TWO 5. 'l'he three parcels shall meet or exceed five (5) acres exclusive of road easements or rights-of-way. 6. The parcel Plat shall show any surface drainage or FEMA flood zones. 7. No building/zoning permits shall be issued until after Parcel Plat recordation. 8. That requisite zoning/building/environmental permits be obtained. 9. The Board of Supervisors accept the dedication of the north twenty-five (25~) feet, of the existing fifty (50~) road right-of-way running east to west, and the north-half of the forty-five (45~) foot radius (cul de sac) right-of-way, and the dedication of twenty (20~) foot radius curve on southwest corner of the subject property, where the cul de sac is adjacent to Avendia Ramirez. In addition the granting of and eight (8~) foot public utility easement along the northern and eastern, boundaries of the cui de sac. The dedication and granting statement to be shown on the Parcel Plat. 10. The rezone shall not become effective for at least thirty (30) days after final approval of the change in classification by the Board of Supervisors, as per ARS 11-829E, and conditions contained herein. 11. If these conditions are not met within one (1) year this approval by the Board of Supervisors shall be void. If at the expiration of this period the property has not been improved for the use for which it was conditionally approved, the Board after notification by registered mail to the owner and applicant who requested the rezoning shall schedule a public hearing to grant an extension, to determine compliance with the schedule for development or cause the property to revert to its former zoning classification in accordance with Arizona Revised Statutes Annotated, Title 11, Chapter 6, 11-832. PAGE 3 OF J 8K 2215 PG 13 (FEEt9J-24580) PAGE 3 WHEREAS, the notice of hearing was published in the Kingman Standard, a newspaper of general circulation in Kingman, Mohave County, Arizona, on April 17, 1993, and posted April 15, 1993 as required by Arizona Revised Statutes, and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday May 3, 1993, approved this zone change as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
