EVALUATION OF A ZONING USE PERMIT (ZUP) FOR A WATER STORAGE TANK
IN AN A-R/10A (AGRICULTURAL-RESIDENTIAL/TEN ACRE MINIMUM LOT
SIZE) ZONE, LOCATED IN A PORTION OF THE NE 1/4 OF THE NE 1/4 OF
THE NW 1/4 OF SECTION 11, TOWNSHIP 23 NORTH, RANGE 15 WEST,
LOCATED IN THE VALLE VISTA PORTION OF THE MOHAVE COUNTY GENERAL
AREA, MOHAVE COUNTY, ARIZONA
WHEREAS, at the regular meeting of the Mohave County Board
of Supervisors held on May 3, 1993, a public hearing was
conducted to determine whether approval should be granted to
Truxton Canyon Water Company, of Kingman, Arizona, for a Zoning
Use Permit (ZUP) for a water storage tank, in an zone A-R/10A
(Agricultural Residential/Ten Acre Minimum Lot Size) zone, on the
NE 1/4 of the NE 1/4 of the NW 1/4 of Section 11, located east of
the Valley vista Area, and
WHEREAS, the site is located north of Arizona West
Subdivision. The property is accessed by Valle Vista Subdivision
via a proposed twenty (20) foot access easement, and
WHEREAS, this water storage tank will be sixty (60) feet in
diameter and will have a twenty (20) foot buffer from all
property lines boundaries of this (.668) acre parcel, and
WHEREAS, Review of floodplain map #040058-2125B indicates
this Parcel to be clear of a designated floodplain. The property
is currently vacant. Surrounding land use consist of a
residential subdivision (Arizona West) approximately two-hundred
(200') feet southeast, and valley vista Subdivision approximately
one-quarter (.25) miles west. The land directly north and south
are currently vacant, and
WHEREAS, at the public hearing before the Mohave County
Planning and Zoning Commission on April 14, 1993, the Commission
recommended APPROVAL of the requested zoning Use Permit (ZUP)
with the applicant understanding and accepting the following
conditions:

1. The applicant comply with all applicable provisions of
Sections 25, 26, 27, & 31 of the Mohave County zoning
Regulations. Compliance with Section 27.P (Site Plan
Requirements) and Ordinance 87-1 (Dark Sky Ordinance)
is also required.
2. That appropriate zoning/building/environmental permits
be obtained.
3. If construction or use has not commenced within one (1)
year of Board approval of the Zoning Use Permit or if
the use has been discontinued for six (6) months, then
approval shall terminate at that date.
4. This Zoning Use Permit is subject to revocation upon
sixty (60) days notification by the Board of
Supervisors, if the opinion of the commission and Board
the continued use of the property would be contrary to
the public health, safety, and welfare.
WHEREAS, the notice of hearing was published in the Kingman
Standard, a newspaper of general circulation in Kingman, Mohave
County, Arizona, on April 17, 1993, and posted April 15, 1993 as
required by Arizona Revised Statutes, and the Mohave County
Zoning Regulations.
NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors,
at their regular meeting on Monday May 3, 1993, approved this
Zoning Use Permit as recommended by the Mohave County Planning
and Zoning Commission and outlined herein.
