PAGE 1 OF ~ HOHAVE COUNTY BOARD OF SUPERVISORS RECORDING FEE 0.00 Ne RESOLUTION NO. 93-89 A RESOLUTION SETTING FORTH APPROVAL OF THE REZONING OF PARCEL 510-B , SECTION 18, TOWNSHIP 23 NORTH, RANGE 16 WEST, FROM: A- R/10A (AGRICULTURAL-RESIDENTIAL/TEN ACRE MINIMUM LOT SIZE) ZONE, PROPOSED TO BE: A-R/5A (AGRICULTURAL-RESIDENTIAL/FIVE ACRE MINIMUM LOT SIZE) ZONE, LOCATED FOUR HUNDRED (400') FEET NORTH OF CALLE CHAVEZ ROAD, IN THE LONG MOUNTAIN PORTION OF THE MOHAVE COUNTY GENERAL AREA, MOHAVE COUNTY, ARIZONA WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on Monday, AprilS, 1993, a public hearing was conducted to determine whether approval should be granted to Donald Bolks of San Diego CA., for a zone change from the existing A-R/10A (Agricultural Residential/Ten Acre Minimum Lot Size) zone to A-R/5A (Agricultural Residential/Five Acre Minimum Lot Size) zone located four-hundred (400') feet north of Calle Chavez Road, Section 18, Township 23 North, Range 16 West, and WHEREAS , The subject property is located approximately eight (8) miles north of Northern Avenue and approximately one- half (.5) miles east of Stockton Hill Road. The property is accessed by Stockton Hill Road Via Calle Muerlos east approximately one -half (.5) miles to the northwest corner of the subject property, and . . The property is currently vacant. Surrounding land uses consist primarily of vacant land. The applicant desires to split this fifteen plus (15+) acre parcel into three five plus (5+) acre parcels, and WHEREAS, This rezone request conforms to the Long Mountain Area Plan, and WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on March 10, 1993, the Commission (:2) Recommended APPROVAL of the requested zone change with the applicant understanding and accepting the following conditions: 1. The three parcels be zoned A-R/5A (Agricultural- Residential/Five Acre Minimum Lot Size). 2. Submittal and recordation of a Parcel Plat prepared in accordance with Article 3.16 of the Mohave County Subdivision Regulations. 3. The establishment of a minimum lot size based on the size of parcels per the recorded Parcel Plat. 4. Each parcel shall have legal access. 5. The three parcels shall meet or exceed five (5) acres exclusive of road easements or rights-of-way. 6. The parcel Plat shall show any surface drainage or FEMA flood zones. 7. That requisite zoning/building/environmental permits be obtained. 9. The Board of Supervisors accept the dedication of a thirty (30') foot road right-of-way along the north and east boundaries and a sixty (60') foot dedication along the west boundary of the subject property. Also the dedication of twenty (20') foot radius curves at the northeast and northwest corners of the subject property. In addition the granting of and eight (8') foot public utility easement along the east, west and north boundaries of this parcel. The dedication, granting and abandonment statement be shown on the Parcel Plat. 10. The rezone shall not become effective for at least thirty (30) days after final approval of the change in classification by the Board of Supervisors, as per ARS 11-829E, and conditions contained herein. ,."-.. 1- ':'-',~;\ \:j -.,,.;:";";"-' 11. If these conditions are not met within one (1) year this approval by the Board of Supervisors shall be void. If at the expiration of this period the property has not been improved for the use for which it was conditionally approved, the Board after notification by registered mail to the owner and applicant who requested the rezoning shall schedule a public hearing to grant an extension, determine compliance with the schedule for development or cause the property to revert to its former zoning classification in accordance with Arizona Revised Statutes Annotated, Title 11, Chapter 6, 11-832. WHEREAS, the notice of hearing was published in the Kingman Standard, a newspaper of general circulation in Kingman, Mohave County, Arizona, on March 20 1993, and posted as required by Arizona Revised Statutes, and the Mohave County Zoning Regulations. :-"" " . i " ..".....,.,... f.. Resolution 93-89 Page 4 PAGE 4 OF ~ BK 2200 PG 733 (F~Et93-18620) NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday AprilS, 1993 approved the granting of this zone change as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
