PAGE 1 OF 3 MOHAVE COUNTY BOARD OF SUPERVISORS RECORDING FEE 0.00 Ne RESOLUTION NO. 93-87 A RESOLUTION SETTING FORTH APPROVAL OF THE REZONING OF A PORTION OF THE RICE BIRD MINING CLAIM IN THE SAN FRANCISCO MINING DISTRICT, SECTION 23, TOWNSHIP 19 NORTH, RANGE 20 WEST, FROM: A- R/36A (AGRICULTURAL-RESIDENTIAL/THIRTY-SIX ACRE MINIMUM LOT SIZE) ZONE, PROPOSED TO BE: C-1 (NEIGHBORHOOD COMMERCIAL) ZONE, LOCATED SOUTH OF OATMAN TOWNS ITE ALONG OLD ROUTE 66, IN THE OATMAN PORTION OF THE MOHAVE COUNTY GENERAL AREA, MOHAVE COUNTY, ARIZONA WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on Monday, AprilS, 1993, a public hearing was conducted to determine whether approval should be granted to Ellen Delong Harvey of Oatman Arizona, for a zone change from the existing A-R/36A (Agricultural Residential/Thirty six Acre Minimum Lot Size) zone to C-l (Neighborhood Commercial) zone located along Old Highway 66 south of Oatman Townsite, Section 23, Township 19 North, Range 20 West, and WHEREAS, this parcel is located just south of Oatman Townsite, business area. The property is a part of the Rice Bird mining claim, and can be accessed directly off Old Highway 66, and ,..-,'"7\ ~'.~i.~~-~.;) '::A . . Resolution 93-87 Page 2 PAGE 2 OF 3 BK 2200 PG 725 (FEE~93-18618) WHEREAS, review of floodplain map #040058-2475B indicates this area to be located in a FEMA Unmapped Area. The property currently has a structure in the rear of the property that is being used as a residence, but was formerly used as a Hotel. The front portion of the parcel has an old wood structure that was formerly used as a commercial business. The site has adequate parking space for a commercial establishment. The surrounding area is primarily residential, with commercial uses about two hundred (200') feet north of the property. The area across Old Route 66 was a part of a former mining operation with old cement foundations being the only visible evidence of the previous use, : ";' "~,,.) and -..,...... :.~ , --} WHEREAS, the Oatman area was originally established before any zoning or other building requirements. All of the established businesses in the area are operating as nonconforming uses, or without county permits, and WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on March 10, 1993, the Commission Recommended APPROVAL of the requested zone change with the applicant understanding and accepting the following conditions: 1. Compliance with all applicable provisions of the Mohave County Zoning Regulations. In addition to compliance with Mohave County Ordinance 87-1 (Dark Sky Ordinance). J . . The establishment of a minimum lot size based on the size of the parcel per the recorded Parcel Plat. 5. If Old Highway 66 is a part of the Parcel Plat Right-of Way, it will need to be dedicated. 6. The rezone shall not become effective for at least thirty (30) days after final approval of the change in classification by the Board of Supervisors, as per ARS 11-829E, and conditions contained herein. WHEREAS, the notice of hearing was published in the Kingman i ! \. Standard, a newspaper of general circulation in Kingman, Mohave County, Arizona, on March 20 1993, and posted as required by Arizona Revised Statutes, and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday AprilS, 1993 approved the granting of this zone change as recommended by the Mohave County Planning and zoning Commission and outlined herein.
